[redacted] came in to purchase a 2004 Mazda 6 from our business on June 03, 2013. She had filled out a credit application and we sent this to our lender Lobel Financing. They approved the loan based upon the information that was submitted to them at the time. We called [redacted] and told her to come in and get the car. They did not have the entire deposit of $1250 that was mutually agreed upon at the time. She said she could give us $250 for a partial down payment, and $1000 two weeks later. We agreed to this promise as our lending requirements states that there can be no more than $500 deferred payment. Lobel financial notified both ourselves and [redacted] that they needed more information about her income. They were unable to satisfy the requirements of being paid (W2) by a licensed company, so Lobel could not agree to complete the process. We called [redacted] to tell her to bring the car back and we would unwind the deal. She and her mom came in and returned the vehicle on June 10, 2013. Her mom asked for the partial down payment to be refunded and we were unable to satisfy her wishes. Partial payments are non refundable as we have a re-stocking fee, and a preparation cost to get the vehicle back to the original condition to re-sell. The pre-approval of the loan was based on the accuracy of the credit application. When [redacted] could not prove that she worked for a company who was licensed, the finance company could not follow through with the loan.

I have reviewed the response made by the business in reference to complaint ID 9579152, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Concerning the reply, we had been in touch with the dealer sat and monday, also we were in touch with the lender, and were in the process of getting the papers together, mindy was very understanding, From lobel finiacal, [redacted]. he said for us to give him 250 , sign a note for the rest, then when lobel calls to tell them we gave 1250 down, I had to put ins on the car and fax everything in before we could take the car off the lot, also he said that he would fax the rest of the papers into them on monday,She told us that ericka being paid by her dad was not a promble and as far as a w2 , all they wanted was a bussiess lic, from her dad, we called and told them we were taking the car back.we did and was talking to the other people , he came out with a rude talking and yelling at us, I asked for my money back then he really started yelling his employee were saying im so sorry and the next day said they could get us into the same car. I called mindy and told her what was going on, and she said it was up to the car dealer if he gives us our money back. [redacted]

In regards to your response: We seem to not be on the same page. We did not here from her on Saturday. After numerous phone call on Monday, she returned the call stating they were bringing the car back because she could not have her dad come up with the business license. We were willing to work with them on the additional $1000 down on the promissory note. They were okay with that. When we asked about the business license and the W2 YTD paystub, they could not come up with that, therefore left us with no choice to cancel the car deal. Because of our restocking fee consisting of detailing, gas, labor, wear and tear, mileage, etc, we can not return the $250 that was an initial deposit on the car. The owner was not rude or yelling at her, as there were witnesses to this.

Regards,

Review: We went into the car lot to look at a vehicle. We test drove a Dodge Durango 2001. We liked it and went in to do a credit application. We filled one out and were told that they would not hear from the lenders that evening if we were to get approved. [redacted] our car sales man along with [redacted] a co worker told us that we could put some money on the vehicle as a hold so that no one would buy the vehicle while they were to find a lender. We told [redacted] that we don't want to go over $225 a month for payments and also not over $1000 for a down payment. We agreed to put $500.00 to hold the vehicle while they worked with finding a lender. I specifically asked will this be refunded if we can't come up with an agreed deal. I was told yes definitely. We signed a paper that stated we were putting a hold on a vehicle and then we gave them our debit card. They gave us a receipt. The next day I called them in the evening after not hearing from them on if they found a lender and they said well we found a lender that will take $1500 down and $299 a month. I said that is too much and we can't do that much. They said well what could you do. I said we could do $225 a month with the most $1000 down. He said he would call me back. A couple days later he called back saying they found a lender that could do $1000 down and $266 a month. I said I would talk to my husband and call him back and let him know. I was able to get a hold the car salesman the next day and tell him that we can't do that deal and we would like to just get our hold on the vehicle back. At this point I had some medical issues that unexpectedly came up and we would not be able to afford the vehicle and don't want to get in a deal we can't do financially. He said he understood and would have to talk to a couple people before he could give us our hold money back. I said Okay. There was not a call the next day so by this time it is Friday May 16th and I gave them a call and was told that the guy who deals with this type of thing is out at auctions and will be back in a couple days. On Tuesday I called after not hearing from anyone and was told I would get a call back. No call back. I called on Thursday and talked to a guy named [redacted] who said that they don't do holds on vehicles for that length of time. I said that he didn't have to hold the vehicle because I said we didn't want to do the deal only a few days after we put the hold on the vehicle. He said he would give me a credit to the lot. I told him I didn't want a credit I wanted my hold back that we were told when put a hold on the vehicle that we would get back. He said that is not their policy. We were not given a copy of their policy and I told him that I don't just hand over money to people. He told me to call the next day. I didn't call. I had my husband who was at the transaction of the hold deal on the very first day go into the dealership the next day to try and resolve the issue. He asked to see the policy and they told him that they don't have it on hand and that they would try to get it to him within a week. They told him there was no agreement to give us back our money that we held the vehicle for. They told him that they were not going to refund us our hold of $500.00. My husband left without being able to resolve the problem. We would like to get our full refund of $500.00 back. We didn't purchase anything from this lot or agree that we would settle for a credit to this lot.Desired Settlement: To be refunded our $500.00 hold for the vehicle we did not purchase.

Review: I agreed to purchase this car from Always Approved under the conditions that they repair the following items:Check engine light errorKey stuck in the ignitionI have made many attempts to get them to complete their agreement. I have made several calls, they tell me they will "call me back", I wrote them a letter, they did not respond, I went to the dealership, they told me that they would have someone call me. They never did. I am still stuck with this car and the issues they agreed in writting to fix. Also I was making regular payments on their web site per our agreement. Suddenly their websit is taken over by a Car Guru web site that requires a paid membership to access their site. I called them to ask how can I now make my payment, they refused to respond!I can not pay the tabs on the car due to the check engine They will not respond. They changed their web address and I do not have a paid membership to their web application so I can not access their web page to make my payment.I have called them numerous more times to resolve the issues and they refuse to respond.I can not renew my license tabs until the check engine problem is fixed. They refuse to respond.I have paid $2800.00 for a car that is worth $500 in good working order and $300 in it's current condition wich they sold the car to me in.I have concerns that the finance agreement I signed is illegal as they charged me $1,000.00. I have interviewed other dealers who all say that this guy is unlawfully charging me.He has broken the contract and I want out of the contract. I owe according to his finance fees $800.00 that I have tried to pay, but get no response from this company.Desired Settlement: I would like this contract ended and I would like the title to the car signed over to me with the monies I owe to be wiped clean in leu of this dealer not making the repairs on the car as per the agreement
