Sorry, just found this notice in junk mail folder after listening to a message from Shelby that it was sent. I have been out of the office and just tried to call Shelby to advise, but, office was closed. When Mr. [redacted] notified us what happened, we did refer him to the masonry contractor that did...
the work. That contractor refused to do anything about it and I'm assuming because we haven't used him for a few years now. We contacted Bill [redacted] with the Home Builders Association of Illinois and told him about it and that we had a 1 year warranty with the first buyer of the home. He said the 1 year warranty applies and they had just won a case similar to this situation and said to stop contact with Mr. [redacted] after we told him it was a 1 year warranty with the previous owner..In the past week, we received a letter from Mr. Winkler's attorney. We called Bill [redacted] with Home Builders Association of Illinois and he gave us an attorney's name to contact. However, he was not knowledgeable of construction law. I contacted the National Home Builders Association and their legal team is on vacation also due to the holiday this week. They are going to send me a list of attorney's to contact.
I am rejecting this response because: All-C keeps on stating that the house came with a 1 year warranty with the original owner. Per the Illinois Implied Warranty Law of Habitability, all components of a house are warrantied for the quoted 1 year, BUT structural components are warrantied for an additional 10 years (11 total). This warranty is also transferrable to subsequent home owners. Based of the construction of the failed columns and archway, the stonework was not merely veneer, but was an integral structural component.As All-C pointed out in their response, I have had to hire an attorney to help get this resolved. I will no longer communicate with them directly and keep my interactions with them through the Revdex.com at a minimum.
