I am rejecting this response because:You helped me resolve my problem with the McDonald Hearing Aid Center, however they are not abiding by their agreementEnclosed please find a copy of their receipt indicating the devices were returned in good working order on 05-16-20016, in which they said they would start the refund process for what I have paidNot only have they not refunded me any money but they continue to bill me and have now added late feesI took a copy of all of my paper work to the Elk Grove office a month ago and the lady made copies for McDonalds and assured me everything would be alrightPart of my concern is that they may be degrading my credit status for a situation they have createdIf you can get these folks to honor our agreement I would be most gratefulThank you in advance, [redacted]

Customer was originally seen for a free hearing test in March of The test showed customer had a moderate to profound bilateral hearing lossCustomer did notpurchase at that timeCustomer purchased a pair of [redacted] HD hearing aids on 7/10/The aids were delivered on 7/27/with notation that the fit,function and calibration were OK; but customer had dexterity issuesThe company provided a remote volume accessory to customer without charge.Customer was seen regularly from then until 8/27/when he appeared requesting a returnIt was explained to customer that the right of return is not automatic and he must provide the company the opportunity to adjust, repair, or replace the aidsCustomer flatly refused any options offered, including a free upgrade to more technologically advanced and expensive models – even though customer had no complaints about the fit or function of the hearing aidsCompany relies on Civil Code Section 1790-in that the buyer does not have an unqualified option to return the device for a refund and may return the hearing aid only if the buyer has offered the seller the opportunity to adjust, repair, or replace the device and the seller has failed to do soThe law also states that a buyer does not have an unqualified right to return if the seller offers to adjust, repair, or replace the device and buyer refusesIn this case, seller - the company - has never refused any kind of service whatsoever but customer refused any other options offeredThus, a return and refund is not warranted.The company remains available to service the devices and continue to provide its high quality services to customerThe customer should contact the office and schedule an appointment to be seen and to receive service on his devicesThank you

[redacted] ("Customer") was seen in the office and provided a hearing test on 11/20/revealing a moderate to severe bilateral hearing lossThat same day Customer purchased a pair of LINX hearing aidsThe hearing aids with custom ear molds were delivered on 12/8/with no complaints about fit or function of the aidsThe left aid was repaired and replaced on 1/23/The left mold was reordered and delivered on 3/11/and notes indicate Customer was doing well with replacementsCustomer received new receivers on 6/9/and the fitting was deemed completedCustomer was seen several times for batteries from 6/9/through 8/6/- a period of days with no adjustmentsCalifornia State Regulations permit a return for refund within days of completion of the fittingThe fitting was completed on 6/9/and the 45-day return warranty period was exceeded on 7/24/and the right to return was lost on that dateTherefore, a refund is not warranted

I am rejecting this response because: the fact that I have unmatched parts on my one remaining hearing aid shows that there have been problems It is not as the company said that I had no problems I know that I have had the hearing aids for over the warranty period My complaint is that my one remaining hearing aid is now unusable because I can not replace the one that was lost The hearing aid would not have been lost if it was properly attached The fact that Mr [redacted] no longer works for you is convent for you He assured me that my hearing would not be obsolete before it was paid for and it obviously is obsolete or I could have bought another one to replace the lost one This company sells overpriced hearing aids that fall apart as soon as the warranty is up and I also think they take advantage of seniors

The return agreement Customer signed states the refund will be made 30-days following the actual return on 11-16-The refund was attempted yesterday but there was a glitch in the electronic systemThe refund will be made as soon as the system is up - hopefully later todayThis would be within the time frame stated in the agreementsPlease return another complaint resolution request so that confirmation of refund can be sentThank you

I am rejecting this response because: The hearing aids became faulty after the period of adjustment, and when the third adjustment of the ear buds still did not solve the problem of not falling out, and the ear piece pulled off twice, the second time sticking in my ear to the point that I could not get it out and needed assistance to do so, I feel that the company is not providing the proper care In addition to that, over the period of time that I have had them, they began to echo and became more a hindrance than an aid I also know that I am not the only person in Chico to have experienced this dissatisfaction with the company and that person did receive a refund This client had the hearing aids just about as long as I did

A full refund has been made to customer's [redacted] accountHis account is now closed and the company no longer has access to the account information due to privacy restrictionsAny money customer has paid to [redacted] that is due to him will be refunded to him directly from [redacted] Thank you

I am rejecting this response because: I was surprised she didn't check the hearing aid instead of looking in my ear and lying about seeing black in my earI also looked because she had it on camera I didn't see anything but a LITTLE waxI would like to have them investigatedI was there once when a gentleman walked in the door and [redacted] made a remark like "What is Your problem?"She clearly does not want to deal with problemsThe other girl ,Catalina, was there both times but she most likely she would side with them for fear of her job she just startedI will take legal action if I have to and go public with these peoplerip offs

Consumer was provided a free hearing test on 5/10/and completed lifestyle assessment forms indicating a need for hearing aidsShe purchased a pair of Enya RIE hearing aids for $3,that were delivered on 5/31/without incidentConsumer appeared for regular service and adjustment from then through 8/2/Company records indicate Consumer kept an appointment on 7/26/but did not mention ANY complaints about the fit or function of her hearing aidsThe Revdex.com complaint was the first indication Consumer was not satisfied and has never requested a refund and return as she agreed to do in her signed purchase agreementBuyers are afforded days from the date of delivery to request a refundCompany records indicate Consumer did not request a refund prior to the date of the Revdex.com complaint - a period exceeding daysTherefore, Consumer has lost the right to request a return and refund (1) because she never requested a refund directly from the company, and (2) the request from the Revdex.com was made at least days after deliveryThe request for refund is denied
