We are working on Case#[redacted] to make the customer happy. Rite-Way Waterproofing fulfilled the contract and is making further attempts to resolve.

Rite Way's response...

does not solve our issue. We asked them to come out and see what it would take to get the area sloped and the walls waterproofed down a few feet as stated in the bid requirements. Instead of doing what we'd asked, we heard of why they couldn't do it and proposed another solution. We appreciate the ideas, but we cannot afford nor have the time to implement a $22,500 plan.


Our property committee commented, the drawings are nice, but we wanted the walls waterproofed and ground sloped by now.


[redacted]'s disappointment with this company continues. We spent $4500 on an interior tile draining system. The interior was not our greatest concern. And the walls still leak. And we still have big bills to pay the company we remain dissatisfied with.

I originally sent a bid to [redacted] from [redacted] Construction a over a year ago. [redacted] gave our company the square footage of a building that they were looking for initial pricing on. They wanted to get a ballpark price to see what it would cost to fix. Several months later I get contacted from a [redacted] at the [redacted] Lutheran Church wanting to discuss the bid I gave to one of their parishioners named [redacted] from [redacted] Construction. I set a meeting with [redacted] to do an onsite estimate for waterproofing.
I originally gave an estimate for the job in late winter/early spring. The original estimate was for [redacted] Construction and they were looking for a ballpark price based square footage bid on exterior waterproofing. Months later she and I met onsite to do a more detailed estimate of what needed to be done. The original estimate/ballpark was for $30,000.00 and t was going to increase dramatically if we did the waterproofing on the outside of the west wall. One of the main footings supporting the roof was in the way. I gave her the alternative of doing interior draintile on the inside for the west wall section instead. Another reason we decided to do the draintile on the inside on the west wall (storage room) was [redacted] pointed out that in the doorway to the storage room and other area's water had came up through the floor. (NOTHING ON THE OUTSIDE CAN FIX THIS ITS PROVEN SCIENCE). The ONLY way to deal with hydrostatic pressure from under the slab is from the inside using interior draintile. The interior draintile system and the exterior waterproofing for the front of the building were explained in great detail when the contracts were written. [redacted] and her committee reviewed those documents and signed the contracts to have us complete the work as stated in those contracts. [redacted]Please see attached contracts[redacted] That being interior draintile for the storage room (west wall) and exterior waterproofing for the front of the building right of the entryway.
The contract for the interior draintile system (which was explained in detail, diagramed and signed and accepted by the church) clearly states:
Block Cavities Filled with Cement - NOT Guaranteed
Dampness & Condensation on floors and walls - NOT Guaranteed
I have offered 4 different solutions (3 of them at NO additional cost to them):
1) To seal the block walls on the inside with concrete sealer - AT NO CHARGE
2) To install a Polydrain(c) (dimple board) all the way to the ceiling level on the walls to capture condensation, moisture or water from the core filled blocks and deposit it into the draintile system. - AT NO CHARGE
3) Coat the walls with XYPEX Concentrate(c) a crystalline method to seal a core filled block from the inside - AT NO CHARGE
4) Exterior (what they requested) Estimate for diversion of roof water **See attached file for the actual estimate
Keep in mind all 4 of these solutions are NOT to fix anything that is under warranty by Rite-Way nor are they items that we didn't fulfill on the contracts. They are solutions to an issue that is causing all these problems, in the interest to satisfy the customer.
We have did everything in our power to come to a agreement with [redacted] and [redacted] Lutheran Church. We at Rite-Way have went above and beyond to fulfill our responsibility of this project. We had 2 contracts with [redacted] Lutheran Church c/o [redacted]. Each contract has been FULLFILLED by us in its entirety. The church has an outstanding balance on this project in the amount of $4500.00 which needs to be paid in full immediately. There is NO work left for us to do at [redacted] Lutheran Church as stated by the contracts.
Final note: What they asked for originally could NOT be done, not then and not now. The West side could only be fixed from the inside due to the location of the structural and massive footing sitting about 8'-10 deep in the soils next to the wall in question. The new proposal they requested is for exterior water control (still not a waterproofing solution) it is to move water away from the foundation to help alleviate the saturated soils in that area. The exterior wall can NOT be waterproofed from the outside all the way down to the footing. This is the way they keep asking for it to be done and it has been told to [redacted] and her committee over and over again that is NOT an option.
They had hydrostatic pressure under the slab from water pushing up, they had water filling up in the open cores of the block walls. All of this water is being captured by the interior draintile system we installed and is FULLY functioning. The area's the blocks are core filled are getting damp, wet & sweating because of the water outside sitting against the wall (The area that is inaccessible). This is what I gave 3 no cost options to remedy but they want nothing to do with these answers to their complaint. We did what we were contracted to do and that was to fulfill the 2 contracts that were signed and dated by the [redacted] Lutheran Church & [redacted].

We appreciate the cooperation of this business with our complaint. The interior resolutions offered do not address the point of entry: the exterior work recommendation from our study which the company was to bid from: Excate down the exterior grade to approximately 2' depth; cleaning the existing below grade wall
surface; installing an EPDM lens sloped away from building; and fully adhering the membrane
up the wall and terminating to the wall surface. Ensure seams are fully bonded to create
continuous drainage lens. Backfill with free draining soil, and add new top soil. We will resolve our complaint should the company agree [redacted] has paid in full as we have remitted a total of $38,500.00. Thank you.
