If reference to the above complaint number, we Falcon Heating & Air Conditioning, INC have the following response.This home was originally built as a new construction home in and purchased by [redacted] from his builderFalcon was contracted by the builder to install and supply the HVAC system for this homeAll warranties in the contract us between Falcon and the builder and were never directly between [redacted] and FalconIn [redacted] filled a warranty request with his builder that the spacing between the units was not to spec by mfrguidelineHe builder contacted us and upon review it was found that in fact one of the units did need to be movedOn 12/03/the unit was moved and a micron vacuum was pulled on the system, which was held for minThe unit was recharged and has been working fine [redacted] then contacted us on or about 5/27/saying his unit has been found leaking at a solder jointUpon further speaking with the builder it was found that [redacted] had contacted them first and explained that he had two separate HVAC companies working on the system since it had been movedThe builder told him that they would not provide any further warranty as they could not guarantee that the other companies did not cause the issueAs a result [redacted] has now filled a grievance against usFalcon has never had a contract with [redacted] ***Our warranty guarantee is to our contracted builder and has been up held by themFalcon believes that if [redacted] feels that there should be further work done, then he should fill through the builder whom he bought the home from and provided the warranty guaranteesThey do provide the homeowner a process for this and make the final judgment call

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed as Answered] Complaint: [redacted] I am rejecting this response because: Let me provide few corrections and response to the story from FalconBack in 2012, I had let Falcon and builder know that the HVAC units are incorrectly installedTechnicians from Falcon and MrG [redacted] has visited my house in to check the units and did not take action stating that the units are installed correctlyAny good HVAC company would immediately know that the units are not installed correctlyIt is really surprising that the techs from Falcon lacked the basic skills OR they just wanted to avoid correcting their mistake I provided all the proof and documentation that confirmed that the units were incorrectly installedBased on that builder and Falcon were left with no choice but to get it addressedThe units were moved on 12/30/and not on 12/03/Not completely sure that micron vaccum for min means? Can Falcon provide some industry standard guidelines that state that microns at mins means the not only the unit is working fine but also all the joints are leak proof at that point in time? Also can they please provide documentation or proof that it was held to that since I never saw any documentation stating that? The technician that moved the unit did not mention of that when they moved the unitThe builder asked me to contact Falcon as they had done the work in my houseI did contact Falcon and they did not even care to acknowledge or remotely entertain that the poor quality of work from them could have contributed to the leak in my homeMore importantly they did not have any appointment for next daysAs a result I had to ask other companies to come check itIt was just diagnostic check and those companies did not perform any repair work on the systemFalcon did know about it since I had told them as well as builder that I had to get immediate helpIt is such a shame that Falcon is trying to run away from their responsibility based on some mere technicality and citing an sloppy reasonI have filed grievance against Falcon as they were the ones who came in my house to fix the issue and did not complete the job correctlyThey were the ones that installed the unit incorrectly in first placeHad they sent skilled technicians, the issue would not have occurred at allTheir technicians decided how and where to move the unitBuilder was not present and neither did Builder decide on what to do and how to doIt was all decided by Falcon technicians onlyBased on the advice of MrG [redacted] I reached out to Lennox and showed them the pictures of installation done by FalconThe technical support rep from Lennox told me that the lineset has been very poorly installed by Falcon and generally good HVAC technicians would not install it that way at allI think the techs from Falcon just wanted to get it done rather than doing a good professional jobFalcon needs to own up their mistakes and poor quality job They need to demonstrate accountability on the work that they have performed and not wash their hands off the mess that is created due to incomplete work performed by their techniciansIf the soldering is done correctly & linesets are installed as per the ideal recommendations from the manufacturer then they should not leakIt was Falcon who cut the existing lineset and then soldered with a new piece of the lineset when the unit was movedFalcon is the one that have messed it up by taking a short cut when they moved the unitI had a complete lineset in my home before the unit was installed and then Falcon made the decision to cut it so that they can move it (as they made the initial mistake of installing outside of manufacturer recommendations)If they did not possessed expertise in installing partial lineset, then they should have installed a complete new lineset from start to endI am in this situation due to inept work by Falcon and would want them to pay Regards, [redacted] ***

Let me provide few corrections and response to the story
from FalconBack in 2012, I had let Falcon and builder know that the HVAC units are incorrectly installed. Technicians from Falcon and Mr. G[redacted] has visited my house in 2012 to check the units and did not take action stating that the units are installed correctly. Any good HVAC company would immediately know that the units are not installed correctly. It is really surprising that the techs from Falcon lacked the basic skills OR they just wanted to avoid correcting their mistake I provided all the proof and documentation that confirmed that the units were incorrectly installed. Based on that builder and Falcon were left with no choice but to get it addressed. The units were moved on 12/30/14 and not on 12/03/14. Not completely sure that 500 micron vaccum for 15 min means? Can Falcon provide some industry standard guidelines that state that 500 microns at 15 mins means the not only the unit is working fine but also all the joints are leak proof at that point in time? Also can they please provide documentation or proof that it was held to that since I never saw any documentation stating that? The technician that moved the unit did not mention of that when they moved the unit. The builder asked me to contact Falcon as they had done the work in my house. system for this home. All warranties in the contract us between Falcon and the builder and were never directly between [redacted] and Falcon. In 2014 [redacted] filled a warranty request with his builder that the spacing between the units was not to spec by mfr. guideline. He builder contacted us and upon review it was found that in fact one of the units did need to be moved. On 12/03/14 the unit was moved and a 500 micron vacuum was pulled on the system, which was held for 15 min. The unit was recharged and has been working fine. [redacted] then contacted us on or about 5/27/16 saying his unit has been found leaking at a solder joint. Upon further speaking with the builder it was found that [redacted] had contacted them first and explained that he had two separate HVAC companies working on the system since it had been moved. The builder told him that they would not provide any further warranty as they could not guarantee that the other companies did not cause the issue. As a result [redacted] has now filled a grievance against us. Falcon has never had a contract with [redacted]. Our warranty guarantee is to our contracted builder and has been up held by them.
