I booked a date on this particular photographers website for 12/14 and paid a $50 holding fee. Amber (photographer) responded to me via email on 11/7 confirming the date. We had gone back and forth via email talking about location for our shoot that was booked for 12/14. had last heard from Amber on 11/17 saying she would confirm if pets were allowed at our location. I patiently waited to hear from her and never did. I reached out again via email on 11/24 and didn’t hear back (after multiple emails sent) until today 12/2 when I finally reached out via *** Messanger. Amber then informed me she can no longer do the date we agreed upon so I asked for a refund and she told me it wasn’t refundable. I now have to find another photographer within a short amount of time before baby make their appearance for our maternity shoot and would like to be able to but the $50 towards that since we weren’t the ones to cancel.

The client (***) and I had discussed a possible date for her photo session, and we had talked about possibly shooting at a Christmas tree farm but only if her dog was allowed to attend. I contacted said Christmas tree farm and waited back for a response whether we were allowed on the property or not for the photo shoot. It took them a long time to get back to me which is why it took me a long time to get back to her. It turns out that the dog was not allowed on their property for the photo session, and I also had a change of plans out of my control and needed to now discuss a possible different date with her. I was shooting a destination wedding the days prior to the date we had talked about scheduling her session on, and my flight plans had been changed by the airline making me get home much later then I had anticipated, therefore not allowing me to be home to do her maternity session on that day. She was completely unwilling to change her date and demanded a refund. I kindly reminded her that the session retainer payment is non refundable (it was in the contract she signed) and we can discuss other dates for her session. She did initially book and pay directly on my website without ever speaking to me about a date, and we had discussed 12/14 but never had a set time or date or location in place.
She was refunded a few weeks ago via *** which was how she initially paid the non refundable retainer. She was trying to get around the contract that she signed stating she understands that the contract is non-refundable and has went to great lengths on social media and now the Revdex.com to get a refund. I did end up refunding her to just be done with the head ache, but contractually she booked knowing it was non refundable. I have proof of the refund and contract which states she understands that the payment is non refundable in any circumstances.
