I am retained by [redacted] to respond to this complaint on his behalf.
FACTS: On July 22, 2013 Mr. [redacted] and his wife applied to reserve a 2 bedroom apartment with a beginning date to be in August of 2013. Mr. [redacted] stated that he would be working for a local trucking firm here in Missoula. The next day Mr. [redacted] was emailed a 12 month Fixed Term Lease for a 2 bedroom apartment beginning August 20th 2013 and ending August 19th 2014. Mr. [redacted] returned the signed Lease Agreement via email. Thereafter Mr. [redacted] called and stated that his wife would not be accompanying him so the required security deposit was reduced from $600.00 to $500.00. The $500.00 security deposit was received on July 31, 2013. At that time there was an enforceable bilateral lease agreement in force.
Sometime thereafter in August, Mr. [redacted] called claiming that he was not coming to Missoula and asking to get his Deposit back. Contrary to the claim by Mr. [redacted], he was never told he would receive his deposit back. He was told that in accordance with the provisions of the Lease there is a $250.00 re-leasing fee, and if the apartment was not rerented before the beginning date of his lease there would also be rent charged until the apartment was re-leased.
As it happened that apartment was rerented beginning August 21st, 2013. Consequently on August 22nd, 2013 the $250.00 re-leasing fee was deducted from the $500.00 deposit and a check was sent to Mr. [redacted] for the $250.00 balance of the deposit without deducting the 1 day of unpaid rent.
This is a perfectly legal and proper resolution to this issue. The mere fact that Mr.
[redacted] was let out of a $10,451.00 Fixed Term Lease for the cost of $250.00 and still files a complaint is ridiculous.
