Horsburgh & Scott (H&S) supplied a gear drive to the Customer in Mexico in October, The gear drive experienced lubrication and bearing problems within the first month of operation of which both were corrected immediately by the Customer and within weeks thereafter the work performed was verified by a field service technician from H&S to have been done properly H&S has requested five (5) times in writing and two (2) times in person for a report detailing the work performed and cost incurred by the Customer for H&S to review and agree on an amout to reimburse the CustomerTo date nothing has been received by H&S Subsequent problems with the gear drive have been caused by the Customer’s installation and operating procedures H&S has offered to buy back the unit at a prorated cost but without agreement by the CustomerThe Customer has not paid H&S for 30% of the original price and this remains an issue for H&S to resolveThe unit continues to run at the plant site operating its intended equipment
