I am rejecting this response because:Even prior to our one month that we had to pay late, we had problems with people (residents or not, we don't know and never asked) harassing us and our children in the middle of the night. There were people at the pool at about...

2 or 3 am and we asked them to leave. We weren't made aware of any security measures we could take, and so after asking them to leave, we went back into our apartment. Every week or two after that incident, we have had people banging on our door, waking up us and our kids, at 2 or 3 a.m. We are nervous every night before we go to bed, and our two young children have started sleeping with us at night because of continued noise at the pool after hours as well as fear of the "bad guys" banging on our door and yelling again. We have spoken with a lawyer about our options and they have counseled us that management has already defaulted on the contract due to their failure to provide a safe environment for us to live. Our legal counsel also mentioned to us that regardless of what the lease agreement says, if we give 60 days notice and the apartment is rented at the end of the 60 days, they cannot force us to pay for 2 months that we don't live there if someone else is already renting it, and that it would be illegal to collect 2 months rent from us for the remainder of the new agreement if there were new tenants already paying. Sixty days of rent for an early termination fee in addition to two months of rent at a place that we would no longer be living at anymore cannot be legally enforced. If there is any question regarding what I have stated in this message, please forward to my legal counsel, who I have chosen to get involved in this matter if necessary. I am happy to provide management with the contact information, but I honestly hope it does not come to that. We have paid every month and have done our part, but management has failed to secure the pool and common area after hours (people are jumping the fence or putting a rock in the gate to keep it open past 10 pm and security has not done anything about it), resulting in a default on their part.  I provided written notice, and according to the agreement, they are required to write back with an acceptance, and they did not do that. They require that all tenants live up to the agreement but fail to do so themselves. As far as I am concerned, and as far as my attorney can see, there is no agreement in effect at this point because of management's failure to act, not mine. Please feel free to rent the apartment to someone else.
