We have completed the accounting and final invoice for this client and will have a retainer refund credit to his credit card for the balance. Our outside billing department will contact him to apprise him of this immediate action taken to appease the client

This client received a retainer refund of $on July 13, - which was the full amount of his unused retainer. We credited that back to his personal credit card and he may have missed that transaction on his statement. The client was contacted to explain this matter and will be
responding back upon confirmation that the unused retainer was returned a month ago. ARH

We will review immediately and follow up. It may be a billing issue with our outside billing department. Please be patient as we review the $352 request.

I am rejecting this response because: The original agreement provided for fees of $195.00 - not $250.  In addition to the original retainer paid of $1950 - On 3/14/17 I was invoiced an additional $1640 for the response to the court  that they are again billing me for by shorting the retainer refund for services already paid for...  By withholding the $212 from the retainer refund , I feel that  the Hernandez Law firm misrepresented their fees and the scope of the work performed.

[redacted] was not our client, her son was and it was for a child support defense issue originally.  [redacted] did the intake for [redacted] who hired the firm to handle a child support defense. A proper general denial was filed by the firm in response to the lawsuit filed by the...

Attorney General's office (see attached). Two attorneys were assigned to represent Mr. [redacted]. One of the more senior attorneys resigned and the case was handled by the first former attorney, who by the way was a former Assistant Attorney General ([redacted]) who was sufficiently aware of the matter. Then the client asked to do a modification which was different than a child support defense matter and we requested an additional retainer which was not going to be paid. The misunderstanding on what defending a child support Attorney General case versus a modification of the original child support order was a factor in us deciding to terminate services so that there would not be a future issue in what what the firm was hired to do and what was going to be done. We understood that [redacted] was in agreement in the termination and refund of monies to him. We aren't sure why we would have received a complaint other than maybe the client has not received the check? Because of the issue with the conflict of communications and expectation of what the firm was hired to do we issued a reimbursement of an amount minus the work we had already done, that amount was $1,738.00 Check 1108 issued July 1, 2017 mailed to [redacted] at [redacted]. We are not sure if she received, if the client moved he has not notified the office. ($212 was kept as an expense even though the contract technically allowed for us to keep more at $250 an hour). We could not reimburse the full amount because of the expense already incurred. We did all we could and there just a misunderstanding on the services to be provided in this matter and because of the extensive hours and time already put into it we were not able to refund the full amount. $212 was kept because of the expenses, the balance was returned to the client.  Respectfully The Law Offices of Alex R.
