San Diego Ca Subject:Revdex.com complaint [redacted] In reference to the complaint filed on 11/1/I have enclosed a signed completion certificate from Dr [redacted] dated 11/14/confirming that the job was completed to her satisfaction, The current problem of water leaking in to the second floor of her home is not a window installation of product quality issueThe windows are a high quality product and were installed by a qualified installer with many years of experienceWe have returned several times to try and help Dr [redacted] with the leaking 2" floor of her houseWe ensured that the caulking that runs along the windows is unbroken, preventing a leak from the top of the windowWhat we have learned is Dr [redacted] had the roof replaced around the same time that the windows were replacedUnfortunately, as you can see from the enclosed photos, the Drip Flashing has been installed incorrectly allowing water to pool under the composite shingles and drip down into the wallWe have brought this to their attention and offered to tarp over their roof to help stop the water from entering but they did not want us to do thisOn Monday the 11" of January we are sending outa installer to recheck the caulking one more time and water check the windows with a hoseI do not think Dr ***'s leak can be resolved until her newly and incorrectly installed roof is repaired.Thank you, [redacted] ***

There were some unusual events that happened in the purchases and insulation of the windows at MR *** *** and DR*** ***'S homeFirst the factory data entry person missed entered "1" window 9"bigger then it should have beenWe had to re order the enlarged window of courseTwo other
windows were accidently broken during installationThis set us back scheduling wise a couple weeks, while the factory was remaking those windowsNormally we are able to complete most jobs regardless of number of windows, in one or two daysWe completed the entire job recently to there satisfactionWe apologized for the delay of the jobI personally met with MR *** *** and DR*** ***, they ensured me that they were now completely satisfied,Thank you,*** ***

Once again, with the rains, there is water leakage and streams of water running into our property upstairs due to the company's failure to effectively install our new windows and due to their failure to effective repair the leakage when initially notified.  This is unacceptable.  It is anticipated to continue to rain throughout the week and this needs to be remedied immediately.  It was our expectation when we paid nearly $7500 for window installation that the work would be performed properly.  As you may recall the initial contract was closer to $7800 and the company offered us a minimal (less than three percent) discount for the installation delays.  We've already had [redacted] come to our home to allegedly repair these exact same leak issues the last time it rained (November); however, the water leakage continues.  We are extremely frustrated and disappointed with this company.  We contacted the company again today to express our dissatisfaction and inform them of the continued leakage.  Further, it is noteworthy to state that the signature on the bottom of the page is "cutoff" so it is difficult to discern if it is, in fact, my husband's signature and the line above the company technician's signature where it appears that a customer would sign remains blank. Finally, it would be difficult for any homeowner to assert that he/she is satisfied with the repair when it has not been tested to determine if leakage continues.

I have asked them for a refund the last 6 or 7 times I have spoken to them and again today when I emailed them through their automated system online. They said they, "have already lost money" on my purchase because they have had to return to my house so many times for repairs. (as if that is my...

fault)  I don't have all the dates I spoke to them but I am sure they will acknowledge I have asked multiple times for a refund.

The manufacturer for [redacted]'s patio cover was [redacted] ( [redacted].) The [redacted] wananty is three years labor, ten years materials. No customer should ever want a product to be warranted or guaranteed by a salesman or a store. Their purpose is to distribute the product with the warranty being provided by the manufacturer. [redacted] is frustrated that his patio cover, provided by Metals and installed by their factorytrained contractor, [redacted]n, is leaking. We have been there several times to service the product. ( For example: a customer buys a television, manufactured by **, from a salesman that works for [redacted] and needs service from an authorized factory warranty center. The product is repaired at no cost to the consumer if it is warranted and the bill is sent to the manufacturer. Assuming that the television was not dropped, installed or hooked up electronically incorrect, this would be a normal process for manufactured products including **'s aluminum patio cover.) Wood patios are normally built from scratch with wood, nails, and etcetera. In this case, the builder would certainly be responsible for the warranty. [redacted]'s patio cover was a premanufactured aluminum cover that, at the time of sale, was recommended to him be mounted under the eve as opposed to on the eve. Most pre-manufactured covers should always be mounted under the eve. ** had a new roof on his house and made it quite clear that he did not want his new roof disturbed. We would gladly return to his house, disassemble his cover and reinstall it under the eve if he would grant us permission. This has been offered to him as a solution before, but he still didn't want his new roof disturbed. It probably will leak occasionally because of the way [redacted]'s house is built. His main roof dumps their water onto the patio when it is mounted to the eve. Where as if it was under the eve and had a gutter on the eve, then the roof would be dumping the water into the eve gutter and there would be no leaks. The patio cover's gutter system is designed to handle only the water collected from the patio, not the water from the entire roof. [redacted] contacted [redacted] and received no response from them. We were going to continue to service and try to help ** receive some resolution from [redacted], but he chose to complain to [redacted] and the Revdex.com as opposed to complaining directly to [redacted] who would have been glad to help him as long as he understood that it was the manufacturer that was providing the warranty, not the salesman nor the store. If ** had simply confronted [redacted] rather than taking out his frustration through [redacted] and the Revdex.com, a solution may have been found working together to persuade [redacted] to provide some relief. ** has insulted and threatened lawsuits to several people at All Seasons Windows and Patios, and at this point, unless we receive an apology from him, we are no longer interested in helping him attain relief from [redacted], his warranty provider. If he wants to adopt a conciliatory attitude and apologize to the people trying to help him, then we may assist him in resolving these issues. After twenty years, I have never known [redacted] to grant any refunds. Their policy is to repair their covers and install them under eves as they recommend. So until that is done, I am afraid ** will remain frustrated and his cover will continue to leak and he will not receive refunds from [redacted] or anyone else. Thank you,[redacted]

The response from the business is a gross misrepresentation of the facts and a ridiculous exaggeration of their efforts thus far. The business has made it clear they are aware their product installation was not consistent with the best methods in the industry and they are well aware that the patio leaks as a result of their installation technique. They have verbally abused me on the phone and I cannot trust them to do any more modifications to this project after allowing them to try for over a year. They need to do the right thing and refund my money. That is what a legitimate business would do and they have made it clear they will not return the money even though the product I paid for is not functioning properly. Shameful.

As a business owner, it is very easy to answer this complaint. This customer offered the salesman a very low price for a patio Cover. All Salesmen are required to Submit all offers subject to management approval, as was handwritten on this contract and...

initialed by the customers. After review, the management declined to accept the Customer's low offer. Being a family-run Company, we want all of the business we can get at a fair price. After the customer found out we would not accept his low offer for the patio cover, he spoke with the office staff with less than courteous and polite remarks. He was mad that we were declining his offer, and tried to bully the female office staff into accepting his job. The ladies had no part or authority involved in the decision making. They only called him to inform him that we would be refunding his money due to not being able to build the patio project.No contract is legally binding if it is clearly handwritten above the signature that the price is subject to management approval. With the refund check, we also sent an additional copy of the original contract Stating "subject to management approval"records.so that the customer would have an extra copy for hisAfter his rude demeanor on the phone with [redacted] in the production department and [redacted] the office manager, this call was passed on to me, the business owner. I listened to him politely and told him that we were going to cancel because the offer was too low. He threatened me that he was going to go to his command and try to blackball our business. He threatened to have us labeled as "do not do business with" within the military community.I am a former military man myself and I do not respond well to threats from anyone, whether they're a fellow veteran or not. I always love to provide favors and discounts to veterans, and consider them brothers. However, just because you're a veteran, it doesn't give you the permission to threaten orattempt to bully another veteran.
