at the damage CBD and MrD [redacted] may argue against the damage costs as much as they like, but the invoices clearly indicate what the damage was caused by and what the costs wereMrD [redacted] blatantly lied about conversations with the business’ managers, and has claimed they have contradicted their own invoices/estimates, without providing any proof of the sameThe invoice for the concrete dust was not for a continuous cleaning fee – it was obtained for concrete dust and a construction clean-upThe fact that the homeowner chose to continue using the company after the initial construction clehas nothing to do with what was paid to fix MrD [redacted] ’s negligence with regards to the concrete dustThe invoice from the hallway drain clearly states that construction debris caused the blockage, further evidenced by pictures showing CBD’s work product clearly flowing into the drainThe bathroom drain is 100% blocked with a metallic silver epoxy, and so it is unlikely that MrD [redacted] will be able to convince a jury that he did not cause this blockage as well or that the costs of repairing it should be disregardedAt a certain point, a contractor is expected to stand behind his work and his mistakes, and it is ludicrous that MrD [redacted] , with no evidence, continues to argue well-documented facts simply because he doesn’t want to be responsible MrD [redacted] insists that “90% of the work was done” before the stain was sealed and uses this as justification to claim the initial project’s full priceHowever, let’s look at the facts: MrD [redacted] stained the floor such that there were many obvious disparities in the coloring, spread throughout the entirety of the basement floor, so extreme that the floor’s appearance was ruinedAt that point, he had a few options:a He could have spent some extra time evening out the stain in order to fix the disparities (an option verified by the manufacturer) – he chose not to.b He could have NOT sealed the floor and instead informed us of the stain discrepancies and allowed us the option of hiring a third party company to fix the stain, before he sealed the floorHad we simply subtracted that amount from what was owed CBD, CBD would have likely still made money on this project – he chose not to.Instead, he ignored the shoddy stain and moved forward without our authorization and without letting us see the stain before he applied the sealerHis act of sealing the floor immediately made any fix to the stain all but impossible without removing ALL of the work he did on the floors, which he would have been well aware of as owner and operator of a concrete companyIt was solely his decision that led to the floor being sealed and to fix the issue we will have to have the floor completely re-done, which will easily cost us over $8,000+, which MrD [redacted] is well aware ofAs a result, our damages are approximately $1,in additional damage to the home + the cost to the floor ($8,000+), for an easy total of $9,No one is happy with the floor and no one is “enjoying it”The floor looks horrendous and is an embarrassment to look at and MrD [redacted] should be mortified that his company produced this work and beyond ecstatic that we have been willing to use informal ways to settle this issue instead of immediately taking him to court and presenting the world with the disastrous work he provided along with seeking extensive damages for what he’s put us throughI’ve included additional pictures so that MrD [redacted] can be reminded, yet again, of how horrible the floor looks due to his decisions regarding the stain and sealerFurthermore, MrD [redacted] seems to think he is only responsible for the additional damage he caused to our house as he, repeatedly, completely ignores the largest source of damage in this situation – the floor itselfFor us to fix the additional damage to our home and remove and replace the floor entirely to fix the damage to the floor itself, it will cost us over $9,in total, as described above, due to MrD [redacted] ’s knowingly, negligent actionsAs a result, MrD [redacted] ’s “offer” of paying $is in no way reasonable or offered in good faithRegards, In response to Ms [redacted] 's complaint, I will try to be to the point as follows: 1- On Behalf of Concrete By Design,I visited ***'s house at least four times prior to starting any work on her homeEvery time I visited prior to beginning work at the home, [redacted] and her housemate [redacted] changed the scope of work and demanded a change of quote and contractCBD was happy to do these quotesHowever, [redacted] and [redacted] drastically reduced the scope of work,undercutting the profitability of the overall job Even so,I still offered the 15% discount on special that month,even though the job was now considerably reduced in valueAfter the final quote was provided to [redacted] and [redacted] they showed me a magazine coupon where we were running a special discountCBD honored this discount as well,in essence giving them a double discount worth 30%, which is more than any project we have done in our entire working history2- Prior to beginning any work at the home,during the many meetings to discuss scope of work, everything was explained to Ms [redacted] and Mr [redacted] regarding the procedures of the work to be done, including the length of time of the work,the fact that there would be dust generated,and the reasonable expectations for the final result At that time I made it clear that this basement was in very poor conditionIt was not livable in its existing condition and had been used primarily for storage in years pastI mentioned many,many times that they needed to have a reasonable expectation for the final results since the original floor was drastically uneven and damagedAt that time I also advised them many times to choose a different flooring system which we offered and which might work more effectively on such a damaged floorHowever, they insisted on the "wood-look system" which CBD ultimately installed To provide you with a picture of the poor condition of the floor you should know that the basement floor had cracking,unleveled areas,and holes due to pieces of cement that had been removed There were so many holes in the floor that it was sometimes difficult to walk on Moreover,the floor was painted all over,which required CBD to use a diamond-blade grinder to remove all the paintThis took full days just to do that and then more days to level the floor,all before we could do any design or colorSo we spent full days out of the days we were there to prep and level the floor prior to doing any design, texture or coloringDuring this preparation time Ms [redacted] consistently praised CBD's work both verbally and by textAlmost every day during this time [redacted] told us how wonderfully well we were doing and sent us this text which I quote: "Marcus,I know it's not done but I had to reach out tell you that it looks phenomenal!!! I can't believe what you've been able to do with that space"This glowing praise came from [redacted] after CBD having worked in her home for more than daysThis shows,If nothing else,that CBD had worked and accomplished a great deal during those days, And therefore CBD deserves payment for that work which it provided3- The dust issue happened on the first day CBD began work in the home Again, the clients had been warned about this prior to signing the agreement for work to beginThe fact that there was no door separating the basement from the rest of the house made it difficult to control dust from escaping to the st floorAlso the return air vent located in the basement may have taken some dust to the 1st floorCertainly, while working in the basement,CBD employees used the best equipment available to control the dustAlso CBD employees had to work in the basement and did not see that much dust, we certainly didn't see the dust in the 1st floor,as we were not thereHowever, Ms***'s housemate [redacted] called CBD the next morning before we could begin the 2nd day of workHe demanded that CBD hire a cleaning crew to clean the houseHowever, because the dust had been discussed and agreed to prior to the start of work, I felt it was both inappropriate and unfair for them to request this additional service at CBD'c expense4- One important point to mention is that CBD completed all contracts and initial negotiations with Ms***At that time Mr [redacted] was introduced to us but he was silent and not involved in any significant wayHowever,as soon as CBD started working, Mr [redacted] was the one giving directions to us each morningThis direction was always in complete opposition to the comments and direction of Ms***So it became a kind of routine of Mr [redacted] telling us something in the morning,almost insulting us every day,then Ms [redacted] telling us what a great job we were doing later that day or the nextAt the time this was a bit disconcerting,but looking back now Itend to view this as planned and contrived in order to take advantage of CBD on many levels5- Another issue making this job even more difficult was the severely restricted access to the work site Both Ms [redacted] and Mr [redacted] refused to give us free access to the basementThey required us to arrive at an earlier time so that they could open a garage door prior to their going to workThis was rather than give CBD access to the garage via an access codeThis meant that one of CBD's worker had to arrive an hour or more earlier than the start of the actual work time to let [redacted] and [redacted] to go their work which means we had to start work on their time, CBD has worked on dozens of homes, from modest bungalows to very expensive homes in the Geist areaWe've covered thousands of square feet of concrete In past jobs,every time we've begun work the customer has provided us with a key,or garage access code,or some way for us to enter the house and do our work on our schedule (which allows CBD to do a job efficiently)6- When Mr[redacted] called demanding that CBD pay for cleaning the house, I felt that after what CBD had endured so far- the demeaning comments from Mr[redacted] to my workers and me, The drastically reduced scope of work,the double discount of 30%, the difficulty gaining access to the work site- I told him that I would be happy to pay for the cleaning but then I would discontinue working on the job and that he should hire another companyI never threatened Mr [redacted] or Ms [redacted] in any way and, I certainly did not steal any money by retaining the deposit, (In fact, they are the ones stealing money from me as they si gned an agreement to pay us upon completing the work which was April 18th They have not paid this and they have been holding CBD's money for more than a month now I feel they have had no intention of paying CBD all along.) However,I was ready to settle the project and to pay them the differenceThen Mr [redacted] called CBD back apologizing for the demeaning comments and said,and I quote, "I will offer you an olive branch by waivi ng the cleaning cost and I would like you to stay and finish the job." At that time I specifically asked him to assure me that they would pay CBD when the job vvas completed,and he responded:"yes"Also he commented that he was a contractor too and he understood that many home owners don't pay him at the end of his work and he assured me that he and Ms [redacted] were not like thatThe very next day I saw [redacted] in the morning as she opening the door for us and said don't worry about yesterday" Its just spring cleaning,nothing major and don't worry about it"This happened only the 2nd day of work and the dust issue was never mentioned again through out the time we were there As a result,I was very surprised that this issue surfaced again exactly when we finished the project.7- Ms***,initially dealt with me as a private individualIt was only after she and Mr [redacted] began refusing to pay me what was owed for the completed work then demanding payments for other issues that were supposedly caused,that she began using her official title as a consular working with a company that specializes in residential warranties,and using her title with that company for her personal useI feel she is using her position to intimidate CBD into waiving our finalinvoiceShe has sent letters (attached) regarding the cost of cleaning and other issues, which surfaced Two (2) weeks after CBD,completed work on her propertyAt that later time she claimed that CBD caused the drain in the bathroom to become cloggedMr [redacted] was the one calling CBD about the blocked drainIn an attempt to resolve the issue,I asked him to hire a plumbing company,send me the bill and I would deduct the charge from our last invoiceUp until the date of this letter, although repeatedly requested by CBD, CBD has not received any written invoice for either the cleaning charge nor the plumbing/drain charge which tells us that these accusations are probably unfounded (similar to their attempt to blame CBD for a bare footprint that appeared on the floor that was from someone in their household -as my staff and I do not work in bare feet and none of my workers has a small foot size.) 8- Ms [redacted] has written various claims regarding using 3rd_party estimates for re-surfacing the floor and charges for damages we supposedly caused to her home, however those claims have varied with each letter she has writtenIn her first letter,the charges were $794.00,in her second letter this charge jumped to "approximately" $1,200,and in her letter to the Revdex.com,she wrote that this same figure was $1,Despite CBD's repeated requests for copies of these documents none have been provided to CBD9- Also,Ms***'s demands change from one letter to anotherPlease see the attached copies of her letters10- According to Ms***'s own statements to me,the floor was transformed tremendously from what it was originally into a livable area;so much so in fact that my workers and I were even surprised at how well it turned out Pictures of how it was transformed are also attachedShe also said that the floor turned out better than she had expected considering the floor's original conditionWe certainly improved the value of her home11- ln one of her later letters, Ms***s mentions "hundreds and hundreds" of dollars of damages but she has not provided any bills or invoices to prove thisCBD is willing to pay for damages,but only if the damages were,in fact,caused by CBD We have been in this business many years and we consider that we are one of the best at what we doAlso,CBD,is familiar with most of the competitors in the area and they know us tooI can challenge any competitor to do any better than what we did in that basementWe use the best products in the industry in every job we doThe staining color used in this job was from Perma-Cast ®Sierra Stain ™ which is the most prominent in the concrete staining industryThey have been in business for over years plusThe product has a manufacturer's label that reads: "Expect wide color variations,mottling and unevenness of colorEach application of Perma-Cast® Sierra Stain TM produces unique results." Each floor accepts colors in a different way depending on age,kind and depth of the concrete required repairing any cracks12- CBD offered many times- both verbally and in writing- to come back and work on the color to their satisfaction but they refused to bring us back,holding our money and accusing us of damaging their house when in actuality CBD added value to the house and improved their investmentAlso, keep in mind that three quarters of the work involved in the project was CBD's work to prepare and level that basement, making it livable prior to applying the design and color Attached,please find Ms***'s previous letters to us,our responses to her and our lawyer's letterAlso, we have included some pictures of the finished floor,which we are posting on our website as we are proud of the results

In response to Ms.Alix Vollmer's complaint,I will try to be to the point as follows: 1- Concrete by design has offered to go back and work on those small spots in concern multiple times both verbally and in writing, however, Ms. [redacted] keeps conveniently ignoring our offer with the intention of, we believe, using this as an excuse for not paying us the balance due.       2- Some of the so-called evidence Ms.Vollmer produced as proof of supposed "damages" that CBD caused to her house are inappropriate or patently untrue. When CBD discussed those         supposed "invoices" with the business managers, one of them was only an estimate- not an invoice at all -and the other was for on-going, monthly cleaning services- not a one-time service      required in this situation. 3- We are willing to pay for $143 for a one-time cleaning service and the $319 for Rota Rooter for a total of$ 462.00. This still leaves a balance of $2499.02 due for over 90 days. CBD will be happy to deduct the $462.00 from the balance due.                                4-  Ms. [redacted] -a lawyer- is trying to use these excuses for not paying us the 2nd %50 as contracted. Also, she will not let us go back and correct any spots of concern as offered by CBD. For                                     all we know at CBD,Ms. [redacted] is happy with the floor and enjoying it. CBD's work improved the value of Ms. [redacted]'s home by over $10,000. We've covered thousands of square feet of concrete.    In past jobs,every time we've begun work the customer has provided us with a key,or garage access code,or some way for us to enter the house and do our work on our schedule (which allows CBD to do a job efficiently). 6- When Mr.[redacted] called demanding that CBD pay for cleaning the house, I felt that after what CBD had endured so far- the demeaning comments from Mr.[redacted] to my workers and me, The drastically reduced scope of work,the double discount of 30%, the difficulty gaining access to the work site- I told him that I would be happy to pay for the cleaning but then I would discontinue working on the job and that he should hire another company. I never threatened Mr. [redacted] or Ms. [redacted] in any way and, I certainly did not steal any money by retaining the deposit, (In fact, they are the ones stealing money from me as they si gned an agreement to pay us upon completing the work which was April 18th.  They have not paid this and they have been holding CBD's money for more than a month now.  I feel they have had no intention of paying CBD all along.) However,I was ready to settle the project and to pay them the difference. Then Mr. [redacted] called CBD back apologizing for the demeaning comments and said,and I quote, "I will offer you an olive branch by waivi ng the cleaning cost and I would like you to stay and finish the job." At that time I specifically asked him to assure me that they would pay CBD when the job vvas completed,and he responded:"yes". Also he commented that he was a contractor too and he understood that many home owners don't pay him at the end of his work and he assured me that he and Ms. [redacted] were not like that. The very next day I saw [redacted] in the morning as she opening the door for us and said don't worry about yesterday" Its just spring cleaning,nothing major and don't worry about it". This happened only the 2nd day of work and the dust issue was never mentioned again through out the time we were there.  As a result,I was very surprised that this issue surfaced again exactly when we finished the project.7- Ms. [redacted],initially dealt with me as a private individual. It was only after she and Mr [redacted] began refusing to pay me what was owed for the completed work then demanding payments for other issues that were supposedly caused,that she began using her official title as a consular working with a company that specializes in residential warranties,and using her title with that company for her personal use. I feel she is using her position to intimidate CBD into waiving our finalinvoice. She has sent 2 letters (attached) regarding the cost of cleaning and other issues, which surfaced Two (2) weeks after CBD,completed work on her property. At that later time she claimed that CBD caused the drain in the bathroom to become clogged. Mr. [redacted] was the one calling CBD about the blocked drain. In an attempt to resolve the issue,I asked him to hire a plumbing company,send me the bill and I would deduct the charge from our last invoice. Up until the date of this letter, although repeatedly requested by CBD, CBD has not received any written invoice for either the cleaning charge nor the plumbing/drain charge which tells us that these accusations are probably unfounded (similar to their attempt to blame CBD for a bare footprint that appeared on the floor that was from someone in their household -as my staff and I do not work in bare feet and none of my workers  has a small foot size.) 8- Ms. [redacted] has written various claims regarding using 3rd_party estimates for re-surfacing the floor and charges for damages we supposedly caused to her home, however those claims have varied with each letter she has written. In her first letter,the charges were $794.00,in her second letter this charge jumped to "approximately" $1,200,and in her letter to the Revdex.com,she wrote that this same figure was $1,000.00. Despite CBD's repeated requests for copies of these documents none have been provided to CBD. 9- Also,Ms. [redacted]'s demands change from one letter to another. Please see the attached copies of her letters. 10- According to Ms. [redacted]'s own statements to me,the floor was transformed tremendously from what it was originally into a livable area;so much so in fact that my workers and I were even surprised at how well it turned out.  Pictures of how it was transformed are also attached. She also said that the floor turned out better than she had expected considering the floor's original condition. We certainly improved the value of her home. 11- ln one of her later letters, Ms. [redacted]s mentions "hundreds and hundreds" of dollars of damages but she has not provided any bills or invoices to prove this. CBD is willing to pay for damages,but only if the damages were,in fact,caused by CBD.                                      ... We have been in this business many years and we consider that we are one of the best at what we do. Also,CBD,is familiar with most of the competitors in the area and they know us too. I can challenge any competitor to do any better than what we did in that basement. We use the best products in the industry in every job we do. The staining color used in this job was from Perma-Cast ®Sierra Stain ™ which is the most prominent in the concrete staining industry. They have been in business for over 20 years plus. The product has a manufacturer's label that reads: "Expect wide color variations,mottling and unevenness of color. Each application of Perma-Cast® Sierra Stain TM  produces unique results." Each floor accepts colors in a different way depending on age,kind and depth of the concrete required repairing any cracks. 12- CBD offered many times- both verbally and in writing- to come back and work on the color to their satisfaction but they refused to bring us back,holding our money and accusing us of damaging their house when in actuality CBD added value to the house and improved their investment. Also, keep in mind that three quarters of the work involved in the project was CBD's work to prepare and level that basement, making it livable prior to applying the design and color.   Attached,please find Ms. [redacted]'s previous letters  to us,our responses to her and our lawyer's letter. Also, we have included some pictures of the finished floor,which we are posting on our website as we are proud of the results.
