Scott C*** is lyingHe walked through the property and inspected the yard, which he told me he found satisfactoryI have witnesses that can attest to thisWhat the pictures show is that leaves fall from the trees in autumn (it was October when I moved out), and the quite modest ordinary wear and tear of habitation.
His willingness to lie in order to attempt to extralegally retain money from my security deposit is beside the point however
See http://www.oregonlaws.org/ors/section a BAll of his pictures show what is clearly and reasonably "ordinary wear and tear"Provisions in the rental contract which he wishes to cite are legally unenforceableOf the $he has kept from security deposit, he is only LEGALLY ENTITLED TO the $for carpet cleaningIt is his duty as the agent of the homeowner to prepare the house adequately for the next tenants, however, he can NOT use my security deposit to pay for it, as there were NO DAMAGES OTHER THAN ORDINARY WEAR AND TEAR.
I might remind MrC*** that, under Oregon law, I will be suing him for twice the amount he illegally retained of my security deposit (which will come to $814.40) PLUS the cost of my airfare and accomodation for having to fly back to Portland to deal with his mendacious behaviour in court if he should choose not to rightly return my $promptlyThat he has not been caught sooner conducting such deceptive practices is a shame, for he certainly gives the impression that he has regularly misled tenants for personal gain enough times to be surprised when confronted with Oregon law

Alder Property Management does not do a final walk through until the house is empty and the tenants have
vacatedThe tenant received the move out check listI also explained what the expectations were at move outI have attached the move out instructions
The yard was not maintainedAfter Alder sent a complaint notice regarding the condition of the yard the tenant had it cutHowever this work was done weeks before his vacatedNot everything was brought back to the original conditionPictures attached
It is stated in the move out instructions that there is a charge of $per light bulb replacementThe four bulbs were replaced and are currently working
There was touch up painting plus the air filter was never changedPlease see attached rental agreement under 11.F and pictures

First off I do not appreciate Mr. [redacted] calling me a liar. The criteria for the move out was verbally communicated as well as listed in the rental agreement and move out instructions. The first paragraph of the move out instructions states the following "The Rental Agreement signed at move-in stipulated the property be returned in the same condition received. The property condition report will be used to make this determination. Any alterations should be discussed with the Property Manager. The Property Manager will inspect the property once the occupants has vacated. We do not meet tenants at the property for final move-outs. Should you have specific questions, please call our office".
I have attached Mr. [redacted] move in check list. He list the house to be in good condition. I have also attached a couple pictures of what the yard looked like before a yard service was brought in. I notified Mr. [redacted] on 9/6/16 regarding the condition of the yard. I would be happy to supply the email if necessary. Mr. [redacted] did have a service brought in but this was before he vacated. The yard needed additional work at the time of move out - Mowing, weeding, beds cleaned, annuals trimmed and debris removed. However, as a courtesy and in an effort in good will I'll cut the landscape charge in half. The charge will be reduced to $62.50. The other charges will remain the same as wall repair, painting, light bulb replacement, cleaning the house and air filter replacement are not considered normal wear and tear.

Again, he is entitled to the $100 for carpet cleaning, which I am not contesting. The house was in good shape upon move out, as was the yard. I was a good tenant, and was invited to continue renting the house from Mr. C[redacted] who described me in email as "an excellent tenant" who he would "like to continue renting the property". I was unable to continue, however, owing to personal business necessitating I move. I expect Mr. C[redacted] to fulfill his end of our rental contract and return my security deposit without further inconvenience to me.
