We had a contract with All Jobs Construction to add a room to our home. We paid $1300 down on April 6, 2017 to get a permit and blueprints. However, since he couldn't get the permit in a reasonable amount of time, we had to return to Iowa. The permit is only good for 6 months, and he had all summer to acquire the permit in order to start work on the 6th of November but failed to get the permit. Before we left Iowa to return to Arizona, I called to verify he had the permit and was going to start work on the 6th of November like he promised. He said he was getting it and could start on the 6th like he promised. We came back to Arizona 2 months early so he could add the room on before the end of the year. After we arrived back in Arizona on the 1st of November, he still did not have the permit. The construction was supposed to start November 6, 2017 but has yet to commence. We called several times to resolve the issue but just keep getting delays and increases in total price when we speak to the project manager ***. He did admit he was wrong by not getting the permit in time to start work on November 6th.

All Jobs Construction Response

Dear Mrs.: and the Revdex.com,

My name is *** I am the Owner of All Job’s Construction Inc.

I was contracted in April about the 19th we signed a contract to build a 108 Sq. foot addition to the park model Mrs. had just purchased days before. The contract we both signed stated that the ($1,300.00) down payment would be used to get the plans drawn up by an Architect, and permits to build the new addition.

Mr. and Mrs. decided that they had already stayed to long in Arizona because of the purchase of the new home and didn’t want to wait the required 2 weeks for plans and the 21 to 30 days required by the county to review the new plans and receive the permit. The ***’s told me they were going back home out of state and would return in November to resume the work. I mentioned that material prices could change or go up, if several months had passed and we resumed in the winter time. I submitted for the permit in October, we had the 1-month time frame to submit for the permit as I had already paid for and completed the building plan’s. I didn’t want the 6-month time to expire by submitting to early, so I waited to submit, so the county permit would not expire while the ***s were back east.

I first submitted beginning of October with a normal time of 21 days to receive permits, After submitting the plan’s, and when I went to the county I to submit the plans examiner pulled up Mrs.s new property and there was an addition that was build on her park model without any permits, or plans It was built without the knowledge of the Pinal County, This caused unforeseen problems ,and I was sent away with new direction to draw up another set of drawings to depict how and with what the existing addition was built with? I called Mrs. immediately to explain the new problem. I also told her this caused additional work and time. The charge was ($425.00) and Mrs. agreed to this verbally as well as in a text message.

I submitted the second time including the new plans for the unpermitted addition that was unforeseen for everyone, I was waiting for the answer on the permit and received a very disturbing phone call from Mrs. My 12-year-old daughter was in the same room with me and could hear her screaming at me, accusing me of not submitting the plans for permit until 2 weeks prior? She had talked to the county a different person than I dealt with the first time when we discovered the unpermitted addition, they had given her the wrong information about the first time I was there because the permit wasn’t submitted into the computer at the first meeting because I needed more information about this illegal addition to get a new permit number and so she call me a liar, Threatened to call the Revdex.com and The chamber of commerce both, said I took her ($1300.00) , I didn’t submit her plans to county when I said I did and it was very stressful. I explained that I had submitted the plans as well as the new plans with a Mr. and it was in the counties hands, that we should have it any day. Permit was approved on November 16th by Dale *** of Pinal county planning department, (PER 17-04746 PERMIT NUMBER).

I had called Mrs. and informed her of the permit had been approved 2 days after her phone call to me, I told Mrs. I could come bring the permit to her house and revisit the cost change and the new contract on the project. She agreed to the Monday after Thanksgiving, and I can start the project the day after our meeting on November 28th. I wanted to talk to her about the ($425.00) for the plans and make sure I got a signature on our new agreement, Mrs., *** kept asking me if I was bringing materials on our Monday meeting to start, I said No I would start the day after, I did not feel comfortable about starting until we agreed on the new terms.

I am not the reason the price increased however, in good faith I paid for the engineering, the extra plans, and the several trips to the county. I completed our written agreement on our contract agreement as well as the verbal agreement, to produce the additional plans to get the permit approved. I just wanted to talk to Mrs. in person and receive confirmation on her part before we started work, especially after the recent phone call I received, as well as several different aggressive encounters with Mrs..

I am willing to bring the new permit to Mrs.’s house, I have fulfilled my agreement to get plans and a permit for their project, it’s unfortunate, I am not building the project however, I did cover my end and have incurred cost for the plans, engineering, permit fees, and additional cost I covered out of pocket to get the plans for Mrs.s existing addition (non-permitted) addition.

I have Mrs.s permit, it is a valid and usable permit and it can be used to start her project with another contractor if she desires to complete her job. I received a call stating that because I would not start on the Monday the 28th however I would meet and start the following day. I was not going do the job? I did see a side of Mrs. that I felt very uncomfortable with, and didn’t want to go any farther until, at least had a new revised contract and money down to start. This was unacceptable to Mrs..

I cannot give Mrs. any money back for the down payment made, I have used the funds to produce a set of drawing’s and a building permit. I am still owed ($425.00) to pay me in full for the plans and permits. I thank you for the opportunity to explain the outstanding invoice.

Sincerely, ***

Customer Response

On the 10th of April, he said he would have his architect draw up plans and that the plans would be done the next Friday. So we paid him $1300, signed the contract, and told him to get the permit over the summer and start work on November 6th which he agreed to. At first he said he would take $425 from the $1300 we had given him, but later said we would have to pay the $425 separately which we agreed to. Later in the summer he called us to inform us that prices had gone up on materials and labor, so there would be an increase in the total which we agreed to. I called him twice before we left Iowa to ensure he could start on the 6th of November, and he said he could. We would never had come to Arizona 2 months early except for him to get the room done by Christmas. I don't think it is right for a responsible agency like the Chamber of Commerce to advertise for a builder that is as irresponsible as he is, especially in an area of older residents such as ourselves for him to take advantage of. Bottom line is he admitted he was wrong by not getting the permit on time. He should have informed us before we left Iowa as we had called him twice to verify. When we arrived in Arizona, he still did not have the permit. Nearly a month later, and a week after he had finally gotten the permit, we agreed to pay the $425 on the permit and the increases in prices and he still wanted us to take pictures of the contract and start over again. Also he said I agree to meet the Monday after Thanksgiving when in fact I agreed to meet the Monday before Thanksgiving so he could start building the Monday after Thanksgiving. Management in the park can also confirm our dealings with *** because we had to keep them informed as we also had to get a permit from them. The inconvenience along with the stress and the countless sleepless nights I've spent is very inconsiderate for him to put me through at my age.

Thank you for the reminder, If Mrs. is willing to pay the additional 425.00 for the plans and permits, I would be happy to release the documents. Mrs. has never offered the additional money for the unforeseen issues?, she told me I wasn’t getting any more money, after she agreed to pay for it, This is one of the reason’s I wanted to redo the contract, she reneged on our verbal agreement. The county found that the ***s had purchased the property with an existing addition that was never permitted. I explained this to Mrs. up front the day I found out, and told her the cost to do a new plan. They decided to come out to Arizona and it was clear that I had not received the permit yet, It normally takes 21 days, however after 3 weeks I received the call from Pinal county that the existing home had an unpermitted addition. I never told the ***’s I had the permit yet? The permit process was delayed because of the existing property had no proof of a permit for past construction. I had explained all of this to the ***’s. I had a very difficult time dealing with Wanda ,I never told her to come out 2 months early and I had told her the actual work would take less than 30 days. I was still ready to build this addition after going through all the hassle of correcting the previous fiasco with her property that had non-permitted work done.(Unforeseen issue this took more time) I volunteered to fix this part of the permit to help the ***s clear things up and help me get the permit. I wasn’t responsible for any delay with the permit, and when I had explained to them the extra work I had to complete to get this done ,and the additional cost to do it. They agreed.
I only told them that the actual job cost had slightly increased because the work had been postponed by the ***s for 4 months while they went back east to Iowa, the proposal and prices on materials on proposal are only good for 30 days, so it may be like $200.00 more to cover drywall and lumber increases. They agreed.
The bottom line is this, I had the permit in my hand and I was ready to start building the project , but because of how volatile Mrs. was, I wanted to revise the contract so we were both covered. She was very threatening over the phone several times, and tried to bully me on several occasions, so I didn’t trust our working relationship after she had threatened me. Mrs. is the one who canceled this project? I was ready to start construction and would have been done in plenty of time for Christmas, she didn’t want to pay the additional $425.00 for the extra work I had done ,and didn’t want to redo the contract to reflect the extra work and material increase, so she cancelled the project. I still have a permit and plans to do her project if she wants to be reasonable and pay me, I am willing to give her the plans, and permits so she can go to another contractor. This was never a situation of me taking advantage of anyone. I have been in business for 18 years ,and never had a complaint, I didn’t get here by taking advantage of good people. I have completed the work I was paid for, and I am still owed an additional $425.00. I don’t understand why the ***’s feel I should give them money back for work I have completed, they cancelled? I have all sent in the documents to prove this work is completed. Thank you,
Sincerely, ***
