Initial Business Response /* (1000, 6, 2015/10/20) */
As with any situation, there's always two sides to every story. We'll try to provide a little history, and what we feel is the truth regarding this situation.
This landscape was originally installed in the spring/summer of 2012. It was...

installed in two phases, phase 1 being installed as contracted by the builder of this home (front and side yard) and phase 2 (back yard) being installed as contracted with the owner of the property.
Our warranty is for one year. As such our warranty expired June of 2013.
As most now know, there were a couple of extreme weather events in Denver over the last twelve months that may have lead to the death of many urban plantings. These events included the extreme temperature drop in November of 2014 and the Mothers Day snow/freeze of 2015.
The owner reached out to us for replacement of 'one' front yard tree (installed as part of the original installation in June of 2012). Due to the extreme weather events as described, we agreed to 'participate in good faith' with the replacement of this tree. We provided a proposal via email for the replacement of this 'one' tree, splitting the material cost of the tree and charging a reasonable labor rate for removal and replacement of the tree. This proposal amounted to $380.00 (materials and labor) plus the prevailing tax on materials. The owner then responded with a counter proposal. We then responded with a final counter of $325.00 (including all materials, tax and labor) of which the owner was not satisfied. It became obvious we were not going to be able to reach an agreeable price.
The owner states that our price was inflated 300%. Our normal installation rate for this variety and size of tree is $567.54 (materials, labor and tax). Adding the removal and disposal of the existing tree ($140.00) brings the total to $717.54. Whether the original price of $380 was used or the final counter of $325 was used, we were not 'inflating' 300%.
Yes, we discontinued communication regarding this tree, but only after our good faith negotiations came to a stand still.
Initial Consumer Rebuttal /* (3000, 8, 2015/10/23) */
(The consumer indicated he/she DID NOT accept the response from the business.)
It's simply not true. [redacted] expressed in email that we would split the cost. If in fact he would have proposed splitting $325, I would have accepted that. However, that is not what was offered.
He was asking me to pay the full cost. Effectively give him more margin to reward a terrible product and customer service. That was unacceptable.
I've moved on, but I do want my valid complaint to be public record to hopefully discourage other citizens from engaging in business with All Seasons and hopefully encourage All Seasons to provide a better product & service to the public.
Final Business Response /* (4000, 10, 2015/11/05) */
Our proposal never indicated we were willing to split the final proposed amount of $325.00, that was our final proposal.
Respectfully Submitted - All Seasons Landscaping, inc.
Final Consumer Response /* (4200, 12, 2015/11/09) */
(The consumer indicated he/she DID NOT accept the response from the business.)
To be clear, All Season is lying. His email is below. Along with saying he'd split the cost, he also writes that his cost was $360, which I know is false. In talking with his competitor who also owns a tree farm, I know the cost to be approximately $150 for that size/quality of tree. So he tried to more than double the cost and split the cost of the materials and not split the rest. Below is his email.
The resolution I'm seeking is for [redacted] and All Seasons to choose honesty & integrity and not be a decietful business with poor customer service. I'm moving on.
[redacted],

The size will be a 2.25" caliper. We will split the material cost of the tree at $360 ($180 each), we will tax you at the prevailing rate on the $180 (material), and charge $200 for removal and installation.

As far as any advice, winter watering will be the key. The sprinkler system will water during the period of the year that the irrigation is on.

We will warranty a total value of $340 should another replacement be needed.

Let me know if that works for you.

Respectfully - [redacted]

Consistency - from 1989 to 2015
