For the Revdex.com's purposes, we (Dan's Auto
Sales) begin the
response by noting that the car was sold and the customer signed a
statement (FTC Buyer's Guide) to that effect, as well as a statement that Dan's
Auto Sales did not make any promises and that neither party owed the other
party anything after the contract was signed.
We are legally and ethically on solid ground as far as the paper trail
goes
That stated, we must remind Mr[redacted] that he and the
primary buyer took delivery of the car on May 6th, when they agreed
to purchase the vehicle if we were able to arrange financing that met their
terms. It was not until May 18th
that financing was arranged and all parties were able to meet and sign contracts. If there were any concerns about mechanical
issues at the time of delivery, the customers had a full days to bring them
to our attention or to have the car inspected.
We do not know whether or not they had the car inspected, but we assume
that there were no concerns at the time they signed the contracts because they
did so of their own free will and accord.
The nature of a "check engine light" is such that it
illuminates when an engine computer recognizes a Diagnostic Trouble Code. Since the light was not on during the days
the customers were driving the car prior to contracting, and apparently not for
several days afterwards, the problem developed after the sale and we could not
have had any prior knowledge of it.
Mr[redacted]'s suggested remedy to the current situation is
"I just want them to take it in and get it check out fully and have a statement
saying they did so and not just there (sic) word". He is requesting our assistance while at the
same time impugning our integrity. We are
not unsympathetic by any means but, after the sale, we have no duty to have the
car inspected or repaired with or without written evidence. However, we have a professional engine
scanning tool and would be happy to run a diagnostic scan to see exactly what
comes up for free. We also have an
arrangement with a mechanic to work on our customers' cars at a discounted labor
rate and parts at our cost. Mr[redacted]
is welcome to take advantage of that arrangement, which has saved many of our
customers a lot of money over the years
Finally, neither of the owners of Dan's Auto Sales were
aware of this issue until we received the Revdex.com report. If he spoke with our salesman and we were not
informed, we will address that issue and we apologize to Mr[redacted]. We would encourage Mr[redacted] to bring any
future problems directly to our attention as our salesman has limited authority
in these matters
