11/1/2013: Opened a homeowners insurance policy with this company for our new home. Then on, November 12, 2013 I got a letter claiming that AllState was not able to carry that type of homeowners insurance because we bought a house from an owner and not a bank. The policy was to be cancelled on 12/12/2013, but I cancelled the policy on 11/12/2013 because I did not want to be rushed.

I was told I could not cancel until there was another insurance. My new insurance company called them, and told them I was covered. I paid them $207 for the month, and was only returned $111. They told me there were fee's for the 14 days of service (which is fine), paper fee's, and an inspection. I have no idea or recollection of them inspecting my house. I never saw anyone, or gave them permission to enter my house.

Regarding the issues of [redacted] as noticed on January 30 2014 in complaint #[redacted]: The complaint is the result of the handling of an insurance issue between the complainant and Mark A Williams in his capacity as insurance broker in a transaction between [redacted] and Pacific Specialty Insurance Company.

The facts of the matter are that [redacted] submitted an application with Pacific Specialty Insurance Company for home owners insurance: 1. The application, signed by the complainant, specifies that the fees for the policy include a non-refundable inspection fee as a part of the application for insurance.

2. The application for insurance was declined by the insurance company and the premium for insurance was refunded, however, the $70.00 non-refundable fee was retained by Pacific Specialty Insurance Company.

3. Mark Williams, in his capacity as broker, had no control or direction over the funds retained by Pacific Specialty Insurance Company.

4. Williams staff requested that the company refund the fee's, however the company referred to the signed contract stipulating the non-refundable fees.

5. Mark Williams, was not advised nor aware of this situation prior to the notice from the BBC. Prior to the notice, the licensed agent in the office whom was handling the insurance issue with the complainant was of the belief that this was a closed matter.

Mark Williams effected his retirement from the Insurance Agency on January 1, 2014. Gary Short has assumed the operation of the Mark Williams Agency on William retirement date. Short did not assume any liability in the transition between Williams and Short_ Short was notified of the issue on January 30, 2014 via correspondence to Williams received on that date. Short investigated and discovered the following:

1. The insurance application was rejected by Pacific Specialty Insurance due to the First Mortgagee being an individual (not a banking institution).

2. The application states that the portion of the fees which are non-refundable.
