To open with; I find it interesting how Mrs [redacted] failed to mention several things: 1) I gave her a $discount off the job2) I spent almost an hour (with out charging her) removing cat paw prints off the newly resurfaced tub I did upstairs.3) That her old toilet was at least years old, and the tank lid did not sit correctly on the tank because the toilet was too close to the wall4) She had emailed me (I have the emails) and told me that the toilet she purchased cost $+ tax? 5) Mrs[redacted] stated that the tank was cracked, not sure how she came to that conclusion, because neither her nor her husband inspected the tank after it was leaking6) Mrs [redacted] filled this complaint on May 19th, a day after I spoke with her, and told her I would have a resolve for this by 5/the latest.With that being said, here is my side of the story, we did enter into a verbal agreement on May 6th to refinish two bathroom tubs and to also refinish existing bathroom tiles in the downstairs bathThis did involve removing and then reinstalling the bathroom toilet, so I could get to the tiles behind toiletThis was for the amount of $with a ten percent deposit of $To start with on the days I was running late, on 5/I was min late, I had called her husband & made him aware I was stuck in traffic, he said that was not a problem, nor did it effect the job for that dayThe second day, 5/15, I did not get to the job until 11:because I had a customer come in unexpectedly that morning to pick up a sink I had resurfaced, and I was waiting for [redacted] to show up with the materials for her jobAgain I was in communication with Mrs [redacted] , on the delay and the issue was with my vendors error on the shipment (this can be verified)When I got to the job, due to the delay, I made her aware that in order to make progress I was willing to stay late, she said that was fine and that she would order pizza, which she didDue to the nature of the work, and the circumstances of what needed to be done, I never made any promises on having the job done that day, I told her I will do the best I canAround 9:pm on 5/15, I still had much left to do, so I asked her what time can I be back in the morning to finish, she told me she was not going to be there, and neither was her husband, due to a dance recitalAt that point in time I was not sure what to do, because she told me she could not take any more time off from work, so I asked her husband if he could be there, and he was kind enough to acceptI asked him if it was OK to work as long as I could physically to get the walls done in order to resurface the bath tub the next dayHe said that was fine, so I worked until almost 1:in the morning! I would have had no problem leaving the job site at a respectable time if there was some flexibility, or if they told me the time was not acceptableI told her husband before I left I would be back in the morning between 9:30-10:00, I got there at 10:I finished the remainder of the job, put back in the vanity and the toilet, then I noticed a leak coming from the toilet tank, at that point it was around 5:pm and getting late, I told her husband right away about it and told him I would go to [redacted] for the repairWhile at [redacted] ***, I noticed there were various toilet sizes/shapes, I was not sure what would fit, until I found a replacement tankSeeing that was the problem, that would be the best optionI went back to the [redacted] 's home and told her husband that I found a replacement tank, and that was the only replacement tank [redacted] soldI also explained to him that I was not comfortable with replacing the whole toilet due to the nature of fittingHe said that was fine, lets see how everything fitsI installed the new tank, which fit correctly, her husband seemed happy with the new tank, because the new tank lid did not touch the wall and could be seated properly unlike the old oneHe did mention that the color was a little off, I asked him if that was acceptable, he said it was fine I guess? I told him if the color was a big issue that I would recolor the tank to match the bottom toilet for no charge out of good faith, he said ok I will leave that option openI then cleaned up, made sure there was no leaks in the toilet, & all was goodI prepared their bill, and then at that time (around 6:pm) Mrs [redacted] arrived homeShe was made aware of the issue with the toilet tank, inspected the job/toilet, and said she was happy and had no problems with the toilet tankShe paid the bill, and I took the old toilet tank, and left the job site.The next evening 5/17, I get a phone call from Mrs [redacted] stating that the new tank I installed was not acceptable, and that it is a water saver that does not flush rightShe told me she does not want the water saver crap, and that she wanted her old toilet backShe said she was having company over Saturday for [redacted] weekend and that she needed it fixed by thenI told her let me see what I can do, and that I would have a resolve for her by Thursday 5/the latestI cant say for sure if what she told me about the tank not flushing right was true or not, but I called [redacted] and they told me that the tank I purchased should flush correctly, if not it may be defective and to return itThe next day on 5/18, I get an email from Mrs [redacted] stating that her husband was going to [redacted] and pick out a toilet, and that she will give me a model number to purchaseI told her before she does that, let me have the old tank that was leaking looked at and see if it was something simple that can be fixedThe same evening she sends me another email asking when the plumber will be at her house, I told her that's not what I said, and that I was going to have her old tank looked atIn the mean time, I got a few emails from her saying she was willing to go half on a toilet and then another saying she was going to sue me? By Wednesday evening I had Mrs [redacted] 's tank looked at, repaired, and tested, I sent her an email on Thursday morning 5/(have the original email) saying that her old tank was repaired, cleaned and looks like new, and that all it needed was some new seals/hardwareI told her I could be up at her home that night around 6:30-7:(so she would not have to take time off from work) to put back in her old tankA fews hours later I get an email response from Mrs [redacted] saying she already purchased a new toilet, and that it cost her $+ tax.To close, after I read her emails, I felt I was being treated a bit unfair, yes not everything went as smooth as we all would have liked, but I went out of my way as much as I should have to try to make the job rightI did everything I felt I was obligated to doAfter all she did not contract my services to replace her toilet, yes her toilet tank did leak after I reinstalled it, but I do not feel I am liable to replace her whole toiletI still have her old tank, and would be happy to put that back in, and for her peace of mind I would give her something in writing that if that did leak, I would replace the whole toilet at no charge

I stand firm on principle here, like I stated in my previous response, Mrs. [redacted] assumed that the tank was not repairable, even though she did not know what was wrong with it. I told her over the phone that I would have a resolve & be over her house to fix the problem by Thursday 5/21/15 the latest, and I made the attempt. It is a matter of fact that I did send her a email on Thursday morning 5/21, stating I would be there that evening to correct the problem. I have attached the email response I sent to here. She filled a complaint on 5/19, this shows she did not give a crap on what I had to say, she passed judgement from the start for what ever reason that may be. She sent me an email (see attached) that the toilet she purchased was $292?? I still feel I am not responsible for an old toilet, that had worn seals, yes the toilet did work, anyone that knows anything about water seals knows if the seals are worn, when you disturb the seals it could cause a leak. I did what was needed to be done, not once, but twice! With that being said, I still leave my offer on the table to install her tank that was resealed.  I would guess she will not accept that, so I am willing to compensate her $100, what I feel is more then fair market value of her old tank (I did not do anything to the bowl & WILL NOT PAY FOR THAT). I have nothing more to say on this case.

Review: I enter into a contract with a Mr. [redacted] of All Surface Restorations on May 6th 2015 to refinish two bathroom tubs and to also refinish existing bathroom tiles in the downstairs bath. This contract involved removing and then reinstalling the bathroom toilet, so he could get to the tiles behind toilet. The contract was for the amount of $1675.00 with a ten percent deposit of $167.50. Mr. [redacted] said that if I paid the rest in cash it would be very much appreciated. Unfortunately I did pay everything but the deposit in cash. My husband and I each took one day each off for work to meet the contractor's schedule. Mr. [redacted] was late the first day (May 13th getting to the job and was three hours late getting to the second scheduled day on May 15th) He also didn't finish the job on the second, but was in my home until 1:30 am Saturday the 16th. He stated that he would back by 10:00 am Saturday the 16th. He showed up at 11:45 am. While putting our toilet back in, Mr. [redacted] snapped the toilet tank. He told my husband no problem, that he would get another one from [redacted].My toilet is an [redacted] and it is not the cheap line of their toilets that [redacted] offers. Mr. [redacted] brought back a thirty dollar tank that when you push down the handle nothing happened. You have to hold the handle down for it to flush. And because it is a gravity fed toilet, it doesn't flush everything down the first time. I told Mr. [redacted] that I wasn't happy with the tank he supplied and he said he would get back to me on it. I have an email stating that he would have a plumber friend of his come and "fix" the tank he got for me. Then he sent me another email stating the plumber wasn't coming to my house but [redacted] was going to take the toilet to the plumber and then bring it back, which would mean me taking another unpaid day off from work. I said no way.I have to replace my own toilet which cost me $232.90 and Mr. [redacted] won't return any more of my emails.Desired Settlement: I want a refund for what I had to pay out for a new toilet. I have the receipt for it. And I will be happy to supply a copy of it.I also don't think Mr. [redacted] deserves to have a good standing with Better Business. He doesn't display what I would think reflects good business practices.

When I got to the job, due to the delay, I made her aware that in order to make progress I was willing to stay late, she said that was fine and that she would order pizza, which she did. Due to the nature of the work, and the circumstances of what needed to be done, I never made any promises on having the job done that day, I told her I will do the best I can. Around 9:00 pm on 5/15, I still had much left to do, so I asked her what time can I be back in the morning to finish, she told me she was not going to be there, and neither was her husband, due to a dance recital. At that point in time I was not sure what to do, because she told me she could not take any more time off from work, so I asked her husband if he could be there, and he was kind enough to accept. I asked him if it was OK to work as long as I could physically to get the walls done in order to resurface the bath tub the next day. He said that was fine, so I worked until almost 1:30 in the morning! I would have had no problem leaving the job site at a respectable time if there was some flexibility, or if they told me the time was not acceptable. I told her husband before I left I would be back in the morning between 9:30-10:00, I got there at 10:10. I finished the remainder of the job, put back in the vanity and the toilet, then I noticed a leak coming from the toilet tank, at that point it was around 5:00 pm and getting late, I told her husband right away about it and told him I would go to [redacted] for the repair. While at [redacted], I noticed there were various toilet sizes/shapes, I was not sure what would fit, until I found a replacement tank. Seeing that was the problem, that would be the best option. I went back to the [redacted]'s home and told her husband that I found a replacement tank, and that was the only replacement tank [redacted] sold. I also explained to him that I was not comfortable with replacing the whole toilet due to the nature of fitting. He said that was fine, lets see how everything fits. I installed the new tank, which fit correctly, her husband seemed happy with the new tank, because the new tank lid did not touch the wall and could be seated properly unlike the old one. He did mention that the color was a little off, I asked him if that was acceptable, he said it was fine I guess? I told him if the color was a big issue that I would recolor the tank to match the bottom toilet for no charge out of good faith, he said ok I will leave that option open. I then cleaned up, made sure there was no leaks in the toilet, & all was good. I prepared their bill, and then at that time (around 6:15 pm) Mrs. [redacted] arrived home. She was made aware of the issue with the toilet tank, inspected the job/toilet, and said she was happy and had no problems with the toilet tank. She paid the bill, and I took the old toilet tank, and left the job site.The next evening 5/17, I get a phone call from Mrs. [redacted] stating that the new tank I installed was not acceptable, and that it is a water saver that does not flush right. She told me she does not want the water saver crap, and that she wanted her old toilet back. She said she was having company over Saturday for [redacted] weekend and that she needed it fixed by then. I told her let me see what I can do, and that I would have a resolve for her by Thursday 5/21 the latest. I cant say for sure if what she told me about the tank not flushing right was true or not, but I called [redacted] and they told me that the tank I purchased should flush correctly, if not it may be defective and to return it. The next day on 5/18, I get an email from Mrs. [redacted] stating that her husband was going to [redacted] and pick out a toilet, and that she will give me a model number to purchase. I told her before she does that, let me have the old tank that was leaking looked at and see if it was something simple that can be fixed. The same evening she sends me another email asking when the plumber will be at her house, I told her that's not what I said, and that I was going to have her old tank looked at. In the mean time, I got a few emails from her saying she was willing to go half on a toilet and then another saying she was going to sue me? By Wednesday evening I had Mrs. [redacted]'s tank looked at, repaired, and tested, I sent her an email on Thursday morning 5/21 (have the original email) saying that her old tank was repaired, cleaned and looks like new, and that all it needed was some new seals/hardware. I told her I could be up at her home that night around 6:30-7:00 (so she would not have to take time off from work) to put back in her old tank. A fews hours later I get an email response from Mrs. [redacted] saying she already purchased a new toilet, and that it cost her $293 + tax.To close, after I read her emails, I felt I was being treated a bit unfair, yes not everything went as smooth as we all would have liked, but I went out of my way as much as I should have to try to make the job right. I did everything I felt I was obligated to do. After all she did not contract my services to replace her toilet, yes her toilet tank did leak after I reinstalled it, but I do not feel I am liable to replace her whole toilet. I still have her old tank, and would be happy to put that back in, and for her peace of mind I would give her something in writing that if that did leak, I would replace the whole toilet at no charge.

I stand firm on principle here, like I stated in my previous response, Mrs. [redacted] assumed that the tank was not repairable, even though she did not know what was wrong with it. I told her over the phone that I would have a resolve & be over her house to fix the problem by Thursday 5/21/15 the latest, and I made the attempt. It is a matter of fact that I did send her a email on Thursday morning 5/21, stating I would be there that evening to correct the problem. I have attached the email response I sent to here. She filled a complaint on 5/19, this shows she did not give a crap on what I had to say, she passed judgement from the start for what ever reason that may be. She sent me an email (see attached) that the toilet she purchased was $292?? I still feel I am not responsible for an old toilet, that had worn seals, yes the toilet did work, anyone that knows anything about water seals knows if the seals are worn, when you disturb the seals it could cause a leak. I did what was needed to be done, not once, but twice! With that being said, I still leave my offer on the table to install her tank that was resealed. I would guess she will not accept that, so I am willing to compensate her $100, what I feel is more then fair market value of her old tank (I did not do anything to the bowl & WILL NOT PAY FOR THAT). I have nothing more to say on this case.

I will accept Mr. [redacted] $100.00 but I have emails also, just like he does that he was suppose to replace the seal on the toilet when he put the old toilet back in place. And I can supply all of them. I don' know what seal he is talking about. It wasn't a seal that had my toilet leaking all over the floor when he put the toilet in or he wouldn't have replaced the whole tank. He stated to my husband that he cracked the tank when putting it back in. If we are lying, why would Mr. [redacted] feel he needed to replace the tank and not just a seal??!!!! I have his original proposal that states removal and re-installing of old toilet that states he would install a new ring seal. BUT I WILL NOT CONSIFER THIS CASE CLOSED UNTIL I RECIEVE THE PAYMENT OF $100.00 AND IT HAS CLEAR FOR MR. [redacted] REFUND. Please let me stress one more time. I contacted Mr. [redacted] on the Sunday of 5/17 with how upset I was about his cheap [redacted] tank. Mr [redacted] is a damn liar! He never told me by phone anything! Because he never would pick up the phone. The only correspondence we had was by email which you have all of and the only time he wanted to talked to me was after I said I would contact a lawyer. I will say that when he does his work, it is presentable, but that I don't think I need to replace a toilet afterwards.

I have reviewed the response made by the business in reference to complaint ID 10632602, and find that this resolution is satisfactory to me.
