Review: I hired [redacted] from ALM Leak Detection LLC to repair a leak in my pool liner. [redacted] came to my house on 6/**/2013 and made the repair. He was responsive to my calls and very prompt in arriving to make the fix. One month later the repair that was made gave out. I called [redacted] on 7/**/2013 and he came back to my house that day to look at the problem. On that day, he informed my wife, who was at home at the time, that the leak was unfixable, even though he had come to my house one month earlier, repaired the leak and accepted payment for the repair. I called [redacted] on 7/**/2013 and left him a frustrated voicemail indicating my confusion and displeasure that a leak he willingly fixed on month prior was now unfixable, and indicated that I wanted to discuss a refund. [redacted] called me back the next day. On that call, he yelled at me repeatedly, did not allow me to speak, told me the leak was my fault problem and not his (the liner was old and unfixable), then hung up on me. When I called back, he answered with "Why the hell are you calling me again?", proceeded to yell at me again that it was my problem and there was nothing he would do about it, then yelled over and over (about 8 times) "what else do you want me to tell you?" "what else do you want me to tell you?" then hung up, again.Desired Settlement: I would like a refund for the $432.00 of pool liner repair services that [redacted] provided. I understand that leaks may re-occur. The issue I have is the lack of guarantee of this work. If the leak was unfixable, as he is arguing now, then [redacted] should have told me that upfront and never put in a repair, and I should not have been charged $432.00 for a pool liner repair.

I am responding to this complaint initiated by [redacted] who resides at [redacted]

I was hired by [redacted] to and repair a leak in his in ground swimming pool. I gather as much information on regarding

the pool prior to my being dispatched to assess the situation.

Through [redacted]'s admission, he purchased this home earlier this year. **. [redacted] also admi ed to not knowing

much about the pool when he purchased the home prior to closing and subsequently moving in.

[redacted] did in fact call me with regards to the pool losing water. When I asked him the age of the overall pool he did

not know any information on regarding its builder, the age of the pool, or the age of the liner. This helps me assist in

gathering information regarding the pool PRIOR to going out.

When I arrived at [redacted]'s home address listed above I noted the liner to be "bleached" This condition occurs when

the pool liner degrades over years, oxidizes, and loses its city. This liner was extremely bleached. I would estimate

this liner to be at least 10 years old. Most liners today get between 8-12 years average life expectancy on the liner,

depending on care of the owner(s).

A large 24 inch cut was noted at the seam of the liner. The seam is where two pieces of vinyl are fused together to join.

This seam "failed" that is, did not hold up due to its age. I explained to **. [redacted] who joined in me in the back yard PRIOR

to any servicing that this was in fact bad damage to the liner, and in fact if any repair was to be made there would be no

guarantee due to the fact of the age and severity of the leak. I informed him I was in sense, "buying him me" un I he could

replace the liner which was needed to be done. He agree to have me do a wide variety of services to the pool, due to his lack

of knowledge of the pool. Additional services included pressure testing the pool plumbing to and any hidden underground leaks.

[redacted] disputes the charges of $432.00. [redacted] agreed to full servicing the pool in order to gather as much information

as possible to assist him in making an informed decision regarding his pool. [redacted] simply see only a vinyl repair at $432.00.

Allow me to itemize the charges.

$100.00 Service call fee. This gets equipment, manpower, equipment on site to make the repair. Pays for tolls,

gasoline, wear and tear on the vehicle, vehicle registra on and insurance.

$150.00 for pressure testing the pool plumbing.

$100.00 for the underwater dive and inspection of not only the noticeable leak below the stairs, but inspection

of the liner to gather as much information as to the condition on of the liner.

$50.00 for the repair for materials and adhesives.

$32.00 NYS sales tax

Total $432.00

ALM Leak Delee on provided [redacted] with as much information possible prior to initiating any work performed

on the pool. Should [redacted] of utilized a pool inspection service, the condition of the pool would have been revealed

prior to the closing of the house and his purchase of a pool with a liner in poor condition. ALM made every attempt to

delay **. [redacted] in purchasing a new liner. However. The pool seam continues to fail. Liner replacement is inevitable at

this point. A liner in this state cannot be repaired with a longer las ng outcome ..other than liner replacement.

I did go to [redacted] house immediately after he called me at NO CHARGE to look at the state of the failure. I did

communicate with his wife directly, rang the door bell and she answered. I told her my endings. She responded

with "we both knew we would probably have to replace the liner" She thanked me for coming out at no charge.

ALM Leak Detection regrets [redacted]'s decision to purchasing the house without gaining more information regarding the

pool with a pool inspection service. This pool liner was repaired with the explicit understanding by both pares that it was

in fact a temporary x, no warranty implied or expressed. And that liner replacement was inevitable. We dispute the full

refund price of $432.00 due to the fact that other services were provided to [redacted], not simply a repaired that did in

fact hold. But the liner underneath the repair continues to fail.

To respond to [redacted]s Claims. First, I did have the information needed in order to give the consumer all the information regarding his aged liner that he purchased without prior inspection. Having been in the swimming pool profession for 8 years now. I immediately noticed the liners advanced age and seam failure without entrance into the pool. Yes indeed [redacted] is correct as I informed him the leak was rather complex and the liner should be replaced immediately. [redacted] made the decision to repair the liner, as it was not the preferred opinion of ALM Leak Detection to make such a repair. However, **. [redacted] specifically directed ALM Leak Detection LLC to make the repair.

**. [redacted] definition of "temporary" greatly differs from the Websters Dictionary as "no time specified". In my eight years of being a swimming pool professional I have never guaranteed or warrantied such aged liners with a liner that I know would continue to fail. I also deny affording any time period specified by [redacted]'s claim of this repair lasting several months as he claims. I ask [redacted], Is there a written warranty documenting this repair would last in the time specified by him? There was no implied amount of time agreed upon by ALM Leak Detection LLC or [redacted], oral or written. [redacted] further claim on providing the original invoice and year the builder installed the liner is not necessary. Installation date is not required as the advanced aging of the liner due to poor care of its previous owner was visibly noted.

[redacted] was afforded all the information prior to the repair in order to provide him with the highest level of customer service in his own making a decision what he was to do with this aged liner, repair vs replace. [redacted] decided to attempt a repair as a new liner install would be in excess of $4000.00 andmay take months to install depending on a pool companies availability. [redacted] needs to assume full responsibility for his choice in repairing the liner, It was his preferred course of action given all the facts regarding his situaiton.

The refund of $432.00 by [redacted] will not be entertained. [redacted] was given the pros and cons of repairing this particular aged liner before the repair was made. In addition, Other services were also performed which [redacted] has not disputed or brought attention to in any of this or previous correspondence. That list of charges was itemized and provided to [redacted] and the Revdex.com in my previous response.

Once again. [redacted] needs to take full responsibility of this aged liners continued seam failure. The patch held. However, the seam continues to fail next to the liner. [redacted] was afforded the option to repair vs replace. [redacted] agreed to make the repair with no warranty implied. [redacted] knew liner replacement was going to be expensive. [redacted]s wife even agreed that the liner needed to be replaced. [redacted] also understood the day of service a repair would last with no time period specified as being temporary until a longer term solution of replacing the liner could be afforded by him.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

My complaint has not been resolved because [redacted] and ALM Leak Detection have made no efforts to correct the situation. I continue to be disappointed by the lack of accountability that he shows for the work that he performed, despite documenting in prior responses that liner was unfixable, and that he lacked necessary information to make the repair. In addition, he continues to demonstrate the poor, rude customer service that he exhibited when I first approached him with my concern about the overall quality of his work.

[redacted] continues to deny my requests to refund the money for the services that he performed. Since he will not entertain the full refund that I have requested, I would like to know what [redacted] is willing to do to correct the situation.

your liner was oxidized, aged, and beyond the point of repair. YOU agreed to allowing me to make the repair with the understanding that I was only slowing your water loss down temporarily . A liner replacement was needed sooner than later. you did not use a pool inspection service. should you have, the problem would of been identified BEFORE your purchase of the home. The leak was there prior to your contacting me. I didn't create the leak or the problem. Your particular issue was beyond repair at that point and a temporary solution was made available to you until you could purchase a new liner. A full refund is not going to be issued.. You had other services performed, Such a pressure testing of the pool plumbing and a service charge to bring the truck out. YOU UNDERSTOOD that the fix I was providing was in fact TEMPORARY. YOU ALSO KNEW that the liner was beyond repair and needed to be replaced the day I came out to your pool I was detailed in my findings and you understood the severity of the leak and its not being able to be repaired due to the age of the liner and its poor maintenance by the prior owner Yes you got bad news.. your liner needed replacement you didn't have the pool Inspected prior to your purchasing it. You expect service providers to come out to your house, perform work you want done, and find out that something needs to be replaced, don't like what you hear, and you want us to do it for free. next time you buy a home. have the pool Inspected.. I wasn't the bad guy here. the prior pool owners were in their poor care of the liner.. you yourself are to blame for not having the pool inspected prior to buying it to find potential problems that could affect the offering price. I provided the services I agreed to do.. and by the way... even though I ask a lot of questions before going to a pool, that doesn't suffice until I get into the pool to actually see whats going on. its called a inspection and I cant inspect your pool over the phone.
