On April 16, 2014, K [redacted] entered an agreement with Allstate Pools to develop plans for a swimming pool at Canby, Northridge, CAfor the sum of $(Non-fundable Check # 1009, dated 4/16/14, for design for plan) On May 9, 2014, Jay N [redacted] paid a visit to K [redacted] ’s residence and presented the plans and computer generated pictures of their swimming pool designed by a computer technician MrN [redacted] also presented a proposal for the amount of $49, K [redacted] wanted to change the beach front On or about 5/13/we sent an email with the attached pictures of the poo design with the change MrN [redacted] left several messages with K [redacted] , but never heard for them until Aug30, 2014, when he received an email stating that they never received the pictures MrN [redacted] resent them another email with the attached pictures On Sept.13, 2014, K [redacted] sent an email attaching swimming pictures “I look forward to seeing what a $29K free-form pool with Balooks like” MrN [redacted] had the computer technician develop a new plan and sent them the new plan MrN [redacted] called several time and on 10/13/the K [redacted] sent an email message stating “I received your voice mail and wanted to thank you for your efforts We have decided to go with another pool company that fits our needs” K [redacted] is now asking for a refund No refunds is due to the K [redacted] , as we provided several designs and fulfilled our agreement D [redacted] Allstate Pools & Spas

This our response in
order of complaints:

MrB*** did negotiate the price for three
months as he finely explained before the third and final plan was finished,
that his budget was $130,for the pool project We designed a pool that cost $125,

Regarding the spillway bowels, they were not
plastic, but made of granite like resin.
The bowels were not what Allstate expected and they were removed from
the job site. Allstate installed two faux
boulders with copper scupper MrB*** was very happy according to his
text. This costs Allstate three time the
cost of water bowelsWhy MrB*** complained about this item is very confusing
to Allstate Pools

Regarding the excess time building of the pool The permits took months, due to MrB*** removing
tree (most of them were on the neighbor’s property) without getting approval
from the City of Glendora and next door neighbor. We started the pool excavation, plumbing, steel,
gunite, coping and faux grotto in workman like manor, however, MrB*** wanted
to install paver decking in the front of his house. We were waiting for his decision and finely
He decided to change the decking completely
to a special stamped concrete. He also,
wanted a plan for landscaping, in which, our associate R*** *** spent a
month and a half creating 3D designs and a Video. MrB*** finally approved the plan on May
30, 2015. Allstate completed all the
decking and landscaping After a week
delay because Mrhad not completed his fence and gate requirements, we plaster
the pool on Aug15, 2015. MrB***
never complained about the time it took to complete the project. I receive a text from MrB*** “Oh wow just
got homeAwwwwwesome!!!!!” He also text
“So peaceful back here Make the last
year of struggle all worthwhile.”

Regarding payment for permits. This stated in Pool, Spa GrottoProposal. It clearly states under Permits the
following: “Expediter fees and city fee not included” MrB*** furnish all
checks to the building department and paid the expediter without any complaint

Regarding the tile. Mr B***
choose the tile from the Universal Tile book.
The tile was delivered to the job site.
While setting on the job site it rained and ruin all the boxes. MrB*** thought that the rain ruin the
tile; however, rain cannot ruin tile, because rain and pool water are always touching
the tileAllstate warranties the tile for years. Allstate has installed tile in over 4,
pools and never observed any damage by rain water. Why would we put in tile that could be damage
by water? We gave MrB*** credit for
the tile he purchase and removed the old tile from the job site. Allstate could not get their money refunded from
the supplier, because the boxes were damage

Regarding the controller to be installed on his
iPhone. This item was not written in the
contract. MrB*** stated this was promised
by Jay NudelmanI do not know if this is true or notHowever, Allstate worked
this out with MrB***, that he will pay for the device and Allstate will pay
for insulation

Allstate includes days of stservice to
make sure if there is any issues with the project MrB*** complained about one jet and one
bubbler was not working. These items
were already repaired. R*** ***
met with MrB*** and when over every item on the pool and landscaping. The certified pool Startup man will explain
how the pool works and program his iPhone

Allstate never received any complaints from Mr
B***’s neighbor. According to Richard
Babcock, the neighbor only complaint was about MrB*** putting plants on her
property, but Allstate was never rude to her

I am rejecting this response because:
The plans sent on 5/13/14 was a design created by N[redacted] that was a basic kidney shape pool with a spa (nothing like the lagoon style pool we requested).  N[redacted] and I spoke a few times between 5/13/14 and 5/31/14, then I went out of the state.  Upon returning around 7/1/14, I contacted N[redacted] again to request an update on the pool plans and was told N[redacted] was still working on it.  It wasn't until 8/30/14 that N[redacted] sent an email with the same plans he originally sent to us on 5/13/14 (NO CHANGES WERE MADE).  The attached email Wisby references was sent by me to N[redacted] on 9/4/14 and started with the following...
"Thank you for sending, although it doesn't seem right.  A Baja ledge was added on the right side with stairs coming off the corners, and there was supposed to be a seating area to the back left by taking coping away to make way for a planter near the spa.  Also want to confirm that there is NO beach entry."
The above passage clearly indicates that NO CHANGES WERE MADE to the revised plans that were sent.  I sent another email to N[redacted] on 9/13/14 with additional pictures of what we wanted following a conversation between us earlier in the week to ensure I got my point across regarding the pool design.  I followed up a few times by phone with no responses and then gave up.  N[redacted] finally called me on 10/13/14 and left a voicemail.  I responded same day via email message stating “I received your voice mail and wanted to thank you for your efforts. We have decided to go with another pool company that fits our needs.”
Wisby/N[redacted] maintain that they revised the pool plans but no revisions were ever received other than the plans first presented on 5/13/14.  No work was performed which warranted a $1500 cost, therefore, I request a refund.

Review: Signed a contract to construct a pool dated November 2014 with Alstate Pools. Met sales rep named J[redacted]. Contract was for $125K and didn't haggle at all on the price. Now the pool is complete minus a few repairs needed (so guess not complete). Had multiple issues with this contractor: 1. Sales rep included in the pool 2 spillway bowls that flow into the pool. They delivered them to my house and to my surprise they were PLASTIC! Yes $125k pool and I get sent plastic water bowls. After calling J[redacted] his words were "oh no those are the best bowls money can buy." His exact words!2. Pool hole was dug in February 2015. From dig to finish was 7 months vs 3 months stated on the contract.3. Per the contract permits were suppose to be paid by contractor. They were not, I paid them.4. During the months of no work the tile for the edging was left in it exposed. It was rained on multiple times to the point of almost disintegrating the boxes they were in. Before they were installed we decided to go to a tile store to see if there was a nicer tile. To our amazement we found that not only was the tile provided the cheapest on the market but it cannot be installed if it gets rained on. So out of our pocket we purchased brand new tile. When I brought this up to Dennis, the owner, he stated that it wasn't his fault it was left in the rain and that it CAN be installed anyway. Scary for someone that has done pools for years and didn't know you can't install tile that has been rained on. Makes me wonder how many pools they have done incorrectly. They would have done mine if I didn't catch it.5. I made it clear to J[redacted] from the very beginning that I wanted to control the pool from my phone. He assured me it would get done. Not only has it not been done but when I called and asked Dennis about it his response was, "Show me where it says that in the contract." Its sad to see sales people over promise and under deliver. No one bothered to do a final inspection with me to make sure everything works.Guess this is one of those contractors you have to be careful with and make sure you read every word. They will try and cut corners and save cost at the expense of your pool! I will be going over the contract word for word with an attorney now and I will be pursuing them for everything that is incorrect.Desired Settlement: Unfortunately this will never be a good experience. The least they can do is finish what they promised. I will give them that opportunity before pursuing any further.

Review: Responding to an advertisement for a $29k pool, I requested a lagoon style design. What was given was a basic kidney shaped pool, and I was told that in order to make any further changes, I needed to pay a $1500 deposit. I paid the deposit, and since then had not received any further changes to pool design even though the person I was dealing with, J[redacted] kept saying he was making changes. JJ then stopped communicating with me entirely, and to this day I have no plans, not even the original. When I tried to resolve directly with owner D[redacted], he stated that I owed them more money for the additional changes and they were going to collect on it.Desired Settlement: Allstate has not provided any output (plans, etc.), therefore, I am requesting a full refund on my deposit.
