Revdex.com:
I have reviewed the response made by the business in reference to my concern, and find that this resolution is satisfactory to me, although it is absolutely that I ever requested a month lease instead of a month lease, and when I reviewed the lease (a very lengthy document) on 7/29/I was referring to the section on condition of the apartment and alas did not note the incorrect lease time terms - thus I was unaware of the incorrect lease time frame until very recentlyI already emailed a day notice to *** on 1/10/18. Thank you

Response to problem: [redacted] and [redacted] applied for an apartment with Windmere Apartments on 6/22/17 online. They did express they wanted a 6 month lease term at that time. They were moving from out of state and mailed in their holding deposit of $100.00.  The holding deposit receipt was...

emailed to them on 6/22/17 so they were aware of the total due for move-in. As of 6/22/17 the move in date was 8/1/17. On 7/11/17 [redacted] reached out to Windmere Apartments asking to move-in sooner. Windmere Apartments made accommodations to allow them to move-in on 7/26/17 an on 7/11/17 a updated holding deposit receipt was emailed. The holding deposit receipt is not a legal contract but a receipt of money paid. [redacted] and [redacted] arrived for move-in on 7/26/17, they signed the holding deposit receipt that was emailed to them. They told the assistant manager they wanted to change their lease term from a 6 month lease term to a 12 month lease term at this time and she typed a new lease for the 12 month term. They signed the lease, paid the move-in costs, did the walk through and received keys to their apartment.  On 7/29/17 three days after move-in Kimberly emailed the assistant manager about the walk through and adding additional items. In the email Kimberly states: “We've reviewed the lease and just wanted to let you know within the three days after move in period that we've discovered a few other problems with the apartment that may not have been on the walk through sheet.“ She references reviewing the lease but did not mention any issue with the lease term dates that are clearly listed on the front page in bold and underlined. Neither of the two residents contacted the office regarding any lease date issues until 1/9/18. On 1/9/18 when [redacted] called the leasing office he spoke with the community manager and informed her they had moved out of the unit however they had not reached out to give a 30 day notice to vacant the apartment. The manager explained a 30 day notice to vacate is required per the lease agreement. The manager told [redacted] there were option available and he hung up the phone.   Settlement offer: We are willing to release liability for the 12 month lease term, however per the lease agreement we are still requiring [redacted] and [redacted] to give a 30 day written notice to vacate. We are also willing to back date the 30 day notice to the first date they contacted the leasing office which was on 1/9/18 and expires 30 days after.

We apologize for any inconvenience this may have caused you. However, as a property management...

company in a current competitive market our rents fluctuate daily.  Rent fluctuation is very common for apartment rentals and online marketing isn't necessarily at "real time."  When the client called to inquire about a rental, we explained the current rental rate and informed the client that rents change regularly.   When speaking to a representative the client was never quoted the $925 rate.
Again, we apologize for any confusion or frustration.
