Review: I bought a Kirby product on August 6, 2013, I cancelled the contract on August 7, 2013. Per A & M Merchandising they never received the cancellation letter for a few weeks and said the postmark was late. I have searched the contract and it says nothing about having the letter postmarked within 3 days.Desired Settlement: I wish to have the merchandise picked up and my contract cancelled and a letter stating that.

The customer purchased the Sentria II Kirby System 8/5/13. The 3 day cancellation period expired on 8/8/13. The contract clearly states: To cancel this transaction, mail or deliver a signed and dated copy of this cancellation notice or any other written notice, or send a telegram to A&M Merchandising at address [redacted] not later that midnight of 8/8/13. Customer mailed notice on 8/16/13. On 8/9/13 customer called our office and spoke to [redacted] about a bank fee that he was charged due to the deposit check of $118 that was processed. We immediately mailed customer as requested a check in the amount of $35 #[redacted] along with promised gift of a hand held vacuum called a "Car Vac" UPS tracking# [redacted]8. The Kirby unit was demonstrated and sold in good faith. The customer did not cancel the purchase within the contract three business days. Please assist. ###-###-####

I am rejecting this response because: The finance company has sent the account back to A & M Merchandising. I would like a representative from A & M Merchandising to pick up the Kirby as soon as possible.

The account was charged back as a first payment default. The customer did not cancel within the three day cancellation period as stated clearly on their contract. We will make arrangements to pick up the Kirby to resolve this matter. Our office will make contact with the customer. Thank you for your assistance with this matter.
