Initial Business Response /* (1000, 6, 2015/07/27) */
This response is being written in regards to one *** *** complaint, filed on 07/24/
In Mr.***s complaint he claims that Allstar Automotive refuses to honor our warranty, and further that not one, but two, of our
transmissionsAllstar Automotive respectfully disagrees with both claimsWith respect to his first claim, that we don't honor our warranty, the fact that we have already "honored" our warranty by sending Mr.*** an additional unit seems evidentWhat Mr*** has neglected to mention is that his vehicle exceeds the manufacturer's recommended usage, which in and of itself would void said warrantyWe here at Allstar chose to warranty this unit for Mr*** regardless of this fact, just in an effort to satisfy our agreementMr*** is also stating in his complaint that we should pay for the freight to return his unit for repair, again, this is beyond the scope of the warranty offered for any of our units that are shipped out of stateWith respect to the fact that the unit failed with such rapidity, Allstar's belief is that this is tantamount to an admission that Mr.***s vehicle does indeed exceed the manufacturer's suggested usageWhen we repaired the transmission that he sent back after "miles" it was discovered that the input shaft had been destroyed and nearly sheared inside the unitThese types of failures only occur when the vehicles exceed horsepower over stockIn our warranty it clearly states that such excess power and torque are not covered by said warranty
Our final response is to Mr.***s ridiculous offer to repair the transmission for him, at our expense, and then ship it to him, at our expense, all for the purposes of selling the unitThis is a solution that defies all good sense and reasonWhy we would repair a unit that Mr.***s has destroyed, not once, but twice, just so that he can sell it, now that he has done a manual conversion on the vehicle defies explanationAllstar *** respectfully decline said offer
Initial Consumer Rebuttal /* (3000, 9, 2015/08/07) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept this response from AllstarYes, they did fix the first transmission that failed and I had to pay to upgrade the shaft because the original shaft that broke in the 1st transmission was not a harden shaft and that is what should have been put in the original unit to begin withThe listing for the original unit that I bought from Allstar stated that the unit could handle up to XXX-XXX horsepower and my truck did not exceed that ratingI would not put a unit in my truck that was not within the power range of my truckThat would be silly on my part as every time it has failed I have had to pay for the transmission to be removed and reinstalled! The simple fact of the matter is that Allstar sells a product that can not handle the power range that they claim that it can! The first unit that failed they did pay for the shipping both ways and the repairs other than the upgraded shaft that I had to pay additional for them to installWhen the unit failed I was using the truck to haul my trailers that fall within the 17,gvw DOT rating and was well under the claimed horsepower range that Allstar claimed that the transmission was rated for in the item descriptionI still want the transmission fixed under the warranty that the transmission came with and there was no misuse of the unit by a vehicle that did not fall within their claimed "power guidelines"I feel that Allstar needs to honor their 3year/100,mile warranty that comes with the unit otherwise the warranty is not worth the paper that it is written on! It has been over a year since the transmission broke and I do not feel that I am being unreasonable in asking Allstar to fix the unit under their said warrantyIf I have to pay for shipping both ways I *** do so but I still feel that because of the rapidity at which the 2nd unit failed that they should pay for the shipping and repairs so that I can get the unit back and sell it to try to recoup some of my initial investment in an obviously sub-par built unitI paid $2,for the original unit, spent another several hundred dollars paying Allstar to upgrade a shaft that should have already been in the unit to withstand the power ratings that they advertise in the Ebay listing and also have had to pay to have the original unit installed, uninstalled, installed a 2nd time and uninstalled a 2nd timeI have another $2,just in installation and uninstallation costs on top of the original cost of the unit and the upgradeEither way this plays out I am going to lose a lot of money because of a situation that I have no control over but I need the unit fixed like it should be so that I can try to minimize my lossesThe ideal solution for this situation is that Allstar takes the transmission back, refunds my initial purchase price for the unit and the cost of the upgraded shaftI'm still losing a couple thousand dollars but that is better than losing the little over $5,that I have in this situation as of right now
Final Business Response /* (4000, 11, 2015/08/13) */
Allstar Automotive respectfully disagrees with the gentleman's claimsAs stated in our previous response, we know for certain, per our conversations with the gentleman, that he was generating more horsepower than he now claimsTo endlessly debate this premise is beyond reason, and Allstar *** not be bullied or tricked into making any admissions contrary to our previous position
Secondly, nowhere in our description on eBay is there any mention of "hardened input shafts" being included in our builds, it is not typically done for daily drivers, and if anything, this notion that it would be, or should be, demonstrates that this particular customer was well aware that his vehicle was generating and inordinate amount of horsepower
Thirdly, as stated previously, Allstar Automotive does not offer a warranty that covers labor and freight to out of state sales, for obvious reasons, namely, we have no control over the installation procedure and no recourse for problematic or inexperienced mechanics installing our unitsHad the gentleman had the transmission installed here at our state of the art facility, we would have been more than happy to have covered all labor for the unit
And finally, Allstar Automotive does indeed sympathize with this gentleman, and we think it a terrible misfortune that he has destroyed yet another transmission through abuse, and we would like to help him in any way possibleHowever, we would not be able to reasonably exist as a small business if we doled out free product to every customer that misused and abused an item, and then expected us to fix it with no monetary compensationThat is the truly "silly" expectation of this gentleman
