Ms*** purchased the Chevrolet Malibu with VIN 1G11B5SA5DFon October 10, from CarplexShe paid two deferred
down payments of $each on October 16, and October 30, totaling $1,in down payment to CarplexThe language Ms*** referenced in the contract about a day grace period actually reads “Late Charge: If a payment is more than days late, you will be charged $17.00”, and can be found on page of the Contract in the “Truth in Lending Disclosures” boxContractual payments are expected to be made on or before the due date, and the reference for this expectation can be found on page of the contract under “Default”It reads, “You will be in default on this Contract if any one of the following occurs (except as prohibited by law): AYou fail to make any payment under this contract when due.” Ms*** became delinquent on her first contractual payment due to American International Finance, Inc(due November 13, 2015), and therefore breached the contractCarplex acquired the collateral, and subsequently voided the contract on November 19, After restocking and repair fees were taken into consideration a refund check #of $was offered to and accepted by Ms***See attached supporting documents Ms*** signed when accepting said refund check
While American International Finance, Incis disappointed we couldn’t service Ms*** contract, we are glad Carplex was able to come to an agreement to make both parties whole

Carplex at Pendleton Pike, Indianapolis, IN She lived in the state of Indiana at that timeAt closing Ms*** was directed by the Store Manager selling the vehicle to obtain an Indiana Identification card so Carplex could complete the title work, and in turn allow Ms*** to plate the vehicleMs*** did not obtain an Indiana ID, and subsequently moved to New JerseyA representative from Carplex then spoke with Ms*** and decided to make an exception due to the fact that she moved to New Jersey unexpectedlyThe Carplex representative advised that they would need to acquire an Indiana title in Carplex’ name, and then send it to her in New Jersey for her to process and add the AIFinance lienA new document was required of Carplex to acquire the Indiana title, and the representative was initially unaware it was requiredThe title has since been received at Carplex, and sent via FedEx Overnight to Ms*** on 9/28/16.While we’re disappointed we couldn’t accommodate Ms*** sooner we are certainly pleased the title has been received at Carplex and sent via FedEx Overnight servicePlease contact me directly with any questions at 317-549-Ext14, or via email at tyler.w***@aifinance.com.Sincerely,Tyler W***
