A.R.S 33-1255 (c) (2) the reads "any common expense benefiting less than all the owners must be assessed exclusively against the units benefiting from the expense". He disagreed with this and stated he wanted it presented to the Board of Directors.  I sent the Board an email with his concerns. It was decided to discuss at the next Board meeting which wasn't unit Sept. 23rd. At the meeting it was discussed & the Board wanted a legal opinion regarding the AZ Statue.  I emailed their request to the attorneys. In their legal opinion it was stated that it should be the HOA's responsibility. Which, I presented to the Board at the next meeting in November. The Board was still split in their decision and asked for another legal opinion. I then sent it to a different law firm. Their legal opinion also stated that they agree that it should be the HOA's responsibility. At the next board meeting which was in January 2015 the Board approved the request with one Board member disagreeing. I contacted ** [redacted] to quote the repairs.  To make a long story short, I've talked withe Owner of ** [redacted] on 06/01/15 & he will contact Mr. [redacted] today & schedule the repairs this week. I've rec'd a phone call from [redacted], who is the Owner of S & R, he stated that he did call & leave a voice message & he also sent a text Mr. [redacted] asking him for a return call or message. Sean states that he will be on property tomorrow, whether Mr. [redacted] contacts him or not. I called and talked w/ [redacted] this morning (06/02/15) and he stated at this time he has not heard back from Mr. [redacted], but [redacted] will be at [redacted] this morning.
