Review: Primary Review: Contractor admits to using unlicensed workers for home framing, chinking, staining, plumbing and heating.

Contractor has multiple breaches of contract that included multiple billing infractions. However, the primary complaint is that the contractor used unlicensed workers that were not covered by the California State Disability Insurance program which is required in our contract. This claim has been submitted to the CSLB.Desired Settlement: Refund all monies paid to unlicensed sub-contractors plus the 20% contractors fee. This is approximately $43,000. Mediation and arbitration steps are also in progress.

Alpine Blue Construction, Inc. has had a series of disputes with this homeowner, [redacted], during the construction of his custom vacation log home located in Olympic Valley near Lake Tahoe. The owner had been disputing payment to Alpine Blue Construction pending the outcome of an inspection of a rock wall at the rear of the property. But once Placer County approved the construction of the wall, the owner focused on demanding a refund of $43,000 for using unlicensed subcontractors as well as demanding copies of time cards, and other documents he was not entitled under the contract before he would make a payment. Meanwhile, the owner was withholding documents from Alpine Blue showing the amount of the materials he purchased but were installed by Alpine Blue. Alpine Blue was entitled to charge overhead and profit for installation of these materials. The acts of the owner made it impossible for Alpine Blue to provide a final invoice. Alpine Blue recorded a mechanic's lien for about $26,000 The owner has complained to the CSLB, filed a complaint with the American Arbitration Association, and he has continued to make disparaging remarks about Alpine Blue Construction in the Lake Tahoe/Truckee area where he is aware Alpine Blue Construction does most of its business. A mediation with Truckee attorney [redacted] is scheduled for October 14, 2013. Mr. [redacted] had been represented by [redacted] Esq. in Truckee. But Mr. [redacted] decided he would represent himself, but on occassion, has had Mr. [redacted] step in to assist him. If the matter is not resolved at the mediation, then Alpine Blue with pursue recovery of the monies owed and defend itself either through the arbitration proceedings or in the Placer County Superior Court. Since the contract includes an attorney fee clause, Alpine Blue Construction will seek recovery of all fees and costs, including those incurred to respond to Mr. [redacted]'s Revdex.com complaint herein, should it prevail. Mr. [redacted] is now aware Alpine Blue Construction has a right under Business & Professions Code Section 7031(b) to recover for monies paid even to unlicensed subcontractors. Instead it is apparent Mr. [redacted] wants to ruin Alpine Blue Construction's reputation through the Revdex.com because he will not prevail in the legal arena. There is no dispute about the quality of the workmanship. The owner has said many times how impressed he is with the work. Alpine Blue Construction has gone to great lengths to make this owner happy.
