I am rejecting this response because:The truck paid for.Some of the story that *** has told seems to be very fictionalI went to *** when I was chronic Lyme diseaseTold him the issue I had and asked if he could do the auction and the shop he said he could but I would certainly get more money if I bring it to him.I told him when I was able to come up with the money to get a truck and help I would contact him.at this time I was not well so I had to hire help to get things to *** plus come up with to get the truck paid for.I delivered as asked by *** he seen everything I had and said when there was a a opening he would throw my things on a auction I told him I want to get as much as I could for the smoker and he told me to put a reserve on it I let him know it would be a dollar s he agreed we’ll come to find out that he auctioned the smoker and not the rest of my thingsKnowing I needed the money .the l received a call from the auction house on the way home but was having issues with my phone I did not receive the items that I paid for which was a mattress box for my bed and after getting home I see that I had two back packsNow *** sold my smoker but I have yet to receive the money for it and he told me he had a check for me.but I have yet to see it I believe dollars is a lot of money why was my things not auction ed I believe *** should deliver back to me what is mine or pay for the help and truck that is needed to get my things

[redacted] called sometime in November and said that he wanted to bring a large load of restaurant equipment from his closed BBQ business, that he was going to rent a truck and bring them to us in order to have an auction. He had been talking about this for almost a year but had never done so. I...

told him that there were No upcoming restaurant auctions in the schedule any time soon, and certainly not by the end of the year, since we were so booked up already. He said he had a lot of equipment and would need to make two trips and was fine with that, but that if I could even sell his smoker with anyone elses equipment before then, that that would be great. I said if something allowed for it, I would, but NO promises.   He dropped off the first load and it was almost all “smallwares”, pans, containers, etc., with a smoker, stainless table, refrigerated case, being the large items. When I questioned him why almost no major pieces of equipment, he said there was another 1-2 smokers, a 2dr refrigerator, refrigerated prep table and more on the next load and that he would be bringing those down in the next couple of weeks and he would contact me with a time.   I waited a few weeks and tried calling him a couple of times to check on the additional major items, but received no reply. We were extremely busy and I tried again at some point and left a message, but again no reply.   We had an auction that ended before Christmas and I seen that he had won a few items, so I figured I would see him and talk to him then. I asked the gal at the front to let me know when he came in so that I could drive over and see him to talk about the rest of the missing equipment. He came and she told me, but he grabbed his stuff when he seen me and flew out the door before I could talk to him. I literally ran out the door and tried to catch him and called him while he drove out the driveway, and of course, no reply..   We discovered sometime after he left, that he was given one too many items, a Wirth backpack. So I tried calling him again and left a message regarding this matter as well as well as the fact that if he was not going to bring additional equipment down that he would need to pick up his items or pay for the storage of them.   The next day, Saturday Dec 23rd, I received a call from a [redacted], saying that he was an “Investor” of [redacted]’s and that [redacted] had contacted him asking him to call me about the equipment that had not been brought. [redacted] proceeded to tell me that [redacted] was in the hospital for some treatment and traveled so little and that was why I could not get a hold of him. I asked him if he was aware that [redacted] had been down the previous day to pick up his items? He was shocked and incredulous to this fact and said that if [redacted] was sick and didn’t have any money, why was he bidding. He said that he would contact [redacted] and get some answers and get back to me the following week.  I did not hear back from him and for a week or two and contacted him again. I think this was around the second week of January or so and he apologized and said that [redacted] told him that the refrigerator was broken and would not be worth anything. I asked him about the other smokers, refrigerated prepaid he forgot to ask [redacted] but would check and call me back. He asked if I had any restaurant auctions that I could add the existing items to, and we did have a restaurant auction going, but it was already a week into the auction and could not add that many small items to it. I informed him that we had [redacted]’s smoker in that auction but could not add that many smallwares to that auction.   He said he would check with Ron on the other equipment and get back to me later. When he did call back, he said that there were “issues” with the other smoker (was two additional but now one?) but could not elaborate.   [redacted] asked if I could auction off the existing items, even at a higher commission %, and I said I would like at the equipment and let him know, but that I figured off the top of my head that there was not even $3,000 there and I could not even remember since it had been so long that I looked at the items in that warehouse. I did look and in my opinion, there is not even $2,000 by itself and cannot run an auction for a consigner for so little. With almost no large anchor pieces to stir interest and mostly smallwares, I told [redacted] that I could likely add them to an upcoming restaurant consignment auction but did not know when. [redacted] asked me to tell him what I thought would be fair for a higher commission % and I said I would go look again and get back to him. Meanwhile, we received this letter and yet NO calls from [redacted] himself, Ever.. [redacted] has had a check sitting on the desk, waiting for him, but until we knew what was going on with the rest of his situation and issues, have not mailed it.   We are Not a Free Storage Warehouse and have been more than fair in storing [redacted]’s items, based on the assurance that further large equipment would be coming and we have tried our best to communicate with him and he has not responded at all. [redacted] had been a long time customer in good standing, but this has never felt right, with him refusing to return multiple calls and to have a second party handle his conversations and to finally make up baseless accusations.   So at this point, due to the fact that [redacted] broke his promise for our arrangement, the only option is for [redacted] to pick up his items, minus the smoker, with his truck and own help to load by Monday, March 26th between the hours of 10am and 2pm during the workday Only. There will  be afforded , no weekend or evening hours at all. NO help will be provided in any form and he will need to schedule the time for removal 24 hours ahead of time. In the event that he does not comply, he will forfeit ownership of these items. Thank You
