Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below >Please kindly provide proof documentation of each and every one of your allegations listed above as well as the basis of your Settlement Proposal for our review so we can expedite processing of this matter.Please refer to the Attorney Letter by [redacted] dated Nov 25th This was mailed to you at [redacted] on November 27th This letter contained the proof you are requesting along with a complete audit of our account statement we received from you July 6th Upon your complete failure to respond an additional copied was mailed to you by Certified Mail on Feb 3rd The USPS tracking number for this is: [redacted] - The record shows that this was delivered to you at 11:31am Feb 4th As such you are already in receipt of the necessary documentationNote in both cases you were provided with days to respondNo attempt to respond to the letter and the evidence included was made by All Smile Dental or anyone acting on your behalf.>Preliminary result of our audit of your family account records is as follow:There was no over-treatment of unnecessary dental procedure,This is simply incorrectYou upsold numerous procedures to both my wife and II was told by you that of my teeth needed fillingThat two had cavities and two that had existing amalgam fillings were cracked and required fillingI consented to getting the first three filled but then upon continued pressure for additional treatments and from overhearing your discussions with other patients where the statements to the same affect were made I became suspicious and decided to seek a second opinionI have now visited two independent dentists, one of which I now retain for all treatmentNeither of these dentists could find any evidence of a crack in the remaining filling that you wanted to replaceIndeed, over years later there are no problems with this fillingUpon receiving copies of the X-rays you took prior to the fillings neither of these dentists can find any evidence of decay in the two healthy teeth or evidence of any problems with the filling that you had me agree to have replacedThis is just one example, other examples include deep cleaning procedures that other dentists question that we needed and you misrepresented to us the nature of the cost and what the insurance company covered.In the deep cleaning example you insisted both my wife and I desperately needed this on January 27th and refused to offer further treatment or evaluation until we had itWhen you provided us with the contract for treatment you specifically told us that the insurance covered 80% of the treatment and that we were responsible for the remaining 20%You told us that the cost of this procedure that we were required to pay was $each which we promptly paid at the time of treatment - your paperwork and description led us to believe that we were receiving treatment that had a fair market value of $eachHowever it was not until you billed our insurance that we realized the scam you were operating hereThe fair market value [redacted] (and dentists I have consulted agree upon) for the deep cleaning you provided is in fact $What you did was you deliberately inflated the bill by $which you charged for rinsing of each quadrant ($per quadrant)The rinse provided was nothing more than common mouthwashAs you were fully aware at the time this was not an approved charge by the insurance company and as such you misrepresented to us the true value of the treatment you were providingThis was done deliberately and with intent to deceive and defraudThe mouthwash that you deceptively charged $has a fair market value of less than a dollarYour markup of over 10,000% represents price gauging and unfair practices and is most likely in breach of consumer protection lawsYour treatment practices are without doubt unethical and may quite possibly be in breach of state lawAs such I feel that our proposed settlement is certainly fair and would save us both substantial time and effort should this require further investigation as a criminal complaint against your practiceWe’d received insurance claim payments that met or exceeded our estimates on all claimsThere is no claim not paid or underpaid.Thank youBy your own admission here you are thus stating that since there is no claim not paid or underpaid (and that we always paid in full for our obligations at the time of treatment) our balance must therefore be zeroHow do you reconcile your statement in here with your continued assertion that we have an outstanding bill? The attached document is my settlement agreement with All Smile Dental for the charges at issueI entered into this settlement agreement with them because they were harassing me with additional finance charges on the disputed amountsI am also aware of All Smile Dental's pattern of harassing customers who raise issues with them *** *** *** ** *** *** ***) and did not want to fall victim to their pattern of abuse. It is unfortunate
that the Complainant had rejected and refused to honor the settlement agreement
executed on 3/27/and is attempting to collect money through the Revdex.com which is
not only a beach of her written agreement but clearly an illegal and fraudulent
act of distortion for financial gain
Prior to this
complaint, and after the 3/27/agreement, the Complainant had made similar attempts

California had ruled in our favor in each of her two attempts to distort money
from All Smile Dental

You have not made any payment nor have you provided any evidence to support your dispute." is not acceptable. I tried to pay it multiple times. But I wanted to know what was the charges for. It comes with financial charges in the beginning with and they already sent out few bills by mistake. I contacted them numerous times and went to the office to resolve it many times. Also, as I mentioned, last year, they told me that there was no charges left to pay anymore! What I have learned from my insurance company, I have only $31 charges left that was not covered by one company but never claimed to the other company. Therefore, the most of financial charges were on charges never existed. I am attaching the evidence documents here. 3. "We hereby offer a settlement proposal in the amount of $350 and we’ll write off the remaining balance." is not acceptable. They billed for non-existing charges and wasted my times.

However it was not until you billed our insurance that we realized the scam you were operating here. The fair market value [redacted] (and dentists I have consulted agree upon) for the deep cleaning you provided is in fact $615. What you did was you deliberately inflated the bill by $120 which you charged for rinsing of each quadrant ($30 per quadrant). The rinse provided was nothing more than common mouthwash. As you were fully aware at the time this was not an approved charge by the insurance company and as such you misrepresented to us the true value of the treatment you were providing. This was done deliberately and with intent to deceive and defraud. The mouthwash that you deceptively charged $120 has a fair market value of less than a dollar. However, here you state the balance due is at least $525. This clearly establishes that your accounting and billing practices are inadequate and likely not in conformance with the requirements of state law. By this statement you are here by admitting that your own billing department is in disagreement with the balance you believe is due. How can one possibly be expected to have good faith in your accounting procedures if you cannot even reconcile what you believe we owe with the bills you are sending? 8. There is no claim not paid or underpaid." you clearly and concisely state that all claims on our account have been paid and therefore any remaining charges you show are accounting errors on your part.To avoid the need for lengthy legal proceedings regarding your billing errors and considering the fact that the statute of limitations on the disputed amounts in this matter have expired I am willing to offer the following compromise which I believe all parties will consider to fair and amicable.1) In exchange for you providing a letter stating that our account has zero balance and has been closed and that as of Apr 6th 2015 we have no outstanding charges or finance or late fees and upon your written agreement to cease and desist all demands for payment and your written statement that any and all outstanding debt you believe we have with All Smile Dental is thus null and void and therefore ineligible for referral to a collection agency I will drop my claim of the excessive payments (and insurance credits) that I believe you owe. I will also agree not to pursue the matter of deceptive and unethical treatment and billing practices with relevant authorities.2) Both parties will consider this to be final settlement of any and all claims referenced in letters, emails, faxes and/or verbal communication regarding billing disputes between ourselves and All Smile Dental.Thank you for your consideration.
