Customer provided a design. When we showed up the customer told [redacted] that he didn't think the separation between the two areas was necessary. The 2 playing areas areas were not separated. A few days later customer requieres to cha e the job done to match the design. Also customer we took retaining... wall blocks to the customer to look at. He said they were ok. And after they were I stalked, he required that they would be Changed. Front yard has a natural slope. Making it more level tools cause drainage issues. No idea how the customer says 50 percent is done? It's more then 50 percent. We awill return the 960 even tough we have done more then 960. We were gonna finish this weekends but now I believe it's best if we refund the money. Our phone and arw down wgile we settle a disputes with [redacted] over data charges.

We offered to fix it, she refused to have it fixed and lied to us about an inspector saying the job was done badI agreed to pay her the disputed amount because I got tired of her annoying attitudeI will not pay her anything now because she is now making up thingsI would like an inspector to
look at the project and realize that she has no grounds for this claim

I am rejecting this response because:I will go into detail below but regardless of these issues, the work was not done. It has been over a month waiting for them to fix some small issues which ranged from needing to get more rocks; fixing design discrepancies from plans; and waiting for delivery/installation of the pavers. The original project should have been finished after a week, per your original estimation, but now is months in. The delays also required the plants to be installed next year, dragging out the project even more. I have been very reasonable with the changes I asked for and was willing to pay if I changed my mind after work was done. *** would not meet with me to discuss the issues and I was more than flexible over the last month. When *** was willing to meet with me, dates to meet would get pushed back or changed 5-times for any number of reasons ranging from “I forgot”, to “pavers not ready”, to “phone broken”, to “disputes with parties”, his child was sick, he was in the hospital, and his wife was in the hospital. There was a huge lack of communication and no warning when he couldn’t show up. All this in the span of less than months and the response is always that it will be finished in a couple days.1) It is correct that I provided a design and we agreed to simplify it from symmetrical mulched areas to symmetric mulched areas. When installed, the mulched area closer toward the street was about half the size of the adjacent area and looked very sloppy. My friends even commented on the lack of clean angles and symmetry. When I told *** about it, he agreed it was a mistake and that it did not match the agreed upon design and that he would make it symmetrical, per the original design. After a couple weeks of no shows and trying to meet with him, I came home and the design was changed to the original areas which did not match the updated designs I redlined and that was sent through text. I never asked for the area design and the final designs I redlined and sent had these areas changed. I can understand if there was some miscommunication with the design and how it was executed, but I tried to meet with *** about times to discuss the design. Going through the text messages I was able to count about times that he didn’t show or pushed back dates so we couldn’t meet. The current design with the areas is fine but still not measured correctly to fit the pattern of stone pavers I have been requesting from day one. The design relies very heavily on symmetry and the stone paver walkways in-between. 2) I did agree to the retaining wall brick color that didn’t match but after it was installed, it stood out more than I expected I asked to have it changed and I agreed to pay to have it changed but it was never fixed I never complained about this aspect, I simply asked for it to be changed and that I would cover the excess expenseYour statement is disingenuous at bestThe retaining wall was made of simply eight bricks but this change was never made so I don’t understand the argument3) The yard was never smoothed/leveled out property so there are humps under the rocks where not enough dirt was removed. This has nothing to do with drainage. There was not enough dirt taken out by the front sidewalk (20ft from the house) so when stones were added, they are spilling over onto the sidewalk, which exposes me to significant liability if someone gets hurtNot to mention, this looks sloppy and unprofessional4) The amount of work that has been complete is very subjective, I know. To date, the yard was cleaned but not smoothed/scraped adequately to put down rock properly. There is a 4ft x 4ft areas with NO rock where landscaping fabric is still showing. Where there is rock, many places are so thin that you can still see the fabric. The mulched areas were installed and seem ok but will need to be adjusted slightly to fit the square stone paver design. The stone pavers were never delivered or installed so the rock will have to be moved to inset the pavers properly. There was also a downspout that was buried that is now hidden but needs a pop out drain so currently the roof drainage is getting backed up, which would be a simple fix, but because it remains buried, water is now backs up by the house, risking foundational damage and other damage to my home. That is where we are nowThe drain still needs to be fixed. The high spots in the yard need to be flattened out and a lot more rock needs to be added. The mulched area needs to be adjusted slightly to fit the symmetric design of the pavers. The pavers also need to be delivered and installed/inset into the rock. There is about individual paver ranging in size that haven’t been installed and another plants ranging in size that need to be installed. I will need to hire someone to fix the current issues, try to find more rock to fill that matches the current stone in place, install pavers and about plants, with that, in the most conservative of terms, the yard is less than 50% complete.5) Further, with regards to the pavers, you have wholly failed on three separate occasions to provide me the contact information for the manufacturer of the pavers so I could intervene and push the process along or even confirm that they were ordered and paid for.The chief issue here is I am supposed to be apologetic to your issues causing delays, but I paid for a service to be professionally done and it wasn’tYou have been reactionary the entire time and never once proactive in this situationI have also talked to another landscaper to finish the project and they agreed with all the issues I brought up. They quoted me an additional $to fix and finish everything. The new landscaper clearly agreed that there is more than 50% of the work left to be done. For these reasons, I maintain my demand for the $1,in full by certified funds by December 30, 2016.

I'm not trying to get anything for free-I already paid youYou don't want to own up to your error and fix the pad correctlyYou want me to pay you for a job I already paid you for or you want me to accept a sloppy repairNeither of these options will workYou still have not returned the dirt you took because you were ill prepared upon arrival and had to use the topsoil I had for another projectFortunately, my handyman was there to witness thatThe solution is to repay the (your price) and the topsoil you took plus the delivery feeCourt may be a better solution, although mediation will come firstI offered plus the cost of the the soil and delivery and you accepted and never sent the checkI have never lied about anything.periodHUD required the replacement of cement and withheld money in escrow for the replacement cement and you were told this from the very beginningYou have delayed my repairs and lied to me on a variety of occasions and shown up hours later than you said you would , hoping this will go awayJust own up to the fact that the pads are wrong and we can both move onI will not accept a patch job when I paid for whole padsThe onous lies with the homeowner on the tripping issue and that is not a good excuse for faulty workmanshipIf you would have handled this in a responsible manner you would have gotten the part of the job and made money but instead you wish to deny the faulty workmanship

I have the original estimate. The original estimate was completed on time. You added grading, concrete, and different rock. I communicated with you everyday. I didn't miss a single day, I worked there everyday for 8 to 12 hours. One day I had issues and I was not there all day but I did show up. And...
