I am rejecting this response because:
As you will note in the attached pictures the dentures are in fact defective as stated in Alpha dentals reply stating the "Obvious signs of manufacturer product defect"There are obvious overly thin areas of acrylic that differs from the rest of the denture. You will also note in i*** the area that was fractured and repaired at the 11/30/return visit from the original seating of the denture of 11/14/2016. Additionally Ohio Administrative code Rule 5160-5-01, "Dental Services:Appendix A" (pp7-12) states that payment for a denture of denture service includes ALL necessary follow up corrections and adjustments for a period of six months. In addition in response to an appeal made by me on 3/27/to my insurance company, the insurance company requested information from DR C*** at Alpha Dental concerning the dentures of which there was no response from Alpha dental. I feel that the above information is significant evidence that first, the dentures are in fact defective, second, Alpha Dental has been neglectful of following rules as set by Ohio Administrative Codes and third Alpha Dental has not been cooperative with myself and the insurance company in resolving the issue. I would ask that A "New complete upper denture" would be provided to me at no cost

Here at Alpha Dental, we strive to provide the best healthcare possibleSince this is not a cookie-cutter profession, different patients with different anatomies would mean limitations of the care we would be able to provideIn the case of
*** ***, we had her scheduled for IV Sedated Oral SurgeryOur sedation Doctor tried to start an IV on the patient a few times, but her veins were simply too difficult at several different sites that we triedSome common reasons why IVs are not able to be started are: patient is on hemodialysis, they have small veins, or they are cancer patients, IV drug abusers, or anyone with a chronic illness that "used up" all their good veinsSometimes, patient's veins are simply too trombosed or weakenedOr the visible ones are simply too small
Firstly, the $the patient paid is typically non-refundableThis is because the Doctor's time is scheduled very tightly and there are many people on the waiting listSince this is an instance where we were unable to start the IV on the patient, we authorized for a refundThere is no fault on either party in this case
We have a policy at our office where once the cash drawer reaches a certain amount of cash, the front desk is instructed to quickly deposit the cash at the bankThis is both for security and safety issuesAs a small private healthcare provider, we do not have a safe where we can keep large amount of cashIn the case of Ms***, the cash that she paid was deposited because the drawer met the threshold, thus, we had no other option but to issue a check out to her through our regular accounting process which would take business days to reach their house (dependent on USPS)
The patient became irate at our answer and began to dramatically raise her voice and make a scene at our receptionShe was given a letter promising the refundAt no point did we say that she would not be receiving a refund
On an updated note, the refund request has reached our accounting department and I have been notified that it has been processed
We will be following up with the patient to make sure she receives the check

She was treatment planned for a full upper mouth extraction. Ms. [redacted] elected to...

purchase Immediate dentures to wear during the interim while she waits for her mouth to reshape after her surgery. Our office successfully fabricated Ms. [redacted] an upper permanent denture which she brought home. Some time elapse and Ms. [redacted] presented back to our office with a Midline fracture to her denture. The dentures that the patient was given did not come with a product warranty nor did it come with a damage warranty. As a provider, we are unable to determine with 100% certainty the cause of most fractures that occur in dentures. As stated in clinical studies, 25% of denture fractures are caused by accidental dropping and Midline fractures account for more than 60% of those that are damaged. There are, however, obvious signs of manufacturer product defect (eg. teeth not properly secured to dentures due to short or weak retention pins, improperly cured acrylic that leaves one side of the denture harder than another side, overly thin area of acrylic that differs from the rest of the denture, improper stress points where each time the patient bites, they would feel large pressure or pain on their palatal arch). Even though these situations were not the case in Ms. [redacted]'s denture, we did a courtesy repair order for her. Repairs on fractured dentures are never a guarantee, because the fracture can regrow if even a half-millimeter fracture was missed (not very visible to the naked eye). We wish to help all of our patients in the best possible way. It would, however, be difficult as a provider to help patients when there are hard outside lab costs that we pre-pay for. The reimbursement for the denture from the insurance company was not able to fully cover the cost of the original dentures and the repair. We have not only allocated all the money allocated for this patient, but spent more money. If the patient would still like to have the denture remade, we can make it at a courtesy material cost of $420.
