Hello, I am writing to in behalf of [redacted] and [redacted] I am their daughter in law and am helping them with this situation My in laws moved to Florida in late March Prior to moving to Florida, [redacted] had some health issues and payments were missed on the home for several months before filing for bankruptcy in Dec They received a discharge from the bankruptcy April At this point, my in laws were under the impression that their home was included in the bankruptcyNeedless to say, after being in Florida years and renting a home, the home they are living in went up for saleWe suggested that they do a credit check and see if they could qualify for the home, to make things easy and not move my father in law around due to his healthAfter we got the credit report back,Feb 17, we noticed that their house was still in their nameWe looked up on the internet the address to the house and found that it was listed for sale We then asked my in laws what was going on and they said they had no idea, they called the loan company for the house when they left it to move to Florida and told them they were vacating the house and the keys were locked inside on the counterWe found out who was selling the house and contacted the real estate agent, April Starr of All Starr PropertyMy in laws informed us that April Starr had contacted them in March by phoneApril had a friend of [redacted] and [redacted] on the phone as wellApril found out the house was empty through this friend but April and my in laws never met nor had any prior conversationsDuring this phone call, April informed [redacted] and [redacted] that the house was in their name and they were responsible to the city for any weeds and grass and the empty pool in the backApril informed them that if anything happens on the property, they would be responsible as well [redacted] and [redacted] informed her the house belonged to the bankApril asked if the friend of [redacted] and [redacted] could live there and take care of the houseThey told April no, and that it wasn't a good idea to have someone in the house and that they didn't have keys for it anymore since the bank came and changed the locks April informed them that she had a way of getting the keysAt the end of this conversation the answer that my in laws gave was no and no they were not going to sell it I (Dawn [redacted] daughter in law) called April and began asking questions to see how she had approval to sell the homeApril informed me that she spoke with [redacted] and [redacted] and got their verbal agreement to sellI asked her to send me a copy of the listing agreement, She told me she would and then hours went byI called the office and spoke with Sherri and she too said she would fax it right over and we never got anythingI call April back and she said that Sherri would not know where she kept thatApril asked me to have [redacted] and [redacted] call herWe called April via way and [redacted] asked April over and over to send the listing agreement to meApril kept asking [redacted] why she wanted it and if something is wrongApril said "I feel like something is wrong"After additional requests the listing agreement was faxed to me and I then began comparing the signatures of [redacted] and [redacted] that were on this documentThe signatures on the listing agreement did not match [redacted] and DebraI questioned April Starr and she texted me back that "the signatures wouldn't match because it was a verbal agreement"When April was asked who gave authorization for people to be living in the house April replied "no one, I did it for the benefit of both parties" Funny thing the one party( [redacted] and [redacted] ) had no idea that the house was up for sale much less that there were people living in it until February 17, This agent went well beyond what is expected of an agent and took advantage of someone in another state by threatening them that they would be responsible if anything should happen to the house because it was still in their name and that the city would fine them for the tall grass when it grewThrough texts and phone conversations, this agent still couldn't understand what she did wrongWe kept explaining over and over to her that she forged signatures and put a house up for sale with out knowledge of the ownersApril Starr continued to say "I released the [redacted] from the contract" (that they never signed or agreed to) Within an hour of receiving the forged listing agreement, April Starr sent via fax a release stating that she would no longer be the agent to sell the house and that [redacted] and [redacted] were no longer under obligation to sell their home with her company, All Starr Property I have attached the spread sheet of texts that we communicated by on Tuesday and Wednesday February 18,2014, admitting the forgery issue and statement that [redacted] and [redacted] were unaware that anyone was living in the house and they did not give authorization for anyone to live there.Also you will find the listing agreement with the forged signaturesThis agent needs to be addressed so that she doesn't do this to other peopleAlthough nothing monetary was lost ( as far as we know), who's to say that she sold the house and pocketed whatever money would have come to [redacted] and [redacted] We only have confirmation of family that they did not pay rentApparently other families have been living in the house at separate times and April would not give me their numbers to call and speak to them, April asked "why do need their numbers?" We have not been able to talk to the other people in the houseAs of last week (Feb 19) the people living in the house were asked to move out by April Starr, April confirmed with me via text that they were moving out by Sat Feb and on Feb we found through a friend that a moving truck was blocking the street that day because someone was moving outThis agent needs to be stopped! She is shady and we can't figure out how bids can be submitted to the bank without paperwork from [redacted] and [redacted] allegedly short selling their homeAlso, interesting to note, the listing agreement states the house is being listed at $95,and yet on her listing on the internet and through her company April Starr has it listed at $110,Is this a common practice? Please make sure that this agent is corrected for the wrongs she has doneThis should never happen to anyone else EVER
