This letter serves as our explanatory response to the Revdex.com filed by *** *** on January 20th, We trust that our response satisfies the requirements identified in your letter and warrants
dismissal of the Complaint filed by Ms *** ***Explanation
On February 7, 2013, Ms*** *** visited Pronto Auto Sales and purchased a Saturn Ion with VIN Number *** for $7,which she agreed to pay as follows:
1) Down payment: $1,2) Two "pinote payment" for $("Deferred Down Payment)
3) Payments: $(Bi-Weekly payments)
4) Final Payment: $Enclosed you will find teh February 7, Motor Vehcile Installment Contract (and other legal documentation with rgard to the sale of said vehicle) signed and entered into by Ms*** *** and *** *** of Pronto Auto Sales. As you can see from the "Transaction History/Payment History" in the section " Due Date VS Transaction Date (it's when the transaction actually took place) Ms*** strated she started to get behind on her payments and we (Pronto Auto Sales) tried to work with her to the best of our ablilites (financial, legal, state, labor responsibilities) with regards to the past due payments. Mid January I had my assistant call her to do a" friendly reminder" about her last past due payments but unfortunately we couldn't reach her. I even call her personally and left her a voice message on her cell phone, due to the fact that she was almost done paying the vehicle (there was not communication howsoever)When I finally got to talk to Ms*** she had this "entitlement mentality" that because she was almost done paying the car she could just pay it whenever she wantedI also explained to her that the first payment is as important as the last oneThe Recovery company that we use charge us $for each reposed vehicle and I even agree to ONLY charge her $On January 19, 2015, the vehicle in question was repossessed pursuant to the February 7, Motor Vehicle Installment Contract Right of Possession Clause because Ms*** *** was in defaultPursuant to the contract, default is defined as follows:
"Any of the following events will be considered a default: your failure to pay any installment when due; your failure to perform or breach of any section of this contract; any misstatement or misrepresentation by you relied on by us; you become insolvent; any judgment is entered against you; the vehicle is transferred without our written consent, or seized under any legal processIf you default, or we believe in good faith that you are not going to keep any of your promises, we can demand that you immediately pay all that you oweWe do not have to give you notice that we are demanding or intend to demand immediate payment of all that you oweWe may repossess the vehicle; take any reasonable measures to correct the default, or save us from loss; or pursue any other remedy permitted by law in recovering the full remaining amount dueYou will pay the reasonable cost and expenses of these measures, to the extent the law allows."
The contract further states Pronto Auto Sales' remedies upon defaultPronto Auto Sales will return the vehicle based on "Return Of The Vehicle To You" which states: "If we reposes the vehicle you have the right to get it back (redeem)To do so, you must pay the entire remaining amount owed on the contract, plus any late charges, costs of repossession we incurred, reasonable expenses and attorney's fees"We at all times acted within the bounds of the contractAccordingly, based on the foregoing, we request dismissal of Ms***s' January 20, Complaint, on the basis of his claims are made without meritIf you have any further questions please do not hesitate to contact me directly at 317-918-*** or at ***@prontoautosales.net
