Hello my name is Robert H [redacted] and I am the owner of All Decked Out Construction I am emailing you in regards to a complaint # [redacted] that I had received as being filed against my company by [redacted] ***, [redacted] ** *** I have attached documents for you to review that will support my responses to [redacted] 's allegations which I will refer to throughout this letter The deck was stated to be flexing and creaking but as you will note in the highlighted areas of the attached email from Azek representative [redacted] after his site visit this is for the product He stated "As I explained regarding the creaking/noise - this can occur with the Concealoc clips which chosen as the fastener" and " I did not notice any unusual flexing of the material on your deck" This is standard performance for these products She may be unhappy with it but her issues are not caused by incorrect installation techniques Also, please refer to the copy of the final building inspection report where the inspector states "This is not a code violation It appears that the decking installer used the hidden clips by the manufacturer." and "framing inspection did not turn up any large spans." We have installed the product at or above building code and minimum install requirements by the manufacture in accordance with [redacted] 's budget and requirements for this project The concern of the screws not being installed correctly and within 1/2" of the end of the decking is invalid Please refer to the highlighted area of page #of the Azek installation guide as attached For cortex screws, which is what we used, it recommends 1" and anything closer should bve predrilled This is an error on both Azek's and ***'s end If either one of parties took the time to read the installation guidelines completely they would realize this is not an issue and the fasteners are installed in accordance with requirements as documented [redacted] also had concerns with the cantilever of some of the decking boards and lack of recommended blocking These recommendations can be found on pages #and #of the attached Azek installation guidelines These are not requirements they are recommendations These issues, as noted in the Azek guidelines "may" prevent problems but in no way are incorrect, unsafe, or void the product warranty They are recommendations that are made by the manufacturer with no account for local building codes or varying styles of deck design and structure They are blanket statements to alleviate manufacture responsibility for the concerns with performance of the product when installed to the bare minimum requirements and under a variety of variables that can exist through install in a wide variety of climates across the world While we could have followed all these recommendations and built the absolute best deck possible [redacted] 's budget did not allow for that In construction there are the minimum requirements to make it safe and avoid warranty concerns which are also the cheapest route and then there is the absolute best way to do things which is often and in this case much more costly One of, if not the greatest of, the concerns for [redacted] when negotiating this project was price We always want to build the best structure we can but are often forced to compromise somewhere between minimum code/install requirements and the upper limits of a customers budget Lets face it, not all consumers have the budget or are willing to spend the money it takes for a flawless install of this type The blocking is not required by local building code and was not part of the originally agreed upon plans and proposal We can go back and install this blocking if [redacted] would like but additional charges will be necessary If you will take the time to read thgrough the attached Email from [redacted] of Azek no where in it does he suggest that I make these repairs as [redacted] has incorrectly stated [redacted] simply noted what he saw in accordance with their recommendations [redacted] has some how misconstrued this as a list of faults in the deck and/or Azek suggesting I fix these issues which is not the case The plumbing lines are not being installed because [redacted] had contacted the building department without my knowledge to schedule a final inspection and informed the inspector that the deck was done and they would be installing the shower At this point my permit was closed out and a final inspection report was filed This can be verified by reviewing the copy of the final building report that is attached I had contacted [redacted] several times to try to clarify this issue to which I received no response At this point my council had advised me to avoid doing the install of the plumbing lines that [redacted] had mentioned to prevent further problems on my end because [redacted] continually had unreasonable complaints with the deck and continued to provide me with increasing lists of her concerns which have changed and been added to frequently and fluidly We would discuss a resolution and I would implement it in accordance with her requests and then she would change her mind the next day I'm happy to make changes as the client likes but additional labor due to changes in plans comes with an additional cost which the client is not willing to assume The drain [redacted] had mentioned was not part of the original proposal or scope of work I had never agreed to install a drain Furthermore, the drain [redacted] is requesting we install would be rendered useless as it would be up hill from the suspected affected area and water does not flow up hill She wants a drain under the deck because she believes the deck is blocking the flow of water which is incorrect Gaps in the material allow water to flow If this were the case every deck on the face of the earth would act like a giant catch basin every time it rains and fill up with water which is not what happens Gaps in the decking are there to allow drainage and air circulation Myself, my council, Azek, Azek's council, [redacted] and her council are all working together to come up with a resolution which [redacted] was aware of at the time this complaint was filled As with any situation involving corporations and big business things of this nature take time There are many layers to go through and red tape to cut to make it happen Funding needs approved and a resolution and payment structure will need to be agreed upon prior to any further work being preformed I have made no less than three separate trips and invested close to man hours trying to resolve all [redacted] 's complaints Attempts have been made and every time the list continues to grow After one set of problems is fixed another constantly arises I have made several attempts in good faith to correct her problems and make her happy I cannot to continue to supply endless amounts of labor when payment is being withheld on job that is complete and has passed final inspection without a written agreement One will be provided to [redacted] for approval once all parties have reached agreements on level of participation in this resolution Please contact me at
