This complaint is based on a misunderstanding between Triple R Doors & Windows and the customer.  We were unaware that the customer wanted to obtain a WPI-8 certificate at the time of the sale.  We became aware of it after the windows were purchased and installed, when the customer...

started asking about an inspector.  The windows they purchased were windstorm approved for Harris County, but not for Brazoria County, where impact DP-rated windows are required to obtain a windstorm certificate and receive an insurance discount for same. The customer did not specify they needed impact windows and in fact, stated they they didn't want that because of the cost. They had already had a complete presentation from [redacted] and they determined the cost was too high. Therefore, under the assumption that they wanted "standard" windows, the windows were ordered and installed as "standard" windows.  We were then called back because the windows did not, of course, pass the windstorm inspection.  It is customary for homeowners to contact their insurance company before they purchase windows to determine the type of windows they need to order for certification and set up the inspection for after the windows are installed.  This customer did not do that and therefore, the windows did not pass. They became angry and wanted to blame us for their mishandling of the situation.  So, in an attempt to help them, we returned to re-do the screw pattern on the windows to attempt to pass the inspection.  The windows failed once again.  We feel the customer, in an effort to save money, tried to go around the system by purchasing cheaper windows and then attempted to get their insurance discount after-the-fact.  If we had been aware that impact windows were desired, we would have ordered and installed impact windows to accommodate the windstorm certificate, as we have done many times before with other customers.  It was not our intention to mislead them or rip them off in any way. We would have been happy to sell them the correct windows had we known.  Customers in Brazoria County may purchase any type of windows they wish.  We have since learned that the customer has obtained their WPI-8 certificate with the same windows we installed for them.

This customer was building a new home on their own property in a rural area.  They ordered the door from us  in February and the door was ordered.  There is a certain time during construction that a beautiful, Mahogany front door can be installed so that it does not get ruined while...

the home is being finished.  The  house was not ready for the door to be put in until May.  The home was located in an area outside our usual working area.  The area around the home was a construction zone and extremely muddy due to all the rain we have had this year.  The job was estimated as a one day job due to the travel time involved.  The door was delivered and then installed.  The holes were not cut for the door hardware because the customer did not have the hardware available to measure so we could cut and install.  The door was fit to the opening and the exterior trim was installed to perfection.  The customer was asked to inspect the door and approve the work that had been done, which they did.  The job could not be completed because the sheetrock had not been installed in the interior to complete the trimwork. The crew even waited for an hour and a half for the sheetrock team to show up to possibly finish the work. The job would have been completed that day  if the sheetrock had been there. It is not Triple R Doors & Windows' fault that the customer was not ready for the complete installation.  So, the door had to be removed and carried out and stored in a warehouse on the property and we had to install a piece of plywood over the opening until the sheetrock could be finished.  The customer was told that we would be back out to complete the work once the sheetrock was finished, but later asked for an additional cost to cover the additional day and the travel expenses due to their contractors' delay.   The customer did continually ask for pictures of the door and  repeated, repeated requests that the door be installed way before it was time for it to be done.  Triple R Doors & Windows installs hundreds of doors and has a 99% approval rating from customers.  Our quality and workmanship are excellent.  We give a good product and excellent workmanship for a minimal price.  Our prices are such that we cannot do extra, unexpected work without additional cost because our margins are so low already.  We regret that these customers cannot appreciate the discount they got on their beautiful new door and refuse to pay just a little additional money so that we could have finished the work. They would have been very happy with the outcome.  It is a sad day that because our company cannot provide free labor and travel time due to a customer's untimely situation, we have to suffer slanderous remarks on a public forum for it. Respectfully,Jack R[redacted], Triple R Doors & Windows

[redacted] Sent: Monday, November 23, 2015 2:33 PM To: drteam Subject: Revdex.com Regarding Complaint #[redacted]   Revdex.com Regarding Complaint #[redacted]RecapJack of Triple R Doors never mentioned a vendor or a 3rd party making the doors, he promised and guaranteed to custom build them himself.   He used a vendor he refused to identify.When we signed contract and paid for doors contractor ignored request to deposit check on date given and presented check one day before as date stamped by bank resulting in an overdraft charge from our bank.  Contractor called screaming that [redacted] was writing hot checks and "stealing his money".  After repeatedly asking him when he presented check and after repeatedly lying that he deposited on the requested date he confessed to depositing the check early and promised reimburnsement of overdraft fee. He guaranteed delivery and installation within 10 days, he failed to provide any response and update on progress or pre approval of doors for 3.5 weeks.  He failed to delivery doors that were requested as specified and contracted.  Jack made many innapropirate calls yelling, screaming and beligerant accusing us of harrasing him when requests for progress were made.  Jack promised to have a resolution the night he delivered stock doors from a local door wholesaler, not custom with manufacturer stickers still present. (see attached pic) Jack claimed vendor would not respond to him for a week and offered no resolution and continued to make irrate, beligerant calls to both my wife and I. In response to the contractor ofer to resolve the matter we will accept contingent on the following conditions of providing pictures of doors for approval no later than Nov 30, 2015.  Approved doors will be completed and delivered no later than Dec 2, 2015.  Contractor will refrain from communicating with us yelling, screaming and using profane language. Contractor will deliver doors to our home no later than 7pm Dec 2, 2015Failure to complete doors as requested and contracted within the time specified will result in continuing with legal proceedings with [redacted]  Please see attached legal document sent to Triple R Doors which was acknoledged in their Revdex.com response.  It stands noting that contractor has failed to respond to this legal action in any way. II. Basis for Recovery 2.1 In their dealings with your company, our clients contracted with you for goods and services. Accordingly, in this transaction, our clients are clearly "consumers" as such term is defined under the [redacted]. 2.2 Our clients assert that you committed a number of false, misleading or deceptive acts and practices prohibited by Section 17.46 of the Texas Business and Commerce Code (the Texas Consumer Protection - Deceptive Trade Practices Act) including, but not limited to, the following: 1. Representing that good or services have characteristics, uses, or benefits which they do not have in violation of the Texas Business and Commerce Code §17.46(b)(5); 2. Representing that goods or services are of a particular standard, quality, or grade, if they are of another in violation of the Texas Business and Commerce Code §17.46(b)(7); 3.
