[redacted]To whom
it may concern,I
[redacted] am writing in response to Ms. [redacted] letter. Ms. [redacted] contacted
me to assist in helping her do some design work in her home. As the owner of
Alpha Interiors I responded to her request. We met several...

times to see what
she would like to accomplish. And what I could do to assist her. She was a bit
difficult to get her to accept any of my suggestions; however, she did find a
picture of a room divider that she had printed off of another designer’s
website. She wanted to use the exact design. My response was, that I could
design her one that was similar, but using that designer’s work was
unethical.  She was agreeable to this and
I came up with a design for a room divider that she liked. She gave me a check
for a deposit on the product. Her divider was to be a custom order that would
have to be fabricated. When orders of this nature are made, and it is a special
piece, there are generally no refunds. I advised Ms. [redacted] that I had several
jobs going on at the same time and that I would have to order the product. She
was aware that my getting back to her job would be awhile. I placed the order
in November on rush/priority because when I did speak she expressed to me that
she would like the order by Thanksgiving. I had told her the cost of rushing
for Thanksgiving week would be more expensive; however I personally absorbed
the extra cost myself as to please her. I knew she had been patient with me
while my other jobs were being completed. The divider arrived as scheduled for
Thanksgiving week but Ms. [redacted] was out of town, making it impossible to proceed
any further. On the Monday after Thanksgiving, she contacted me and said that
she wanted the room divider delivered I told her that it would be on Tuesday
because the contactor I use for projects of this nature was not available until
Tuesday. On Tuesday I met with Ms. [redacted] and my contractor at her home and the
divider was delivered. It was discovered at this time a previous contactor that
she used for constructing the door opening had made construction error. This
resulted in the room divider being slightly too large. I told her that my
contractor could fix the panel so that it would fit properly, and she was agreeable.
It was at this time that I took her aside and apologized for the project taking
such a long while. She said not to worry about it. She understood and figured I
was busy and then things happen. I told her as soon as my installer/contractor
could sand down the divider and be available to install it I would get back to
her. This particular installer is the only one I would trust to alter the
divider. She said that was not a problem to keep her updated. In the course of
our conversation I made Ms. [redacted] aware that my installer also had other
projects obligations, and more than that, he was dealing with a family member
whom was expected to pass away anytime from brain cancer. On the morning of the
scheduled installation I received a call from my installer that his family
member has passed away Understandably, the man was not going to be there to
install the divider on the that day. He nor I had control of the passing of
someone. I called Ms. [redacted] to let her know and she demanded that the divider be
delivered and installed that day. I told her this was the only contractor I
felt comfortable in allowing to install the room divider properly and the
correct way. I told Ms. [redacted] I would get the divider delivered to her house and
make arrangements for installation in a day or two, just after the funeral. At
this point Ms. [redacted] started refusing any options that I presented. I apologized
to her for the inconvenience, but I had no control over the man dying. I was
trying to make things right by getting the divider to home, and I told her if
she had someone else that she wanted to install the divider that would fine. It
was at his time that she said “no” just give me my money back. I made another
attempt to have the product installed for her and she would not hear of it. In
closing, as I said previously custom orders are generally not refundable. I feel
that I made efforts to get the product installed. Some things happen that u don’t
for see and can’t control such as technical problems with structures and people
dying. I did talk with the company that I ordered this divider from and they
made some allowances for me on returning the divider give the circumstances.
Now…all though this time when I was meeting with Ms. [redacted] I had never charged
her for my services or my design. She stated many times that she was going to
pay me for my time, There was quite a bit of time spent on her because as said
earlier she was not very accepting of most of my suggestions. I generally charge
clients $100.00 per hour for consulting; however I waived that fee if they
continue to use my services. This was to the case with Ms. [redacted] as she had
ordered the divider and going with the installation. The company will refund my
money/Ms. [redacted] money entirely, but I have to pay to have the divider shipped
back. This will $101.00. They are also charging a restocking fee of 20% of my
cost on the divider, This will be $253.00. This brings me to my cost. I feel it
is only fair to charge Ms. [redacted] my designer fee at this time because she has
used my services for more hours than I am charging and basically not remained
in a working relationship with Alpha Interiors. I will be charging her $250.00
I definitely spent more than two and a half hours with the client. Respectfully Submitted[redacted]Alpha Interiors
