Dear Miriam on 04-02-Mr*** *** contacted my office explaining he had an ant problem at his home in Highland CAand wanted to know how much I would charge to solve his problemI told him I needed to come out and do an inspectionSo I went out and did the inspection and he told me he also
wanted the inside of the house and garage done as wellI told him the initial charge would be $and the charge to come out every other month would be $He asked me if I could do the service tomorrow between 8-am I said yes I gave him the preparation instructions and also told him he would need to be out of the house for 3-hours when I started the treatment insideWe agreed to all the terms and I came out on 04-03-between 8-amWhen I arrived *** was not there and I met his wife THI VU I introduced myself and explained to her everything her husband and I had talked about she agreed to everything and I told her I needed her signature before I could apply any pesticidesShe signed the paper work and I gave her a copy and then asked her if she had a preference weather I start the inside or the outside firstShe said it didn't matter so I said I will do the outside and garage first she then asked me when I would be coming back for the next treatmentI told her it would be around the end of June so I could include them with the other Bi Monthly customers I serviced in the areaI then noticed the side entry gate was locked and did she have a key she said no my husband has it with himI also noticed the gate was tied with wire to another section of wrought iron gate that was rotted from age, weather, and neglect I told her I could untie that section and gain entry through that way and secure it when I was finished in the back yard she said that was fine and said she was running late for work and needed to goI hadn't heard anything from them between 04-03-and 06-30-so I went out to service their property on 06-30-in the morning I noticed there was no car in the drive way so I assumed no one was home I also noticed the gate being locked again so I UNTIED THE SECTION like before to gain access to service the backyardMiriam I was just doing what the contract called for which allows me to come on their property for serviceWhile I was in the backyard I was inspecting all around the house including all windows and doors for spider webs and spiders I happened to be around the backdoor when *** *** came out noticed me and said what is that pole you are using ? I EXPLAINED IT WAS FOR REMOVING SPIDER WEBS around the foundation and windows and doors and any other areas around the house where there are websI then asked him how the last treatment worked and he said you got them all however I NOTICED AN ANT TRAIL IN THE backyard along the fence by the fruit trees I said no problem I would take care of themHe then went inside and I finished the treatment secured the gate and knocked on the door to collect the fee for serviceHe didn't answer the door so I left a self addressed envelope with the bill for service and leftI also would like to mention when *** came out he said how did you get in the backyard I told him the same way I came the last time through the broken section of your wrought iron gate which your wife gave her permission to meMiriam this is simply a matter of another customer breaching their contract because when I contacted MrsLee about payment for service rendered she said I was to expensive and requested it to be the last service I said no you signed a contract and with you being in Real Estate as an agent you know all about written contractsI also told her that not only will you be liable for late fees that I WOULD ALSO FILE A SMALL CLAIMS LAW SUIT for breach of contractAnd now Miriam since they contacted the B.B.Bdefaming my character with slander and libel since this was written they most likely will be hearing from the law firm of Parker And Stanberry for their allegations as wellSincerely Mark Londean / Owner Operator of Alternative Pest Control Inc
