REPLY TO RESPONSE
(1) I have not received a phone call from respondent nor a reply to my letter until now.
(2) Before filing my complaint, I consulted another wheelchair technician at Bischoffs Medical & Mobility to have the batteries tested when they were only a few weeks old. He advised me that the problem was my batteries. I consulted the technician after calling the Interstate Battery Manufacture/Distributor in Texas, who advised me to have the batteries tested.
(3) A copy of my receipt and a copy of the battery information that was placed in my chair is attached and labeled 1 and 2.
WARRANTY OF BATTERIES
(4) [redacted] refused to give me the warranty papers to the battery. I called the Interstate distributor in Texas and discovered that the batteries have a one-year warranty. I got the written warranty off the internet. (See attachment #3) .
(5) After I purchased the battery set from Allure, [redacted], the technician, told me that it was charged 80% and would carry me about five blocks. I am informed that all new batteries should be charge 100%. before using them. (See attachment #4).
.AGE OF WHEELCHAIR
(6) The age of my wheelchair has nothing to do with the power of the battery. I purchased the chair from Hometown Medical Supplies, 75 Phelan Street, San Jose, CA, XXX-XXX-XXX, and it was in good condition. It appeared to have been only slightly used. However, It had a problem with the seat, which needs a screw in it, according to[redacted] at Allure. Also, the batteries in the chair when I purchased it from Hometown had been replaced by Hometown in May, 2012. The batteries were not very good and did not last long. They were probably very old batteries when they were placed in the wheelchair by Hometown. I was forced to purchase a battery set from Allure.
(7) Prior to purchasing the wheelchair from Hometown, I had a used wheelchair over five years old donated to me, and it had good batteries in it. I could run the wheelchair many miles before recharging the batteries.
(8) The manual to my wheelchair does not indicate that new batteries in an old chair would power the wheelchair to run less than 12 miles. As a matter of fact, the Interstate manufacture/distributor in Texas told me that the new battery set was designed to power my chair to travel the distance specified in the wheelchair manual.(See Attachment #5) In its response, Allure stated that overtime with use, power chairs become less efficient and draw more power from the batteries and the same battery will last fewer hours on an old power chair than a new one. (See paragraph 4 of his response.) In this case before the Revdex.com, I am concerned about lots of hours being lost by the batteries
(9) A friend of mines, who visits the Salvation Army in San Jose, CA, has a wheelchair, which was donated to him by the Salvation army, and it is an old chair. The Army purchased a battery set for the chair. He can run his chair for many miles without having to charge the batteries. I am the only person who has to power a wheelchair while visiting the Salvation army for lunch. The other five people using wheelchairs don't have to power their chairs while visiting the Salvation Army, and they have old chairs. I asked the Salvation Army to purchase a battery set for me because I got tired of Allure changing the battery set that don't offer proper service. I didn't get any assistance from the Army.
THE INTERSTATE BATTERY IS NOT DESIGNED FO MY WHEELCHAIR
(10) Interstate Battery Company does not sell a battery that fits my Pronto M51 wheelchair. The DCM0035 battery which was placed in my wheelchair does not fit it. A list of the type of wheelchairs that interstate battery, DCM 0035 fits is listed in (Attachment #6.)
(11) According to the wheelchair manual for Invacare Pronto M51, an incorrect size battery could damaged the chair. (See Attachment #7).
(12) The respondent refers to page 12 of the Invacare Pronto 51 manual. Page 12 does not list any type of battery that fits the chair. (A copy of page 12 is Attached as #8)
CONCLUSION
(13) I prefer to do business with someone else. During my last visit to Allure,[redacted] had his secretary to ask me to compensate $30 to replace the battery set.[redacted] charged me for installing the first set of batteries, and I am very tired of him making a fool out of me. Presently, I cannot drive the chair over four blocks without having to recharge the batteries. I would like to be compensated $267.98 as soon as possible so I can purchase another battery set.

The customer did not return the batteries. She called a couple of weeks ago and made an appointment but she never showed up. For any warranty issues, the product has to be returned to us so we can resolve the issue. Unfortunately, at this point the warranty has expired and therefore, we cannot take the batteries back. We value our customer's satisfaction. Even though the batteries are no longer under warranty and we do not have any liabilities, we offer a complimentary amount of $100.00 to the customer only if that makes her completely satisfied with this transaction. This offer is valid only if the customer replies back to us in writing before December 30th, 2015 and accepts this offer. The reply must also include an address where the check should be mailed to.

Due to inability to access internet to view my e-mail, I never responded to the dealers late response which was not timely filed. The warranty was good for one year and I took the initial battery back to the dealer before one year. He kept exchanging batteries on two occasions. The Revdex.com had closed the case regarding the issue and advised me that I could sue if I was not satisfied. The dealer refused to compensate me and told me that he had to make a determination regarding the batteries. I decided to allow a judge to make the determination regarding the batteries. Therefore, I plan to file a case in small claims court very soon. I have purchased new batteries for my chair. Also, I discovered that the replacement batteries that Allure placed in my chair were not the same type of batteries that the initial batteries were.
