Now that it
is clear to me which instance/vehicle this matter is in regards to, I am more
than happy to give you any information in which would be helpful to clear this
matter.  It is my hope that this can all
be taken care of in a way that is both suited to Ms. [redacted] and Allstar Towing.
I have yet
to see any of the pictures, documentation or the recordings that were made by
Mr. [redacted] of damage that may have occurred to the 2002 Pontiac Grand Prix.
This vehicle was removed from private property for being parked illegally as
posted by signs in the parking lot.  Mr.
[redacted] claims that the car was improperly towed due to the wheels being locked.
Vehicles are towed everyday with the wheels in the locked position for various
reasons. To avoid any damage to a vehicle skates are used. These are small
plastic pieces that help slide the vehicle on and off the bed of the tow truck
without damage.  All of our drivers are
experienced in using these tools as well as other techniques to tow vehicles.
As policy,
when damage does occur to a vehicle, we would direct them to our insurance
carrier to make a claim.  Mr. [redacted] nor
Ms. [redacted] have called for this information, they seem more interested in
trying to file complaints with various organizations then having the repair
completed.
I understand
that having your vehicle towed is not a pleasant situation. However, the
“strong arm tactics” that were mentioned are outlandish.  When Mr. [redacted] and Ms. [redacted] came to
retrieve her vehicle they were already upset and combative. They refused to
sign the damage waiver section of the invoice without knowing that the vehicle
was not damaged.  We offered to have them
go inspect the vehicle but they adamantly declined to do so.  At this time, they left the office to call
the [redacted], which did not respond by closing time.  The MPD has not made any contact with Allstar
regarding this matter.  Before our office
closed for the business day Ms. [redacted] stated she would sign the damage waiver
but under protest and paid the impound fees. Her car was immediately released
to her.
Allstar
Towing is willing to do what we can do to right the damages that may have
occurred to the vehicle as the insurance adjuster sees fit.   I understand that this situation could have
happened differently and that Mr. [redacted] and Ms. [redacted] are upset about how
they feel they were treated and I apologize for that. But threatening to bring
local media, The City of Milwaukee and any other organizations to the table is
unnecessary. The matter of damage can be resolved with our insurance company.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below
[To assist us in bringing this matter to a close, we would like to know your view on the matter.]                                    ... The reference to filing a claim with the insurance carrier from ALL STAR is welcome, and we will accept any information as such to initiate the process. The rest of the response contains too many lies and misrepresentations of fact to be accepted. First, it was ALL STAR'S own employee who told me that filing complaints with WI Revdex.com and DATCAP was "the best thing to do" when I informed him that this was going to happen. As with all else spoken by this person, he should have considered his comment more carefully, as his wish has been obliged. This is the same obnoxious, mouthy and foolish person who has been mentioned in earlier comments. Second, ALL STAR fails to understand that I have 15+years of background in the towing business that began in 1988, prior to the establishment of their company and covers more time than they have been in business. (we were making "skates" out of steel before they were made of nylon, and I was one of the first persons in SE WI to use the nylon version before they were sold publicy in 1996) Thirdly, The worst part is the statement that says we were "upset and combative" upon arrival. I have the audio recording of the visit, and ALL STAR has video recording that would go as absolute contradiction of such a statement. I suggest they learn the difference between "dispute" or "argue", and "combative", apparently they are not able to handle those who challenge unethical practices such as holding private property to extort damage release signatures. Which also by the way, increases the scope of liability that ALL STAR must assume, this is according to a legal consultant to State Rep Steven Nass with whom I have had a lengthy conversation with on all aspects of this situation, and is intimately familiar with all of the laws that relate to the situation and the private property vehicle removal laws. Fourth, I did not decline to inspect the vehicle, I informed the obnoxious, mouthy, foolish employee upon inspection of the vehicle that I was going to tell the owner (Dawn Beyer) not to sign the damage waiver because of the way the vehicle was handled and that it would be impossible to determine the existence or absence of any damage without hoisting for thorough inspection (which no insurance carrier would allow a vehicle owner on a storage lot to do) and driving the vehicle on a road test. Again, I have the audio recording of this exchange. I can provide the pictures of the damages (broken right front sway bar end, collapsed power steering cooler line, and fresh pavement gouges on lower fascia) and the repair assessment of $1,273.80 by a local dealer as needed. These are all common results and damages from mishandling vehicles while dragging them up rollback carriers and unloading them carlessly, and anyone in the towing industry for any length of time knows it. We have made no contest or dispute about the circumstances for which the vehicle was removed from the parking lot of O'Reilly Auto Parts near 60th and Oklahoma in Milwaukee. As mentioned prior, this type of action does not permit a towing company to negligently damage vehicles, nor does it permit a towing company to extort damage waiver signatures by refusing to release a vehicle to an owner because they decline to sign such a waiver. The most troubling aspect of such action is that the waiver does not protect the company from negligence or damage/losses resulting thereof, and anyone in the towing business for a length of time knows it. Attention to these abuses is higher at present because of the number of complaints of such abuses sharply increasing after enactment of the newer private property removal laws, as per the aforementioned discussions with State Rep Nass's office, so it is not an isolated problem. It was made clear to me that the situation would lead to leglislative corrective action if it worsens and goes on long enough. To Katie Orlando of ALL STAR, the heavy handed actions of the company and the demeanor of your employee made it painfully clear that both are accustomed to acting they way they do, these choices on behalf of ALL STAR put the company in this position. The actions effectively removed any courtesy you might have gotten from us by dealing with us directly since there was no interest or effort on the part of the employee to act amicably. The employee refused to listen and take us seriously, and no management intervened to address the problem. The situation is now worsened by the fact that you think nothing of lying in your statements, consider this our last effort for a resolution, and your last chance to correct your falsified statements before it becomes a matter in civil court proceedings, then we could initiate efforts to resolve the matter through the insurance carrier.  Regards,
[redacted], Rep [redacted]

Review: Company refused to allow removal of a towed and stored vehicle despite being paid in full for charges because owner refused to sign a damage liability release for the company. The vehicle was mishandled (dragged on a flatbed truck with wheels locked) and needed to be taken to a repair facility to be properly hoisted and inspected for damage. Police were called but failed to arrive prior to the business closing time for complaint filing by owner, owner was forced to sign a damage waiver in order to remove the vehicle so as not to add additional charges, and merely note the objection. Damage was later found and photographed that evening when the vehicle was hoisted for inspection. Vehicle owner had photocopies taken by business of vehicle title and insurance cards for company retention as a. "Policy", one need not point out the numerous privacy issues arriving from such practices. The time of pickup was not noted on the receipt from the business . This is considered crucia information within the towing industry. Company representative was mouthy and arrogant , also made foolish and false statements. Company rep on the phone failed to inform owner of needed or required documentation on the phone when the owner called in advance, also considered an industry standard. I have extensive backround in the industry and Allstar Towing is a classic example of the worst conduct and practices within.Desired Settlement: Allstar Towing must cover the repairs and related expenses, compensate for the privacy violations and "hold the car for ransom " waiver practices and apologize in written form for all of it. This matter is being persued in civil litigation, and with all entities that provide the company liscensing for it on a governmental level for it to operate. Thus far, those we have spoken with are in agreement with our position. O 'Reilly Auto Parts who ordered the towing company to remove the vehicle is also going to be subject to complaint and scrutiny as result of Allstar Towing 's misdeeds.

Response:

This company's rates are ridiculous, and the service was awful. The total cost of them towing my car was $350. A $225 towing fee (The city charges $120 for the exact same service), a processing fee of $25, and $80 per day for storage. Some people don't even make $80 per day, so how would they ever get their car back. Not only that, but when I went to pick up my car which was locked when I left it, the door was ajar, my dashboard ripped apart, and my radio stolen. Completely unacceptable service. Now my 4x4 does not work properly because they ripped the wiring apart and I have no radio! When I confronted them about this they claimed the truck was locked and they couldn't get in. So then it happened in their "secure" storage area that they charge $80 for, but won't accept any liability for damages. When I asked to see the security footage of the parking lot, they said it didn't cover the area my vehicle was parked in. How perfectly convenient for them. All in all I would never ever recommend this place, and if you need to have a car towed, please just use the city of Milwaukee's services, at least they are reputable unlike this All Star Towing company.

Review: I called Allstar Towing to jump a vehicle that had a dead battery. When the employee arrived he attached the cables to the battery but in the wrong location, switching positive and negative terminals . This caused the battery to spark and subsequently blow a fuse in my radio. I then had to take my vehicle to another mechanic to fix the fuse and was charged an additional $120.00. Allstar towing told me that I could not prove that their employee blew the fuse and they would only refund me $60. At this point I had already spent $60 for the jump plus the $120 to fix the fuse. I wanted a complete refund of the $120 I was required to spend due to their improper service with the jump. After a few minutes of arguing the Allstar employee at the counter walked away and said " I look forward to hearing from your lawyer".Desired Settlement: A refund of $60 to cover the $120 I was required to spend due to their improper service.

Business

Response:

The customer did come in stating that his fuse was blown due to our jump start procedure. We asked him how do we know it wasn't already blown. He stated to us that is was not. So we called [redacted] where he went and had it repaired. I spoke with the service manager and asked if there was a way he could tell us if we did the damage. He replied there is no way to know if the damage was done before we (All Star) worked on it. We explained that to the customer and agreed with him to cover half the repair costs which were $120 and gave him $60. Attached with this email is a Release From Further Damage Letter that he signed stating it was resolved with the $60 payment. I do not understand why he filed this claim. It was all taken care of when he left our office.

Consumer

Response:

While I accept the fact that I signed the Release From Further Damage form, I would still like everyone to be aware of the service provided by this company. They damaged my vehicle and were not willing to take responsibility for their actions. I could not "prove" their mistake and therefore I was the one who ended up paying in the end.
