Initial Business Response / [redacted] (1000, 12, 2016/11/30) */ Dear [redacted] of Northern Indiana 11-28- Case#XXXXXXXX [redacted] came to One On One Fitness on 04-15-asking for pricing and literature on the PHYSIOSTEP brand of recumbent ellipticals [redacted] then returned, having researched the product literature, on 4/22/and purchased the PHYSIOSTEP MDX [redacted] was informed of our sales policy and shown our displayed NO RETURNS POLICY, additionally our NO RETURNS POLICY is printed on the sales receipt she signed to complete the purchase [redacted] 's remarks at the time of sale that it was the perfect choice for her because the seat swiveled, and out of the three available choices, it was the only one that performed the swivel seat function One On One Fitness received the ordered Physiostep MDX on 05/06/and inspected the unit for damagesThe unit's carton was in great condition which warranted no further inspection at that timeComplete product inspections are performed during delivery On 05/06/ [redacted] and [redacted] both spoke directly with [redacted] and agreed upon 05/11/between am and am for their deliveryBoth [redacted] and [redacted] performed the delivery at 10:amThe delivery was successful, the unit passed on-site assembly inspection by both TechniciansThe unit was assembled in the living room, and both [redacted] , and [redacted] were trained on the unit by [redacted] for hr that even included nutritional advice and training intervals and intensity [redacted] remarked at the time he needed no further training, as he very motivated and required no additional assistanceRemoval of packaging is offered to our customers but is not requiredWoodkas were not interested in the packaging materials and the container was removed and disposed ofThe delivery team left the home and the [redacted] 's were satisfied On 06/09/ [redacted] called One On One Fitness and spoke with [redacted] asked [redacted] if she could trade her Physiostep MDX in for the NEWLY RELEASED Physiostep LTXA model that was not advertised or available at the time of Mrs [redacted] 's original purchase [redacted] explained that One On One Fitness does not take trade-ins on equipment [redacted] then asked if we could consignment sale her Physiostep MDX [redacted] told her the corporation does not allow consignment and we do not have the Showroom floor space for used units [redacted] then demanded an exception to return the unit for her money back [redacted] reminded her of the No Return Policy on all Fitness Items, and Special Order Merchandise On 06-11-the accounting department was notified my PNC, the corporation's bank, that a formal chargeback had been filed by the [redacted] 's and the funds for their purchase were removed from One On One's bank account pending sale documentation review by MERCHANT SERVICESThe formal charge made by the Woodkas to their credit card company was that the product purchased was never deliveredAll documentation was submitted to PNC's Merchant ServicesMerchant Services than presented our documents to the Woodkas credit card company and the Woodkas fraudulent claim was instantly overtuned and the funds we're returned to One On One's Corporate bank account immediately the following day Mrs [redacted] would have you believe that she had an active involvement in the funds being released back into the corporate accountThis simply is not true The next contact with Mrs [redacted] came in a phone call where she "offered" one last chance to make an exception and give her a full refund or the company would be hearing from her lawyersAt this time it was mentioned to Mrs [redacted] that filing a fraudulent claim with a credit card company is a felony and it would not be in her best interest to make her actions part of public record [redacted] then came into One On One Fitness in late OctoberShe had a paper in her hand and was accompanied by a tall male, later identified as her neighbor [redacted] approached the desk and the male with her stood very close to me with an aggressive postureThe gentleman made me feel uneasy as he just stared at me with a menacing lookIt was very clear that the purpose of his presence was one of intimidation [redacted] asked if she could return the item just as she had asked, multiple times, on previous interactionsAlthough I had explained it to her over and over again, I showed her a courtesy that was no longer due, and explained the exceptionally clear and simply stated policy of No returns on fitness equipment, all sales are finalAs I was retelling the policy to Mrs [redacted] , the man who accompanied her kept interrupting meAfter I asked him quit interrupting, the neighbor got extremely angry and asked me very loudly and aggressively, "JUST WHAT ARE YOU GONNA DO FOR HER THEN? I explained to him that this transaction had nothing to do with himHe rapidly closed the distance between us, while I was still seated, and yelled "I'm not satisfied with that answer and you had better make this right!!" It was at this time I asked the gentleman to leave the storeHe was clearly here to argue, was becoming confrontational, and there was nothing I hadn't already said to Mrs [redacted] that hadn't been said on many previous occasionsCertainly, nothing that was going to satisfy himI told [redacted] that we were happy to honor the warranty and maintain the usability of her product, but there would be no further discussion on returning itAs Mrs [redacted] left the showroom she stated that we'll be sorry after she writes a letter to the Revdex.com In the quarter of a century we have been in business, we have embraced the presence of the Revdex.comFor ourselves and for the vast majority of consumers, the Revdex.com is an invaluable component in selecting reputable producers, sellers and servicersIt is unfortunate that there is a small population that feels the Revdex.com is an instrument to manipulate, intimidate and otherwise coerce their agenda with perverse statements, partial truths and often outright fabrications We are including all the documentation, that was requested by the financial institutions, and used to successfully defend the transaction between One On One Fitness and the Woodkas [redacted] Sales Manager One One One Fitness [redacted] Mishawaka, IN XXXXX XXX-XXX-XXXX ***Supporting documentation attached, PLEASE SEE ATTACHED Initial Consumer Rebuttal / [redacted] (3000, 19, 2016/12/14) */ (The consumer indicated he/she DID NOT accept the response from the business.) researched the product literature, on 4/22/2016 and purchased the PHYSIOSTEP MDX. [redacted] was informed of our sales policy and shown our displayed NO RETURNS POLICY, additionally our NO RETURNS POLICY is printed on the sales receipt she signed to complete the purchase. [redacted]'s remarks at the time of sale that it was the perfect choice for her because the seat swiveled, and out of the three available choices, it was the only one that performed the swivel seat function.
One On One Fitness received the ordered Physiostep MDX on 05/06/2016 and inspected the unit for damages. The unit's carton was in great condition which warranted no further inspection at that time. Complete product inspections are performed during delivery.
On 05/06/2016 [redacted] and [redacted] both spoke directly with [redacted] and agreed upon 05/11/2016 between 9 am and 10 am for their delivery. Both [redacted] and [redacted] performed the delivery at 10:00 am. The delivery was successful, the unit passed on-site assembly inspection by both Technicians. The unit was assembled in the living room, and both [redacted], and [redacted] were trained on the unit by [redacted] for 1 hr that even included nutritional advice and training intervals and intensity. [redacted] remarked at the time he needed no further training, as he very motivated and required no additional assistance. Removal of packaging is offered to our customers but is not required. Woodkas were not interested in the packaging materials and the container was removed and disposed of. The delivery team left the home and the [redacted]'s were satisfied.
On 06/09/2016 [redacted] called One On One Fitness and spoke with [redacted] asked [redacted] if she could trade her Physiostep MDX in for the NEWLY RELEASED Physiostep LTX. A model that was not advertised or available at the time of Mrs. [redacted]'s original purchase. [redacted] explained that One On One Fitness does not take trade-ins on equipment. [redacted] then asked if we could consignment sale her Physiostep MDX. [redacted] told her the corporation does not allow consignment and we do not have the Showroom floor space for used units. Merchant Services than presented our documents to the Woodkas credit card company and the Woodkas fraudulent claim was instantly overtuned and the funds we're returned to One On One's Corporate bank account immediately the following day.
