I was hired to paint the exterior of house located at [redacted] for [redacted] and [redacted]. In addition to the painting, I was hired to do wood repair, wood replacement, gutter repair, installing 3 wood columns on the front porch, building new wood steps and handrails, The total...

quote was $11,587.20. After week 1 we successfully scraped peeling paint, primed almost the entire house, caulked cracks and gaps in wood siding and trim, bondo patched wood trim, replaced several siding boards that were rotted. After week 2 we painted 2 coats of paint to the entire house, installed the 3 wood columns, installed handrails, replaced most of the soffits on the exterior. After week 3 we were in the process of starting the demo of the old concrete steps and building new wooden steps, at this point we were about 90% done with the job. I received 2 payments of $4,000 in the first two weeks, $3,000 immediately went to purchasing paint and supplies and wood siding boards, wood columns, and materials needed for building handrails, $4,500 went to payroll for my workers. In my original quote I clearly stated that I would replace wood that was rotten or damaged, this did not mean that I would replace ALL soffits on entire exterior of house. I approached [redacted] and [redacted] and advised them that the soffits were in such bad shape that it was not possible to simply repair them, when I tried to repair selected area's of the soffits they would literally crumble, they were saturated with rot and water damage from a previous storm ( a huge tree limb fell into the house damaging the roof, soffits, fascia and gutters. The exterior of the house obviously was not properly maintained, on the other sides of the house the soffits and siding boards were rotted. [redacted] and [redacted] gave me verbal permission to replace all of the soffit on the house and they were informed that there would be an additional charge for this, and she very clearly stated that this was not a simple soffit repair as stated in the original quote and that she had no problem paying the extra cost.  I have 5 witnesses that will testify that [redacted] and [redacted] did give me permission to replace the soffits for an additional charge. So, we proceeded to replace all of the soffits, along with the siding boards, I visually inspected the gutters and downspouts and concluded that they were not leaking, we were done with the painting except for a small garage and we had only the wooden steps to complete. I sent [redacted] and [redacted] a final invoice with the remaining balance due of $3,587.20 on the original quote and the additional charges for the soffit replacement $2,000, Replace facia board on tree damaged side of house $400, install new handrails $750, install new trim board on left side of house $80, and an extra charge for paint change $240. When I spoke with [redacted] the next day after I sent her the final invoice, she was very upset with the additional charges and immediately refused to pay for the additional work. I tried to explain to her the additional work that was involved and the costs and she did not want to discuss any further. She tried to tell me that the additional work on the soffits was included in the original quote, even though her and [redacted] agreed to pay the extra cost several times in our conversations, and my employees are my witnesses to this. She refused to pay the extra money and then she fired me off the job. After she had fired me, my workers were still on the job working, and she arranged to have them finish the job and she stated that she would pay them the remaining balance due (instead of me), My workers showed up the next day to work and she would not let them work and she called me and asked me to come gather my tools and clean up the yard. I came by her house to gather my tools and ladders and I did not clean up the yard because I felt that I was being taken advantage of and we had completed 90% of the work and we were fired off the job. I honestly felt bad that I didn't clean the yard, paint chips, etc. but I felt like I was cheated out of $7,000 remaining balance owed to me. It is unfortunate that the project had to end this way, but I did my job and I was honest and upfront with [redacted] and [redacted] about the additional costs and it seems to me that they wanted the extra work done but didn't want to pay for it, and the only option they had was to fire me.

I have attached the agreed upon quote for this work which we reviewed with Scott prior to him starting the job. Please note the following in the quote: The agreed upon total cost was $11587.20 of which $8000 was paid.  Work included in the $11587.20 cost that was not completed is listed below: *Garage and Front Porch (listed at $1560).  This was not started at all, no side boards replaced, no scraping, no painting, etc. . . not started. *Exterior residential carpentry work (listed at $2550).  It's important to note that some of the carpentry work was done.  Three new columns (150 each) were replaced and some siding boards were replaced.  Sofits were replaced (with band-aid repair simply covering old wood with a new board (this is the disputed additional $2500 that he wanted to charge despite it being listed in original bid).  Facia board was not replaced along all sides despite quote including that and Scott was charging $400 extra which I reluctantly agreed to pay.   There were a number of things that weren't completed.  I'll list the incomplete items, below:      -Demo old concrete steps, install new wood steps and handrails     -repair gutters as needed     -some wood siding repair not done (including top right corner of house- this is actually part of facia board)In addition to what I've listed above, the paint work from the original quote was also not completed.  The parts not completed include:  front porch, doors, touch up paint, areas where they accidentally used satin finish over flat on the west side of house and told me they would fix, and foundation of entire house.  On top of everything I've listed above, a horrible mess was left.  There were 0 tarps used on the job and clean up did not occur each day.  In fact, clean up never occurred.  Paint buckets I paid for were left out and open in the heat after the painters left and paintbrushes and rollers left in the buckets (I have pictures and video of all of this).  Paint chips all over my yard, none of old wood removed, trash and cigarettes left in my yard. I have pictures and video of all of this.  One final thing to note:  Scott didn't follow any of the required clean up and proper disposal of lead paint due to their environmental impact.  These paint chips were left in our yard for weeks.  This is why the clean up we've done has been such a large effort.

I have pictures and video of all of this.   (SEVERAL DROPS WERE USED ON THE PAINTING PROJECT, THERE WAS SOME MESS ON THE PROPERTY WHICH WE PLANNED TO CLEAN ON THE LAST DAY OF PROJECT AS HOMEOWNER DID NOT HAVE ISSUES WITH IT, COULD NOT THOROUGHLY CLEAN DUE TO BEING FIRED OFF JOB)One final thing to note:  Scott didn't follow any of the required clean up and proper disposal of lead paint due to their environmental impact.  These paint chips were left in our yard for weeks.  This is why the clean up we've done has been such a large effort. (HOMEOWNER DID NOT INFORM ME IN THE BEGINNING OF THIS PROJECT THAT LEAD BASED PAINT MAY BE ON HER HOUSE, STATE LAW REQUIRES THAT SHE PROPERLY INFORM ME. AS FAR AS PAYING SOMEONE TO CLEAN HER PROPERTY, I WOULD HAVE CLEANED THE PAINT CHIPS BUT I WAS FIRED OFF THE JOB, MY GUESS IS HOMEOWNER COULD NOT AFFORD TO PAY FOR EXTRA WORK DONE ON THE HOUSE, BUT REPEATEDLY GAVE ME VERBAL PERMISSION TO DO THE EXTRA WORK FOR AN EXTRA CHARGE. I HAVE SEVERAL WITNESSES THAT CAN TESTIFY THAT I REPEATEDLY INFORMED THE OWNERS OF THE EXTRA COSTS AND THAT THEY AGREED TO PAY IT, AND THEN WHEN THE FINAL INVOICE WAS SENT TO CUSTOMER, I WAS SUDDENLY FIRED OFF THE JOB)Regards,[redacted]Attached Files/Documentsus why here...
