During the contract conversation between the client and myself on 2/19/2015, the fact that there was no mention of the removal of "all limbs" in the original contract was established, the client explained that there was a tree in the back of the property that animals were using to gain access to the houseI agreed to go by and take a lookI suppose the client assumes this is the verbal contract he mentionedDue to inclement weather throughout the month of February and personal illness I was not able to get by the property to assess the situation as soon as he would have liked However, I did go by the clients rental property and investigated his concern and after considerable surveillance I was able to ascertain the squirrels route to the roof and eliminate it

We spoke again Monday, February 23, 2015 and you affirmed that you would remove the limb by the end of the week of the 23rd. As of February 28, 2015 the limb has not been removed. I have tried reaching you several times at [redacted] and left several messages since we made the verbal agreement. However, you have not returned my messages and have not contacted me in that regard. The failure to remove the limb has allowed an animal (squirrel) to access my roof and this is the reason for the urgency. I need this to be done asap and have the contract completed. Please respond? Review: Contracted Allen M. Enterprises to cut tree and "all" limbs surrounding house for $1,500.00 USD.

Allen M. Enterprises failed to cut limb from tree in the back of my house resulting in a small animal (squirrel) entering the attic.

This has caused me additional money (financial loss) to remove the squirrel and repair the damage done.

Note: tried to contact Allen M. Enterprises numerous times on 2/12 and 21/13 (left a voice message and have not received a call back).Desired Settlement: I would like Allen M. Enterprises to "Complete The Job" and issue a partial refund equal to my cost for removing the squirrel and repairing damage done to my attic.

Review: I hired Allen M. Enterprises to regrade my back yard in October 2012. During performance of the work, Mr. [redacted] damaged the distribution box to the septic system causing sewage to leak in the yard. My first call to him was answered and he stated how was he to know that the distribution box was where it was. It appears it would be his business to know since it was obvious that there was a septic system and all lots over 1 acre (this is 6 acres) are required to have septic systems in [redacted]. Since he had already been paid by my wife who had not noticed the damage as I was out of town, he refused to answer any follow up phone calls. In addition he failed to sign for a certified letter I sent him on November 14, 2013. Since the leakage was reported to the county I had 30 days to fix it and had to hire a contractor to do the repairs since Mr [redacted] would not take responsibility for the damage he did to the system.Desired Settlement: I would like a refund of $1000.00 for the cost of the replacement of the distribution box in my septic system.

A distribution box is used to "distribute" waste and water that is pumped from the septic tank throughout a series of corrugated drain pipes dispersed into a "drain field" all of which are buried in the ground. The drain field in this case is the entire back yard which was what I was hired to regrade. The yard was full of swells, holes and ditches that would require a lot of topsoil and grading to make it level and usable. This work would be done with heavy equipment and large trucks delivering the soil. Any time heavy equipment is used on a drain field or septic system, there is a risk of damage to that system from the weight of the equipment. All of this was explained to the client and accepted prior to the work being done. Upon completion of the grading, I received a phone call from the client and was informed that a licensed septic contractor and an inspector from [redacted] had been contacted. I went to the residence to inspect the damage for myself. A wet area in the yard indicated that the distribution tank was over flowing. I spoke with the inspector from the county and it was determined that a pipe had been damaged, not the distribution box, and was causing the backup. I spoke with the resident owner and informed him that not being licensed for septic work, there was nothing else I could do. The fact that the homeowner was informed of the probability of damage to a buried system was possible, and the fact that he elected to do the work anyway, removes any liability from Allen M. Enterprises LLC morally and legally.

Per our discussion today concerning the subject complaint against Allen M. Enterprises, LLC, I have attached the actual Notice of Alleged Violation issued by the [redacted] Health Department on November 7, 2012. The Notice clearly states that the distribution box was damaged from a horizontal direction and was no longer water tight. I have also attached a copy of the certified letter I attempted to send Mr. [redacted] on November 13, 2012 in response to his failure to answer or return my calls. His statements that he 1) explained to the client that there was a risk of damage, 2) that he went to the residence to inspect the damage, and 3) spoke to the resident about the damage are false:

1) His discussions about the work were no more than providing a proposal and an approximate start date-copy of proposal is attached

2) His only response to the only phone call he answered was that “how was he to know where the distribution box was”-

3) The statement above is the last conversation we had concerning the damage as he refused to answer the phone, return messages, or sign for the certified letter I sent. He never discussed any of the items mentioned in his response nor did he ever return to my house after receiving final payment when he completed the grading. Unfortunately I was not at home and he got payment from my wife before I could inspect the work.

As of having to correct the problem, since Mr. [redacted] would not respond I was obliged to fix the problem within the time frames required by the Notice or face fines/penalties.
