The facts are as follows:
ASAC had a contract with *** *** to build a floating cabin (see previously submitted contract)
ASAC built said cabin to owner specifications (secured decks/docks with customer supplied wire) see attached photo
ASAC delivered cabin to Baffin Bay as per contract
ASAC was unable to demo previous structure upon delivery due to owner’s failure to remove personal belongings (see attached photo)
ASAC was forced to remobilize
ASAC completed demo of previous structure

first to clarify a few things,** *** stated that I am sole owner of the cabin,I am not.** *** was made aware of this before any work or contract was signed,there are in fact owners, myself,*** *** *** *** *** *** *** who filed complaint # ID ***.(see Texas parks and wildlife permit #HC for listed owners)This complaint was filed with my knowledge as well as the rest of the co owners.*** *** was in fact originally contacted by ** *** on behalf of the rest of the owners, as ** *** was tasked with finding the group a contractor to tear down our existing cabin and building a new one.** *** set up a meeting between ** ***, myself, ** *** and ** *** around 07/15/at which time he was told there were owner and we want him to do this work.*** *** then drew up an estimate for the work and emailed myself and *** a copy.(estimate #072615) for the sum of 31,dollars, *** and myself reviewed the contract and declined to pay this amount.** *** then contacted *** *** and asked him to get the price down to no more than 30,dollars which is what was agreed to.(see contract # 072715) This contract was signed by me on behalf of all owners only because *** was out of town*** *** contacted me on 09/3/2015, a Thursday and said he would be ready to move the cabin from the marina were it was built to Baffin bay and asked if I was coming down.I said yes at which time *** *** asked if we could pay him the remaining balance of the contract.on 09/04/myself,*** *** *** *** *** *** *** all went to the coast to watch ** *** deliver the cabin to Baffin Bay.upon arrival to the marina it was in fact *** *** that payed *** *** in full the remaining amount of dollars at the marina before cabin had even been moved.At the marina front deck was already installed but side could not be installed until cabin was moved from the marina to Baffin Bay.We,(all owners had to help *** *** via our boats,pull the cabin out of the marina and into open water to move it to Baffin Bay).*** *** pulled the cabin and *** *** pulled deck sections.upon arrival at Baffin Bay *** *** tied the cabin down (it was dark) he and his helper and *** ***, a co owner returned to the marina via *** ***s boat.Now keep in mind all sides still need to be installed and old cabin still needs to be torn down.cabin at this point is not ready for an inspection because side decks have not been installed at this point.the next day,09/05/*** *** and one helper returned to install the side decks.** *** did not have enough help to put together and install the side decks so I got in the water and helped him with one side.myself and *** *** then returned to shore to grab a bite to eat.upon returning ** *** and his helper had left,leaving the decks for the other side of the house sitting on top of the deck that I helped him install.The following day,09/06/2015,( as we spent the night in the old cabin)we waited for ** *** to return and finish the job*** never returned on this day and was not heard from.myself and *** *** then made a list of things that still needed to be done and returned to San Antonio.all owners had a meeting and discussed remaining work *** *** needed to do to complete and fulfill the contract.*** *** was then contacted by *** *** and given a list of things that needed to be done.*** *** informed us he would not be returning to Baffin Bay for approximately one week to finish the job.during this time ** *** was contacted by ** *** and asked when he would be tearing down the old cabin because our permit only allowed for one cabin.** *** told *** that the tear down was not part of the contract and we would have to pay an additional dollars for haul in and tear down.** *** then contacted myself and told me this.I contacted ** *** and inquired about this at which time he said he told me it was not part of the contract.I then called *** *** and explained the conversation between *** ***,*** and myself.*** *** then contacted ** *** and informed him tear down was in fact part of the contract.*** *** did meet myself and *** *** at my house on 09/14/to pick up a key to finish his work on the house.*** *** followed ** *** to *** *** house,a co owner* *** *** also voice to *** *** concerns about the way the deck was secured to the house and told him he needed to better secure the decks.*** *** even gave *** *** the cable to properly secure them.at some point ** ***, (about a week later)returned to Baffin Bay to secure the deck he had installed (with string),finish installing remaining decks and other work voiced to him.toilet install,screen door,boat cleats.window screens,and backwards fan blades.Some of this work is still not complete.*** *** contacted me upon his return from Baffin Bay to complete this work and told me about the missing decks, and if we wanted them rebuilt he would do it but we would have to pay for them again.I then contacted *** *** and told him what *** *** said** *** tried for days to contact ** *** with no answer and no return call.** *** then came to my house and called ** *** from my phone, at which time *** *** did answer.** *** then began telling *** *** he didnt have a contract with him and hung up.it was then with my,and the rest of the owners permission,*** *** filed complaint# *** against *** *** and his company.after *** *** received the complaint he contacted me and stated he felt he went above and beyond on the cabin but wanted to know what he could do to make it right.I then told him I would get back with him.I then contacted the rest of the owners and discussed it with them.all owners decided to ask him to give us a refund for material which we had already bought at a price of dollars to replace the one side that had been losthe said he would get back to me and I never heard from him again.further more, during the process of trying to resolve the issue with the side deck,all decks have now been lost due to poor installationie secured with string.we are now asking for all monies, I am rejecting this response because:[redacted] and all squared away construction simply did not meet its end of this contract.[redacted] states his business is veteran owned.well I would like to take this time to thank him for serving as myself and [redacted] are also veterans.we are also on fixed incomes and as a veteran he should me ashamed of trying to defraud us out of our money.[redacted] states he was unaware of this dispute before he was contacted by the Revdex.com.( you find in a phone call recorded and attached below) [redacted] was aware I was unhappy well before any claim was filed with the Revdex.com, in fact it was only after two complaints that he contacted me.[redacted] continues to reply he only had a contract with me so I will also include evidence this is not true.(see permit from Texas parks and wildlife listing all equal owners) [redacted] took on this project with that knowledge and readily contacted other partners with questions on this project.you will also find checks payed to [redacted] partly by me and partly by [redacted] on all owners behalf.[redacted] stated his company strives for excellence, well he missed it on this one as after paying him 30,000 dollars we ended up with missing parts due to [redacted] neglecting the project and leaving it unsecured for nearly two weeks,parts also floating off in less than two months on account of poor installation.[redacted]s excellent work lasted about two months.he also stated he returned to finish the job because we didn't have old building ready for demo which is simply not true.he returned to because he simply had not finish the job. he was instructed to destroy old building and all of its contents with the understanding that if there was anything in the building he or is helper wanted  during this process they where welcome to keep it.and far as myself contacting [redacted] to solicit money as he stated.I spoke with [redacted] after he called me with concerns to the Revdex.com complaint and wanted to know how to resolve it.after speaking with all owners we decided to ask for only the cost of material.see receipts below.note: this offer was made before we had knowledge of ALL decks being missing.we were not asking for labor,delivery or installation already payed to [redacted],a more than fair solution.I would like to settle this here, but want [redacted] to know if no solution is found.we well take further legal action

Excellent construction company; owner is former U. S. Marine (thus the name of the company) and he does good work at a fair price. Left the property clean and neat; started on time, ended on time.
