Upon receiving the information from mr./mrs [redacted] , I realize we had left a higher Stump due to the endangered birds I apologize for their inconvenience and have sent them a check in the amount of $as they had asked for to cover their costs Thank you, [redacted] LeFebvre

We completed all of the work described in the price of $ The stump removal was a proposal for the price of $which we did not collect because we could not do the work even though we had our equipment on site due to the fact that the neighbors were threatening to call the police if the
birds were harmed At this point we decided it was not conducive to make a special extra trip and did not return They were told we would grind it if we were in the area and the birds were gone They have found a provider that will do this job for less so we’ve closed the bid which is clearly stated expire days from original date of the estimate

I am rejecting this response because:
As explained in our
complaint, Alpine Arborists failed to complete the entire tree removalThe tree removal was $1,and the stump
grinding would have been $
They were paid in
advance for the entire tree removal, but only completed some of itWe
are not talking about the stump grinding at allTo reiterate, we are
requesting a refund for tree removal work
that we paid for, that was never completed
Specifically, approximately
feet of the tree is above ground and was not removed, as shown in the attached photo (Tree Image 1)
A photo of the tree was also included
in the attached text sent on 10/7/(TreeText 2)
Alpine Arborists has
demonstrated they are aware some of the tree remains (beyond the stump), as in
their response they admit to stopping cutting the tree down because of a
woodpecker nestIf they stopped cutting the tree to leave a woodpecker nest,
more than just the stump would obviously be there
Also, Alpine Arborists
extended the 30-day timeframe when they
explicitly told us that if we paid for the entire tree removal (even though
they did not finish all of the work), that they would "make the special extra trip" return to finish the
tree removal and complete the stump grinding
They did not say it would only be if it
was convenient for themThey did not
say there were no guarantees they would returnThey did not say it would have to be within daysIf they said any
of those things, then we would not have
paid them for work they did not yet completeWe were told that paying them in advance was a guarantee that they
would return to complete the workTheir response now, however, seems to
indicate that they asked us to pay for both completed and incomplete work without ever having the true intent to
finish the job
Indeed, this response is
the first time Alpine Arborist mentioned that they did not want to come out to
complete the work for which they had been
paid to doWe called and texted them multiple times, and they did not even
have the professional courtesy to respondThey failed to return any of our
calls or messages regarding the matterThis is extremely unprofessional and has
further delayed our ability to completely remove the tree
As a reminder, [redacted]'s
actions further indicate that they knew their work was paid for – yet
incomplete – and that he extended the 30-day timeframeSpecifically, [redacted]
scheduled an appointment for Alpine Arborists to finish the tree removal (to
finish the job they had already been paid to do) and then complete the stump grinding (which then we would have owed
them $285.00) on September 29, Yet, the crew never showed upWhen we
texted [redacted], he did not say anything about a 30-day timeframe, that he would only
do it when it was convenient for them, or that he didn't want to finish work
for which he was paidInstead, he said
that there was a rain delay, and that he would reach out to

The above facts
demonstrate that Alpine Arborists clearly knew that their previous work was
incomplete, and that they did extend the 30-day timeframe for our tree removal
We have not found a
provider that will "do the job for less." That is the amount that it will cost
to finish what Alpine Arborists failed
to do (yet were paid to do)Estimates from other companies show that the removal of the remaining tree, which is
necessary before being able to grind the stump, would cost at least $We have attached an estimate by another company stating this (Tree Estimate). We should be refunded for the portion they
did not complete—and have now admitted they have no intention to complete--which
is $
