[redacted] from All Temp is an answer for prayers. I called on Sunday morning because our furnace was not working, with the temperature at 14 degrees out if was freezing in the house. He came within a 1/2 hour. It was a simple switch that we didn't know was there, he fixed it in ten minutes. He did not charge us for the the trip over. I am very thankful for his honesty, and his care. I will call him anytime we have a heating cooling problem.

They are trying to charge me for a restocking fee of $122 after I cancelled my order. They switched from [redacted] to [redacted] unit for $7300!Company was an [redacted] dealer and was coming out to my home to do regular maintenance on my [redacted] unit. On this occasion they came out and said that the heat exchanger had a hole in it. That unit was only 12 years old. They said it would cost $7300 to replace the unit. They represented it as [redacted]. This was over twice what we had paid for the 12 year old unit. They were originally an [redacted] Dealer. They never told us that they were planning on installing a [redacted] unit. They hid this fact and never informed us that they had switched from being a [redacted] dealer to a [redacted] Dealer. No indication on the invoice the tech left on the day of his indicated the unit was [redacted]. In fact the invoice had [redacted] written on it leading us to believe that was what we were going to get. I am 77 years old. Also the invoice did not indicate any model types or any information about the unit except for the fact it was 14 seer. When we called to cancel the unit they said there would be a restocking fee even though the unit never left their warehouse. They would not give us any information on the model or type that would even justify the pricing of this [redacted] unit. We then found another dealer that was able to deliver and install another system for only $3500. That is less than half what they were trying to charge us. I guess we looked like good targets being senior citizens and we believe they misrepresented the brand of the unit and other pertinent information thinking we would never notice. It is a shame that companies like this are allowed to misrepresent the product and try to bait and switch you.Desired SettlementWe simply would like for them to eliminate the restocking fee of $122.How can you charge a restocking fee when you have not even delivered a product and when it was not the product that thy represented on their invoice. They failed to note exact model or brand except for [redacted] on the invoice. Then I will address the outlandish and quite insulting accusations contained in this document. 1. The [redacted] color brochure was gone thru and clearly explained to the homeowner! (2) models of [redacted] systems were explained in great detail and prices were given in writing! 13 SEER @ $6,441.00 and 14 SEER @ $7,332.00. Mr. [redacted] chose the 14 SEER [redacted] system. Mr. [redacted] chose the more efficient of the 2.We (like 90% of all heating & air dealers nation wide do not have a warehouse!) At the time the order was placed, it was called in to our distributer with a job name of [redacted], to be delivered from their warehouse in [redacted], ** to our location. This unit was delivered as scheduled. The installers had it loaded on our install vehicle the following morning when Mr. [redacted] called to cancel his order. It was explained to him that there would be a re-stocking charge as we get charged a re-stocking fee from our distributer as they have spent man hours, diesel fuel, etc, to get us the unit! This is nothing abnormal or making someone "a target" there is NO invoice " misrepresenting " anything! We have all documentation and an invoice from our distributer for the re-stocking fee that WE OWE THEM! I am not even going to address the other ridiculous statements except to say that we do not need to and do not mislead, target, misrepresent anyone! We have an impeccable reputation and have been in business for over 16 years. We are a T.V.A approved contractor, State of TN licensed contractor! We would "simply like to eliminate the restocking fee" also. However, as a logical person I understand that [redacted] Supply companies time, labor, fuel are not free! We will pay our distributer! (invoice #XXXXXXX ) Apparently Mr. [redacted] and his son are under the misconception that they should be held to no debt in this matter! All Temp has given them a discount on the amount owed and have not charged them for our time, labor, fuel! It is a shame that some people will stoop to such despicable measures to try to keep from paying what is owed![redacted]OWNERConsumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Mr. [redacted] has never spoken with me as he indicates in his response. The service invoice which they had my Dad sign does not include the model or series or even brand of the unit they were trying to sell him. The only brand name on the service invoice was [redacted] When I emailed Mr. [redacted] he refused to give me any information in regards to the model or series of the unit that he has claimed to have ordered for my Dad. No where on the service order is my Dad given the right to cancel within 3 days.Dad states that he told this technician that he was not sure what he wanted to do. He also stated that the technician never told him that he was trying to sell him a [redacted]. As I previously stated nothing on the service invoice indicates that the unit was going to be a [redacted]. Seems like there should be alot more detail and a separate contract when a company is trying to sell you a product for $7300. Dad never signed any contract. He merely signed an ambiguous service invoice.The service invoice does not indicate the cost of the undescribed unit. Surely the unit does not run $7300. There must be a labor charge, right? This ambiguity is not very professional.Service order says "found cracked heat exchanger. Quoted new unit. Cust Wants 14 Seer Gas pack." That is the entirety of the description of the Unit except on the service order where it states [redacted] So based on this my Dad believed he was getting a American Standard unit. So this dealer could have delivered any brand unit or any series based on the poor description on the service order. Dad was expecting an [redacted] and states "that they did not tell him it was going to be a [redacted] and the service invoice proves this lack of information! Why no contract with brand name, model, and or series? I am sure when Mr [redacted] goes to buy a vehicle that the contract states he is buying a [redacted] so that they do not end up delivering him a [redacted]. In addition my Dad asked how much it would cost to simply replace the heat exchanger and he was verbally quoted over $5000! His unit was only 12 years old.Mr. [redacted] states he has the invoice for his purchase of the unit from his supplier. We would like to see this. We would also like to see the return invoice. How are we even to know for sure that this was indeed the brand, model, and series that was going to be for Dad since it was never stated on the invoice? I have checked online and have found that 14 seer, 2.5 ton units from [redacted] go for around $3000 Plus installation. I am in the process of getting written quotes from other dealers to try and understand how Mr [redacted] quoted $7300.It would be helpful if I had a brand, series, or model to go by from the service invoice or from my email inquiries to him. I have been in touch with [redacted] Controls which is apparently the parent company of [redacted] and they suggested that Mr [redacted] provide us with all documentation in regards to this unit and where and by whom the unit was ultimately installed. If Mr [redacted] installed this unit at another home than he is not due any restocking fee. Mr [redacted] needs to be forthcoming of documents that fully support his position. Our document clearly shows that my Dad was not informed of the brand, other than American Standard, model number, series, etc other than the unit would be 14 seer.Mr [redacted] has not provided my Dad or myself any documentation with or without my Dad's signature on it to prove that my Dad wanted a [redacted] system. My dad feels that he has been taken advantage of and Mr. [redacted] has yet to prove Dad wrong. What cannot be denied is that the tech who wrote up the service invoice needs to be trained on being more descriptive of the service and goods he is trying to sell a customer. To say a brochure was thoroughly gone through but then to not make any mention of the brand, model, or series on even the service invoice makes it seem like the technician didn't even know that information or was not willing to share it. Please review the service invoice that I have attached. I received this from Mr [redacted] as his proof to support his case. There is no proof that my Dad requested a [redacted] system and therefore no restocking fees for a [redacted] system would apply.Final Business Response The $122 re-stocking fee has been discounted to a $0 balance and is no longer being pursued. Final Consumer Response (The consumer indicated he/she ACCEPTED the response from the business.)We accept the removal of the $122 restocking fee from our bill. We accept that All Temperature Heating and Cooling will no longer pursue trying to collect this fee. We accept in good faith that no further attempts to collect any monies will be pursued by All Temperature Heating and Cooling.
