Our Company has reviewed the complaint by said customer and determined there is no merit to the allegations. The loan documents contain all required disclosures that was presented to customer to review and sign. The warranty agreement does not...

contain the verbiage "bumper to bumper" as claimed and this document was signed by the customer as well. Our company has an agreement with only one Credit Reporting Agency and reports only to this Agency. Our Company has fulfiled its ogligation as a lender to said customer.

This is not acceptable. Within the packet of things to sign, there is a page that my husband and myself had to sign acknowledging to reporting to credit AGENCIES (plural) as well as what their employee told me which is a verbal contract and is legally binding in the state of Missouri. Also, I never said the pamphlet said "bumper to bumper" I stated that I was told that BY THE EMPLOYEE which is who also signed my contracts. If his verbal contract is null and void, then the written contract that he signed should be also. As far as the "company only has an agreement with the one credit reporting agency and only reports to this agency".... I bet that would be a totally different story if the tables were turned and I was the one breaking contract. I have no doubt that this company would somehow report to ALL THREE. I was made numerous promises by the local office and none have been kept. I have sent a notice through the "contact me" on the company website requesting for someone in corporate to contact me, which has yet to happen. I am willing to provide Revdex.com as well as any other entity copies of contract, including that notice of reporting to credit AGENCIES (plural... and if they only report to one, right there is deception in writing) as well as any and all copies of e mails between myself and staff of this company as well as the company retained attorney, all who have ignored my recent attempts of contact. Right now, this company is in breech of contract and unless they make it right by 10/31/2015 as stated in the statement I sent requesting to speak with someone in corporate, it will be filed with the appropriate courts. This company thinks I will just bow down and take this, I will fight to the end, all while keeping my end of this LEGALLY BINDING CONTRACT. I have proof of all payments made, I have my copies of all contracts and statements that were signed, as well as their company has security cameras that they legally have to keep footage for a specific period of time that will show that they are in violation of Federal law when it comes to the way the company presented my contract (not showing me every page) as well as verbal contract that is valid in the state of Missouri. The longer I have waited to file, the more information and people I have found that this has happened to. I am going to stand up for everyone that this company has taken advantage of. I will not stand back and be yet another person who gets scammed. I am NOT asking too much! I am asking for what was promised, the entire reason I obtained this loan, which was for credit reporting and that is why I went with this company because I was PROMISED reporting to all 3 bureaus. I am paying about $350 a month, PLUS full coverage insurance and over $10,000 total on a $6500 loan! THE LEAST I DESERVE is to report this loan to the credit bureaus like I was promised. That is what this entire fight is about! for paying over $10,000 for a 2003 BMW with over 100k miles... the least I deserve is what I was promised with credit reporting! And I will not stop until it is either reported in its entirety to the credit agencies, or until I am no longer liable for this loan. I am not asking too much for what I am paying and what I was promised, and I have numerous other people who would have no problem going to court to tell the judge the exact same thing.

I have e mailed Omar numerous times, including last week when this unsatisfactory response was given on one of my complaints with another agency, and he has yet to contact me back! I will NOT talk over the phone with anyone in that company as it seems they say things then do not follow through, so any and all contact with Superior Finance and/or [redacted] will need to be in writing.
Now in regards to this response... I have e mailed Omar and asked for specific figures in regards to the insurance/warranty etc. I do not feel a "prorated/partial" refund is fair as I was not informed of the astronomical price associated with these items, as like I stated before, I was not shown a lot of information in regards to the "contract" and I started this complaint about price etc months ago and this response is the first I've heard about canceling it. We have not made a single claim or contacted that company in any way so their services were not used. We should be entitled to a full refund due to those reasons
Now in regards to the reporting to credit... This is the exact reason that I am not willing to speak to anyone in regards to this matter and want everything in writing... Their employees both told me on numerous occasions that Superior reports to ALL 3 MAJOR CREDIT BUREAUS... "That is a great thing to look at when obtaining any loan, be sure you are getting credit for what you pay. We report to all 3 so your credit will raise across the board".... statements like that are EXACTLY why I chose Superior over other local finance companies. There are other companies that do report to all 3 including Heights Finance and Sun Loan, but I went with Superior because of that promise as well as the "bumper to bumper" warranty that I was promised. That is deception from day one! That is deceptive lending practices and in violation of federal law. There is even a form that my husband and I had to sign acknowledging that they report to credit BUREAUS.... PLURAL!!! It is there in black and white on the paperwork they had us sign! DECEPTION!
We were misled in so many ways in obtaining this loan. I have attempted to settle this outside of a courtroom. I have set deadline after deadline for them to comply and they refuse. These complaints and a possible resolution are the final straw in regards to trying to resolve anything outside of a courtroom. I will not back down and I will fight to the end. I have 6 other people who have had very similar run-ins with this company, as well as a car dealer who has told me he is now refusing to do business with this company because of the shady business ethics shown. When will enough be enough and this company stop swindling people?!?!?!
In all honesty, am I asking too much? Seriously! I am paying OVER $10k for a 2003 BMW that the purchase price was $6500... come on! I am asking for what is fair! I was promised reporting to all 3! It is not going cost Arvest or Superior a ton of money or even much time at all... likely less time and money than has been spent on fighting me on what I was promised and you've run your name through the dirt in the meantime!
Is there no such thing as customer service anymore? "The customer is always right" doesn't even matter here... it is more "the customer deserves to have what our employee promised" is more like it. Does [redacted] not even care about deceptive lending, which is against Federal law... Your employee misled myself and my husband. I have proof in your own paperwork that I had to sign. The loan and the company were misrepresented, and we were severely misled! I know for an absolute fact that if I were to become in default on this loan, Arvest/Superior would magically form a relationship with the other 2 bureaus and report to all 3 about the default... but they won't do that when someone is paying them an arm and a leg and following the contract even though the company isnt... That is very low but we all know it is true...
I have requested reporting to all 3 bureaus (including all past payment and account information) as well as breakdowns of what goes where and for the joke of a warranty to be what it was promised. Since getting what I was promised with the warranty is not possible and I now know that I can cancel all of that (If Omar would ever contact me with the information I requested)... is it too much to ask to just send info to a couple of credit agencies and uphold what your employee told us?
Your company claims that you have no record of any of that... well of course not! It was your employees conning us into getting a loan there so he could meet his quota or get commission! He didn't care what he had to say to get us to sign, he said it! And now you, as the company he represented, should honor it! The last responses given had to do with "change in management" etc... No one seems to know what is going on in your own company since you needed an extension for that reason, how can you honestly say that you know we were not told that when it seems no one there knows what anyone else is doing.
It is not too much to ask! $10k for a 2003 BMW.... the least you could do is report as promised so it shows that I keep my obligation, no matter how much I am on the losing end! You can see in my account, you are paid and you are normally paid early! Customer service... customer satisfaction..... JUST DOING THE RIGHT THING!!! It makes no sense to me why I am being fought so hard over you just sending something to a credit agency! It can't be that hard!
Very sad that not only can a company not care about their customers, but this is the exact reason why a mans word is never good enough anymore.... very very sad!
