Complaint: ***
I am rejecting this response because: MrCuriazza's response is totally inaccurate. On March 6, I received an email bill from *** Property Management for drywall repairs to the ceiling below our unit due to a leaking toiletSince *** *** had installed the new toilet only months previously, I attempted to call them and did not hear anything back for almost two weeks. I then forward to *** *** the *** *** Bill on March in the amount of $(Attached)
On March *** *** asked if any other work had been done on the unit, as maybe that was the cause for the leakOn March 25, I emailed Don Wagner of *** to ask that question who s*d as follows: "Emergency Response just shut off the water. Unless you had a plumber to work on it nothing else was done" In summary, *** *** installed a new toilet during late 2013, it subsequently leaked, causing $to the unit below, no other entity worked on the lead other than *** Property Management, *** *** had a copy of the bill for the damage along with over $of our money from the original repairs and wants to blame someone else for the damage
I think we all can see where this is going--no where!!
Thanks to the Revdex.com for trying to resolve this but we are going to proceed to small claims court
Regards,
*** ***

I am Joe Curiazza, the owner of *** *** Plumbing in Breckenridge,COI am contacting you about the claim against me from Mr***, regarding his property at *** *** *** in Silverthorne, CO
Mr.*** is stating that my company replaced a toilet for him in the late summer of
which subsequently failed causing damages to the unit below his
The fact of the matter is that we were contacted by his property management company on October 2nd of to determine the origin of a water leak below the *** unitAt that time the ceiling was water damaged and needed repairThe technician I assigned to the job found that the toilet was loose on the floor flangeAs he removed the original toilet, he discovered that there was a crack on the back of the toilet tank which was also leakingHe also found that the shower adjacent to the toilet was in disrepair and that the shower diverter cartridge was leaking and needed replacementAt that time, my technician had the property management company contact Mr*** to explain to him the situation and give him estimated pricing for repairsApproval for the work was granted and the work was completed( Unrelated to the toilet and shower work, there were leaks from beneath the kitchen sink which were also completed within the same "Ballpark Pricing".)
The invoiced amount was $802.50, which was sent out on Jan12th of There was no mention of our participation in the lower unit's ceiling repair in my invoice. The ***s paid the invoice promptly and I assumed that the property management company would bill the ***s for their time in repairing the ceiling from the original leaking toilet and shower
In February of 2014, *** *** called me stating that there was an invoice from the property management company for the ceiling repair, due to water damage, claiming it was from the work performed by my companyI asked if he was certain that this wasn't the invoice for the original ceiling repair which was completed after we completed our workHe could not give me a definitive answer and asked if I would investigate the situation for himAfter contacting all of the property managers who might have been involved, all of whom had no recollection of further damages after the original project, I asked Mr*** to provide me with copies of invoices of further work performed by either the property management company or by another plumbing company after our replacements(There are several plumbing companies that do emergency service work for this property management company, so it was quite possible that perhaps there was a fault with the material installed or there may have been another issue either with the shower or the drainage or water supply system which may have been repaired by someone else.)
At no time did I tell Mr*** that I would not warranty my work or take responsibility for the subsequent damages( I have saved the e-mail conversations between us, the original field generated work order and the actual invoice in case this goes any further.) I asked him for some kind of proof that I was at fault and that he didn't receive the same ceiling repair invoice twice
I discontinued communications with Mr*** when he told me that my relationship with the property management company was "Bizarre", that he could not get information from anybody and he was going to contact the Revdex.comI haven't received communication from anybody involved in this matter until I received your letter stating there was a claim against meI assumed that *** *** realized that he had only received the one invoice from his property management company and all was settledApparently not
My family and I have owned a successful plumbing business since We have never had a claim of incompetence in our workmanship, a complaint against our work and business ethics, a material flaw nor financial matter that wasn't resolved amicablyI do not want to blemish our record over bookkeeping errors or miscommunications
Please contact me at ###-###-#### to discuss this matter, as it has my family and co- workers upset to think that this issue has escalated to this complaint
Sincerely,
Joe Curiazza

Complaint: [redacted]
I am rejecting this response because:
As he did in our phone conversations and emails, Mr. Curiazza is simple muddying the water as a way to avoid the real issue in this matter:  his employee installed a new toilet to correct a leak for which we paid for damages to the unit below and within only months of this installation another leak occurred, resulting in damages for which we are again being billed. There was no work performed by some other contractor. The only thing that the [redacted] Property Management company did was to turn off the water to halt the leaking to the unit below when it was reported by out tenants. I did refer to his correspondence as "bizarre" and knew it was pointless to continue arguing with him when he hypothesized that the property management company might have done some repairs and then tried to cover it up--highly unlikely in that they were the ones who referred us to [redacted] in the first place! I have also alerted [redacted] to this dispute as well and cautioned them about using this firm in the future.
Regards,
[redacted]

As I have stated in my last correspondence to you, I have not seen any paperwork or invoices from either [redacted] Property Management or another plumbing company, regarding the unit at [redacted]. If the ceiling below the [redacted] unit was damaged again from inferior work or material on our part, I would assume that somebody corrected the problem, unless it is still leaking. If somebody corrected the problem, I would assume there was an invoice for the work. As I do have a good working relationship with [redacted] Property Management, they would have contacted me directly to make repairs on a project that I was involved with had there been any leaks.
As I s[redacted]d previously, if my company was at fault, I would take responsibility for the ceiling repairs. If the ceiling repairs stem from the original leak, the owner is responsible. If the damage is from an issue unrelated to the work we did, the owner is responsible. If there is no proof of wrongdoing on our part, the owner is responsible. I will not pay the ceiling repair bills without proper documentation from the management company and the company or individual who repaired the alleged leak, stating that we were negligent in our endeavors.
As for Mr. [redacted] alerting [redacted] and cautioning them against using my company in the future, without having the proof I have asked for time and again, he is opening himself up for legal action for slander and possibly loss of revenue.
I hope this matter can be resolved without going any further or by simply getting me the documentation I have been requesting.
