Dear Revdex.com: This letter is in response to a complaint submitted by [redacted] F. [redacted] to the Revdex.com on or about December 6, 2017 against Alliant National Title Insurance Company (“Alliant National”). We appreciate the opportunity to address Mr. [redacted] concerns....

Alliant National received a title claim on behalf of Mr. [redacted] in February 2017, in which it was informed that there was a prior outstanding Deed of Trust in favor of the Department of Housing and Urban Development (“HUD Loan”), which was not paid off at closing. Alliant National began its investigation of the claim, which included discussions with the closing agent and a review of the public records to determine the sequence of events and to confirm whether the HUD Loan was paid off at closing. In furtherance of its investigation, Alliant National contacted the Department of HUD directly in June 2017 in an attempt to determine what amounts remained owing on the HUD Loan. Alliant National was advised by the Department of HUD in late June 2017 that the loan had been transferred to the Department of Treasury for servicing, and that Alliant National would need to obtain written authorization from the debtors before the Department of Treasury could discuss the matter with Alliant National. Alliant National contacted debtors’ counsel and began working with debtors’ counsel in an effort to resolve the matter. In connection with its efforts to reach a resolution, Alliant National sent an inquiry to HUD in August 2017 requesting an updated payoff amount and an itemization of the payoff. In September 2017, Alliant National learned that the HUD Loan had again been transferred from the Department of Treasury to an entity named [redacted] Recovery, Inc. for collection of the debt. [redacted] Recovery, Inc. could not provide information concerning the HUD Loan to Alliant National because  it  was  not  authorized  by  the  debtors  to  do  so.  As  a  result,  Alliant  National  contacted debtors’ counsel and, with the assistance of debtors counsel, submitted an offer to pay off the HUD Loan in late October 2017.Alliant National advised Mr. [redacted] on November 2, 2017 of the status of the matter, including the difficulties that had arisen in obtaining information due to the transfer of the HUD Loan and privacy laws which prevented the agency from disclosing information related to the debt to Alliant National directly. Alliant National also informed Mr. [redacted] that an offer to resolve the debt had been submitted through [redacted] Recovery, Inc., and that Alliant Natioonal was awaiting a response.   Alliant  National  followed  up  with  debtors’  counsel  on  the  status  of  the  offer  on November 20, 2017 and November 30, 2017. Alliant National learned on December 5, 2017 that [redacted] Recovery, Inc. was transitioning to a new system, and although it had reviewed and considered the offer, it had been unable to submit the offer to the Department of Treasury until the transition to the new system was complete and that the process could take additional time. On December 5, 2017, Alliant National requested an updated payoff through the debtors’ counsel and was granted written authorization to discuss the debt with [redacted] Recovery, Inc. by the debtors. To avoid additional delay to Mr. [redacted], Alliant National submitted a check for the payoff  amount  to  the  Department  of  Treasury  on  December  15,  2017.   At  this  time,  Alliant National is awaiting a recorded release of the HUD lien. Alliant National has advised Mr. [redacted] of the status, and that it is awaiting a recorded release. We hope that this addresses the issues raised in Mr. [redacted] complaint. Dear Revdex.com:   This letter is in response to [redacted] F. [redacted] December 28, 2017 rejection of Alliant National Title Insurance Company’s (“Alliant National”) response to Mr. [redacted] complaint. Mr. [redacted] requested “official notification that the lien has been satisfied and a clear title is recorded with [redacted] County Recorder.”   As indicated in our prior correspondence dated December 19, 2017, Alliant National submitted a check for the payoff amount to the Department of Treasury on December 15, 2017 in full payment of the outstanding Deed of Trust in favor of the Department of Housing and Urban Development (“HUD Loan”). Alliant National has confirmed with the bank that the check cleared on December 20, 2017.   The release of the HUD Loan is processed and handled by the U.S. Department of HUD.  Alliant National has reached out to HUD in an effort to accelerate this matter.  In response, HUD provided the attached confirmation that it received “payment in full” of the HUD Loan, and additionally requested the release be processed as soon as possible and sent to Alliant National for recording.  A copy of the email from [redacted], Director of the Asset Recovery Division at HUD (redacted for confidentiality), is included in the response which is attached      Alliant National will continue to follow up with HUD and make every effort to ensure the release is processed and recorded with the [redacted] County Recorder’s Office as soon as possible.  Alliant National will provide Mr. [redacted] with a copy of the release as soon as it is received.   We hope that this satisfactorily addresses Mr. [redacted] concerns.  Please contact us at ###-###-#### or [redacted]@alliantnational.com with any questions.  Thank you.
