Correct the response given with the illustrations was with the receipt that was sent there was a second portion of the fence that I met with the homeowners new boyfriend who was not part of the original contract whatsoever and he showed me where he wanted the fence we dug the holes we brought part of the material to the job at that time he said he would no longer like us to do the fence he wanted me to drop the fence off and he would put it in himself so they wanted me to take the holes and drop the material off and not pay me any more of the moneyI have called the person that the contract was with several times to reach an agreement I assume this is not who has emailed you I assume it is her new boyfriend who I have been to the police to get an order of protection against because he was messaging my mother on Facebook and showing up at my job sites and threatening me he told me if I didn't put the fencing for free that I would end up like [redacted] who after some research I discovered that [redacted] head beating him into a vegetative state and in fact been to prison for several years agoAt that time I discontinue contact with ND alerted the local law enforcement and attempted to contact the actual customer who is [redacted] stanislawskiShe has not returned my callSo to clarify I was provided with a receipt through a previous email from you and I answered with the pictures depicting the job with the receipt had been completedI have attempted to reach the homeowner [redacted] several times to discuss what we could do I dug holes at the instruction of [redacted] I was permitted on the property and in fact invited back to pick up the materials which he said he was going to throw away if I did not come back on the property and removeIf you have someone named [redacted] telling you that he gave me $1,I would like to see that receipt provided because the work began and then when he informed me that I would not be paid work was discontinued and his online attack beganAs mentioned he is not an actual customer and has supplied proof that he is not a customer in the receipt provided yesterdayI was misled by [redacted] to believe that he would be taking over [redacted] Sands laskey's End of the contract however when he informed me he would not be paying our relationship was over and as mentioned above it was a less than amicable separationAgain I have called [redacted] several times for I went to the police about [redacted] harassment and while I was at the police station at the direction of the sheriff my calls have not been returned I believe that [redacted] and I could get to a resolution that works for both of us however ***'s involvement has made for several setbacks and discomfort by both sides.?

Before they paid me they we walked around the fence and there were no complaints, I fixed what I needed to fix? The holes underneath had nothing to do with me, the ground is uneven and there are animals out there that dig holes under the fenceWhile doing the job, the two consumers had different ideals of what they wanted, so I split the difference, also against my better judgement, they ask me to use some of their old fence and that is why there is some gaps and I regret doing it? The only thing I feel that needs to be done is the panel in which they state is not the same color? I will be out that way in a couple of weeks and I can repair at that time

I never received any paperwork from the court and I did go to court? The consumer said he sued me and I just think this is crazyI asked him did he want the fence done, he said no, so I sold part of the fence that I was suppose to put up? I guess I will cut him a check, I don't know when it will be, I will check with my accountant

Response taken by phone: There was a big miscommunication with this customer The consumer did sign our contract in the middle of November The contract states that it will take up to weeks to install the fence I purchased all the materials for his fence but now that winter is here I cannot install it I have spoken to the customer and let him know he will be one of the first fences that we install this Spring.

*** *** I would have simply closed this had it not been for the company owner calling me irrational and lying about a 'contract'This is not a forum for name calling and lying; instead, only the facts should be presentedThe fact are: there was no contract, only an invoice and an agreement to install the fence as stated in my original complaintI've enclosed copies of the original invoice dated 4/19/with the company owner's initials acknowledging the deposit check, the check dated 4/20/2016, which was cashed on 4/21/2016, and a copy of a backdated contract that was left in my brother-in-law's mailbox on Wednesday 8/10/Please note the invoice date and additional contract clauses at the bottom of the page that aren't present on the original invoice and the fact that my signature is not present on the backdated invoiceAlso note the he states I've been actively writing about his business on-line, writing letters, and contacting several government agencies in an attempt to further damage his businessThe Revdex.com is the only site I've contacted concerning this and only in an effort to resolve a bad situation, not to damage anyone's businessI've written no other letters and the only government agency I've contacted was my local police departmentPlease ask the owner to submit proof of me doing otherwise.I did manage to get a full refund on 8/10/2016, but not without threats of having the company owner arrested for grand larcenyRegarding this being a civil or criminal case, that's depends on certain criteria and the County DAFrom what I've been told by the police, the criteria fit a criminal charge.In any case, since I did get a full refund, you can close this complaintIf the company owner continues to disparage me with name calling and lying, I will then file another complaint on this site and it will include the names of the police officers who have been directly involved in the negotiations with the company owner so you can contact themIn addition, I'll also submit review to other business review sites such as *** *** and *** in addition to filing a police complaint

I went out of my way to help Mrand Mrs*** as much as I could with the situation that was presented to me. We first were called by Landmark Home Warranty's dispatch department on 09/13/in regards to excepting a dispatch in this area and we accepted*** our dispatcher called Mr
*** and he immediately said you are coming today right? His demeanor was very pushy and demanding to her and he was very snappy with her when she told him we were already full for the dayWe offered him our next available time of 11-3pm on 09/14/because we were already booked up for the current day and would squeeze him in even though he was off route a little because I myself was going to handle the claim the next dayHe accepted but was not very happy about it but we deal with this at some point on a weekly basis.While running my appointments on 09/13/I had one of mine reschedule so I called *** and had her call Mr*** and asked if we could move him up to 09/13/around 3:00pm and he was very excited and said "YES PLEASE!" and "Thank you so much."I arrived at the property and found both the front loading washer and dryer were on makeshift sided homemade wooden stands and the drain hose had vibrated out of the drain in the wall because the washer is not stable on the stand that was built by Mr*** for itI immediately explained to Mrs*** that this was an improper installation and not wear and tear that is not covered by her home warranty company and it is definitely what had caused her malfunction causing water to dump out after each cycle onto the floor of their homeI advised her to either get both correct Samsung pedestals for her machines or put them on the ground because the stands they are on are inadequate to support the machines and posed a safety hazard and also could damage the machines further.I went ahead and slid out the dryer about foot and pulled the drain hose back up, installed it in the drain and zip tied it to the washer supply hose to help prevent the hose from coming out againWhen moving the dryer I found that the customer had put foam rubber mats under the already unstable sided stand that were completely saturated to more then likely eliminate the noise from the machines banging around on the unstable standsThese mats were not made with the intention to be used for this applicationI tried to move the dryer back and it was sliding off of the stand because it was not secured to the stand causing very hazardous situation for me to attempt to lift the dryer, the makeshift stand and the slippery wet mats together while trying to prevent the unsecured dryer from falling off and hurting meThe foam rubber mats were all wet as well as sliding all over when I was trying to get it all settled because they were not designed with the intention of getting wet and being moved under the weight of these machinesMrs*** had seen I was struggling trying to get this mess of a contraption back together and told me that her husband and friend had made those and it required people to get it all back togetherShe said she would tell him to call one of his buddies to helpI then moved the stand back as best as I could and centered the dryer on the stand so that it would not fall off and hurt someone. Next we went to the kitchen to fill out my paperwork and Mrs*** had a question about her microwave and I went ahead and helped her out with that as well, at no additional charge, while writing up my paperwork and helped clean it and put it back togetherWhen I left everyone was happy and all was workingWasher tested for leaks and spin stability, dryer turned on and heated and microwave was running and heating.At 11:26am Mr*** called our office and spoke with *** demanding that she have the tech that left his home in total disarray, call him backI was out of the office until roughly 1:00pm and had things I needed to address that were more pressing so I did not immediately call Mr*** upon walking in the doorAt 1:28pm Mr*** called and *** transferred him to meI answered the phone and introduced myself to him and he immediately began to question the reason he was transferred to meI asked him how I could help him while he spoke over meI asked him what appliance he was having a problem with and he said the washer because it's wobbling all over the placeI told him the washer had not been moved at all during my visit out, and he instead went back to speak over me and demanded me to come back out today (09/14) to help him put it all back the way he wanted itI advised him that the failure was not wear and tear and it was not covered by Landmark Home WarrantyInstead of just walking away from it, I went ahead and took care of what I could while out and if he wanted us back out it would be $for a service call as he continued to speak over meHe stated that he was now not happy that we came a day early and also told me that he had already paid and was not going to pay $for us to come back out and address this issueI again informed him Landmark Home Warranty was not going to pay for his improper install / abwear and tear issueI also stated that if he was to call me out of the phone book it would have costed him more to start out withHis response was it is not his fault that I do work for LHW for so little money (This was never the topic)I had enough of him talking over me and him attempting to twist my words and his demands so I kindly told him to have a nice day and calmly hung up the phoneI as a business owner do not have time to argue with him about the validity of his claim or his opinion.Immediately Mr*** called back at 1:35pm and told me he would listen to what I had to say instead of speaking over me because he knows how nice I am for helping them out with everything so farAs you would guess it did not last for longWhile being able to speak I told him LHW is not responsible for the damages caused by his makeshift stands and to improve his problem, he needs to buy the appropriate Samsung pedestals for his machines to prevent any further damage and for the safety of his familyHe once again began to talk derogatory towards me stating that I am now a salesman for Samsung for suggesting the proper solution to his situationHe stated the washer and dryer have been this way for years and he did it in an attempt to save his family money because he has a very young daughter that is less then years oldHis comment did not even add up and I told him, sir I am sorry I can not do anything else to make you happy at this point after trying repeatedly, unless you are going to pay for a service call I can not sit on the phone and argue with you all day because I have other things that I need to attend to and left it at that.At 2:22pm Mr*** called back again to finalize his threatHe demanded once again that I go out to his house immediately to fix his problem while smugly saying how nice of a guy I was or he was going to finalize his complaint to the Revdex.com and complaint to Landmark Home WarrantyI told him his complaint held no merit and I wish he did not feel this wayI once again told him to have a great day and this was the last I heard from Mr***.Mr*** did not pay me directly for any services preformed as I was not contracted to his home by him but otherwise by his home warranty companyI have to uphold the policies of the company that contracted me out that he has a full contract with and can not go back out without pay for a situation that is not covered by his warranty company and also that poses a safety hazard.
