To Whom it May Concern, Attached you will find the Final Settlement Statement and the Customer Orientation Form from 10/24/ On that day Mrs [redacted] took possession of her home Per our contract with Mrs [redacted] on that day the One Year Warranty began on her home As you can see her current complaint is well past the end of her warranty one year warranty periodPlease note that in an effort to satisfy Mrs [redacted] that America's Home Place on three different occasions has continued to perform warranty on her home Also, we will send a representative to her home on Monday morning to observe her current problem I propose that once we diagnose the issue that if Mrs [redacted] desires that America's Home Place pay the cost of the plumbing repair in return we will need her to sign a compromise and release that will release America's Home Place from all future issues (even though we have no current liability on her home) If I can be of further assistance please let me know Thank you, [redacted] ***

[redacted] My name is [redacted] *** I am a Division President for America’s Home Place over South Ga and North Florida I have been heavily involved in the selling and the building of the [redacted] Home and am knowledgeable of the job and the customer concerns To keep this simple I will simply respond to Mrs [redacted] ’s concerns outlined in her complaint to you Before I do please note that America’s Home Place received a Certificate of Occupancy from Schley County on 9/30/14, and that we have passed all inspections I have attached a copy of the Certificate of Occupancy for your review Also, attached are daily logs that we keep on every job in my division In those logs we detail the daily activity on the job Also I am attaching an string of emails between Mrs [redacted] and myself that starts on 9/26/ As you can see we just got the requested final completion list on 10/14/ Here are the issues that Mrs [redacted] has with her home according to the letter and my response to those items: Building Timeline-Mrs [redacted] states that nothing happened for two weeks after her initial superintendent was let go On March 3rd her initial superintendent was let go As you can see [redacted] who is our production manager began running the job himself In the attached board update during the two weeks after between 3/4/and 3/17/the house had backfill on the slab completed, slab plumbing completed, slab prepping done, inspection passed, and framing began During that time there were several visits to the job Misplaced Water Lines-These items were corrected to code See the Certificate of Occupancy Deck-This is currently done to code per the Schley County Building Department I will be the first to admit that initially it was not done correctly but now it is We have even done additional work to ensure that she is satisfied Tomorrow the dirt will be pulled from the deck boards and the additional concerns that the customer has with the deck will be completed then (from her list on 10/14/14) Plans Issues-See attached plans signed by Mrs [redacted] on 1/30/ Hot Water Heater-Initially the hot water heater was in the attic area next to bedroom On 6/18/she made a change order (see attached with her signature) that added a on demand heater That eliminated the need for us to put a hot water heater in the attic beside bedroom As you can see from our daily log that when the change order was executed on 6/18/(see attachment) we already had sheetrock completed At that point the door was framed in, and the opening was there We framed that opening in and patched the sheetrock It is in to code and builders specs that she agreed to in the contract 2x6/2xwall issue-The house’s utility room back wall called for a 2xwall on the plans Mistakenly the wall was framed for a 2xwall I have met several times with Mrs [redacted] and she stated on different occasions that she didn’t want us to rip the wall out to make the correction so it was not done Leak at the Front of the home-This issue is repaired Also we are redoing the sheetrock at the front of the house to ensure her satisfaction after it being installed and repaired correctly The first time we took sheetrock out only to where water damage was present Before the repair we thought that the sheetrock damage was higher When we opened it up that was not the case The damaged sheetrock was cut and replaced where needed But Mrs [redacted] wanted it higher so we are doing it a second time That will be done this week The repairs were done according to our company mold specialist We are doing them a second time to satisfy the customer Smooth Ceilings-These have been done times We are going to rework the seams in the garage hallway, foyer by the coat closet, vaulted ceiling seams will be sanded Those items will be done this week Scratched Floors-This will be touched up once all the other issues are completed Draft Stop-Was completed last week Sheetrock in Garage-This will be done this week Stairway Light-Has already been put in If you have any further questions on the above please let me know Desired Settlement: Credit Requests- Deck- Done according to code There is no reason to credit the cost here We will pull the dirt back, and touch up a few other items that Mrs [redacted] has requested That will be done tomorrow Ceilings- No credit will be given here The ceilings are going to be touched up one more time and will be to code and standards Grading Issues- This property was initially graded by owner prior to us beginning construction The house was placed on the property in the way that it was provided to us In fact America’s Home Place has paid for an additional expense of $4k (half paid by Mrs [redacted] ) to even make the driveway passable Please see the notes in our daily updates at the beginning of the job noting this Material trucks were unable to get to the home in the way it was provided to us Coring of the Foundation- America’s Home Place passed a footer inspection, a slab plumbing inspection, and a final inspection at her home Those inspections insured that the house was built to codes and standards If the customer wants a coring sample then they are welcome to do so and make the repairs from that sample at their cost America’s Home Place has no reason to believe that anything was done incorrectly, thus we are not doing the sample at a cost to us Longevity of the Project- In article of the contract signed by Mrs [redacted] on 11/22/it clearly states that “CONTRACTOR DOES NOT GUARANTEE A COMPLETION DATE AND IS NOT RESPONSIBLE FOR ANY EXPENSE OR EXTRA FINANCING COST DUE TO THE EXPIRED INTEREST RATE LOCKS, CHANGING, INTEREST RATES OR ANY OTHER OWNER FINANCING EXPENSE.” This issue was clearly laid out in the attached contract I trust that with the backup documentation that you can see AHP has done all we can to attempt to complete her home in a timely fashion I will not say that everything has went perfectly but I will say that we have done all We let Sarah know that we had no interest in using one of their preferred lenders, againOn June 16, 2016, Sarah emailed me the following: It doesn’t look like [redacted] mortgage will accept the pricing worksheet as it stands and America’s Home Place can not artificially inflate prices to hide closing costs within the pricing worksheetI’ve spoken with [redacted] and sent over the pricing worksheet for his reviewAfter an initial assessment, he would be able to potentially save you 4k in closing costs based on the pricing worksheet and cost of the land (70,000)I’ve copied him on this email as he will have to pre qualify you all with his company before we can move forwardIf you are willing to talk to another lender, this is the best option I have been able to find Sarah took it upon herself to reach out to [redacted] who they recommend, with out permission from my husband or myselfThis is after we made it clear we did not want to use any of their lendersUnfortunately, I no longer have the phone that I had when I was dealing with Sarah T [redacted] at AHP however I am sure they will have records of the numerous text messages sent to me asking if I have spoke to their finance personAt this point, we no longer felt comfortable working with them and decided we were not willing to make such a large purchase from this company after AHP disregarding our concerns for using our own financing and pressuring us into using someone they "recommend." Eagle Towing LLC is under contract with Camelot East Apartments as part of a Private Property Impound agreement. [redacted] wrote a nonspecific complaint that did not identify the make and model of her vehicle. We have no knowledge that the driver “broke-into” the Ms. [redacted] ’s car;... however even if it was necessary, this action is legal. Prior to towing from private property, we must insure the vehicle is in Neutral. The driver is legally permitted to enter a locked vehicle to place the car in neutral. If the car is not placed in Neutral prior to the towing operation there will be damage to the car. This is main reason it is legal for our driver to enter a locked vehicle. Based on these facts Ms. [redacted] is not entitled to a refund.

American Home PlaceJenkin’s- “We were under contract to build a home and came to an agreement, gave them a $deposit and signed their contract”Please note that all three signed versions of the PWS and Section of the ratified Construction Agreement clearly annotate the deposit to be non-refundableJenkin’s- “How they had a line in the financing page, raised concerns with our loan officer and they advised it needed to be changed” [redacted] AHP agreed to contribute $toward the [redacted] closing costsThis “concession” was annotated on the last line of the first PWS*Since AHP was going to have to “front” these funds for the [redacted] to close on their construction loan, [redacted] ( [redacted] lender) preferred that we rewrite the PWS to isolate this contribution as “closing costs” instead of a “concession”[redacted] underwriter rejected AHP’s revised PWS and indicated that AHP cannot contribute towards closing costs [redacted] now requested that we rewrite the PWS to rename our contribution towards the closing costs as “Construction Administration Fees”.*It was at this time that the [redacted] were apprised by their lender that their loan required two closings and that they were required an additional $6k in feesAHP agreed to contribute an additional $1500, which is why the figures changed from $to $10849.35*Their lender then indicated that the only way this deal would work would be to “absorb” our closing cost contributions into the hard costs of the home or the Land Improvement Allowance FeesAfter consulting with a legal consultant and a Real Estate broker, we were advised that it is illegal for us to artificially inflate the cost of the home merely to “bury” transaction feesWe also rejected their idea of creating fraudulent invoices to substantiate augmented site related expensesWe conveyed our positions to their lender which is where we reached an impasse [redacted] “AHP wouldn’t update the contract or work with her” [redacted] Inaccurate, reference prior response #(above) pertaining to multiple iterations of our Pricing Work Sheet and signed Construction Agreement[redacted] Sarah T [redacted] AHP Building Consultant) modified the agreement and reviewing it with their lender prior to resubmitting to their underwriter Under advice from [redacted] ( [redacted] ***) we were instructed to “move the money around a little” to placate their underwriter[redacted] Multiple additional texts and emails between various AHP employees, [redacted] and the [redacted] pertaining to this transaction can be provided upon request [redacted] “At that time they kept calling, texting, and emailing us pressuring us to use “their” finance guy who began contacting us as well” [redacted] inaccurate, AHP does not have a “finance guy”We refer our customer to multiple lenders that are familiar with our processes and who will, historically, provide bettwe service at competitive rates to our clients Our customers are under no obligation to use who we refer[redacted] The [redacted] conveyed a sentiment that they felt they had “gone too far” with [redacted] and that they would potentially delay the process by considering other lendersWe: [redacted] made them aware that [redacted] had not even initiated an appraisal (days after they were given all of the loan documents) ergo, no money had been spent[redacted] made them aware that the other lenders have similar programs with identical (if not better) fee structures and encouraged them to submit an initial loan application with other lenders so that they could compare products[redacted] The [redacted] seemed anxious to move the process along yet unwilling to consider another lender other that ***Sue to their reluctance (and the face that we were unwilling to “doctor” the paperwork) their perception was that AHP was “steering” the [redacted] away from [redacted] and towards one of our preferred lenders [redacted] - “we began getting uncomfortable with the pressure and we tried to have them work with our lenders but their refused” [redacted] To our knowledge, the [redacted] have not provided any evidence to substantiate this claimWe were diligent to respond to every one of their concerns and made every effort to work with their lender [redacted] we attempted to restructure our PWS to placate their underwriting multiple times and even agree to contribute an additional $ towards their closing costs when their lender supposed everyone with an additional $fee to pay for a second closing ***- At this point we told them we weren’t comfortable moving forward with them because of how they were trying to push them to their lenderInaccurate- “At this point in our lives it doesn’t look like it’s going to work out and we hope we can work with you all sometime in the future”***- they refused to give us our deposit and amicably go our separate waysPlease reference response #pertaining to the separate documents that clearly stated “non-refundable deposit”Based on the direct quote above, we conceded to honor to $deposit for a period of days if they eventually build with AHPWe expressed to the [redacted] that our overhead burden to perform a detailed site analysis, drafting fees, estimating, etcalready exceeded the deposited amount (which is why it is non-refundable after the PWS is signed) [redacted] - “We asked for the information to their corporate office to talk to them about what was going on but they refused to give us the information”Inaccurate, when requested this information was providedGiven the proven ability of the [redacted] to navigate social media, we are confident that they also possess the abilty to retrieve what relevant information that they require from our company’s website [redacted] - The only response from them was that we had days to stay under contract, again pressure to use who they wanted to finance with”InaccurateDue to the potential of material/labor price increase, AHP will honor the quoted price on the PWS for a period of daysIt is within this day period that we expect the client to sign the formal Construction Agreement ( the “contract”)Once the contract is signed, we anticipate an additional 30- days for the client to secure financing, as most lenders cannot start their loan process (appraisal, underwriting, etc.) until this document is ratified.Due to the irregularities in this transaction and their difficulty in obtaining financing, AHP additional agreed to honor their initial $ deposit for an additional days if they chose to build with us in the future

Americas Home Place placed our house form in the wrong location, (encroaching on setbacks) They had to tear it out and could not figure out how to place the new one properly.This took over months and we were still without a slab! The superintendent did not seem to have the capability to complete -or start- our house properlyWe contacted Mitch, the regional manager, to return our depositHe did not have a grasp on what had been happening with our project, or his employees, and forced us to take them to court to get it returnedWe won our case and have since been returned our deposit + legal fees Terrible process, terrible execution, terrible customer service.DO NOT DO BUSINESS WITH AMERICAS HOME PLACE

I read on the original email that I needed to inform of any contact via the business and myselfI have been speaking on and off with the superintendent and he has been explaining some items they were trying to correct on their ownOne item was the ceilings, once againAnother was the leak upstairs around the toiletAfter four attempts to stop the leak they finally replaced the toiletThere was also a leak coming through the wall to the outside of the home and that had to be repairedYesterday, 11/17/14, *** contacted me and stated Mr*** *** agreed on crediting the money we paid extra for the ceiling paint to look smooth but, they would not correct the underling issue, the sheet rockThey also proposed with the credit to apply a textured ceiling to try to "hide" the imperfections of the sheet rockI feel this is insulting to offer us back our out of pocket money as a credit to just hide the real issue and we have to still live with the imperfections and some how correct them in the future.

I have communicated with the customer and have scheduled a walk through of the house with the list of items requested for repair and sign off of completion for item completed on the list and to schedule any open items for future completion dateIt is my opinion that AHP will finished for items that are agreed upon for repairs by the end of April as long as the customer and AHP agree on items to be coveredAppointment is scheduled for 4-2-9:00am CT

For your reference, details of the offer I reviewed appear below.AHP did have a company cone and assess the truss issue in the garage The problem is not only in the garage but over our entire house Yes some of the items on the list have been addressed but maybe only half of the page list When repair work is done it is poor For example flashing nailed on top of shingles When we brought this up it was suppose to be fixed The repair men simply covered this area with a row of shingles on top of flashing These blew off within a weeks time Another example was there was air blowing under floor molding in dining room The fix for this by repair man was expanding spray foam When sprayed in area it came out umderneath molding in garage on the other side of the wallProblems are in each room of our home The step that was just added a couple of weeks ago already has a brick that has come off The air blowing under cabinets remains present as well as cold areas on the floors There is moisture differences in areas of slab and this is documented Nails pops in every room, humps in sheet rock that are very visible, broken window, gaps in siding next to window, parts of roof are wavy, all ceilings have sagging areas, there is a huge hump in floor that was noticed AFTER the new floors were laid which is suppose to be fixed "later", cement work in garage that even Mr*** said his grandchild could have done it better has not been addressed, wood door casing that already has water damage that AHP repaired with caulk, and the list goes on and on with issues that are being ignored AHP had an inspector come to our home to assess the two large cracks in slab that ran from inside and down side of house The inspector stated it was all within guidelines because it was less that 1/of an inch Our measurements differ dramatically Since the start of our home it has been one thing after another constantly The list that was referred to in AHP response is a very out dated list The only way the complaints can be resolved is for our home to be properly fixed AHP continues to place band aids on problems that are extremely concerning to us or either the problems are not address at all for example the ceiling sags or ceiling cracks in two separate rooms Attached are images of floor cracks and moisture reading in different areas The floor repair man said the black area on floor is from moisture problems

Thank you for allowing me to respond to Mrs***’s concerns again Attached you will pictures from the prepping and pouring of the foundation, one of invoices (all can be provided if needed) that shows fibermesh was purchased and installed, a signed contract, and signed plans with change order from Mrs***.
I will respond to each section of Mrs***’s Concerns in the order that she laid them out individually:
Building Timeline/Foundation Questions-
Attached are several pictures that we took during and prior to the pouring of the foundation I think that it shows that we were there and running the job and visiting on a very regular basis
Misplaced Waterlines-
The concrete from the waterline repairs were repaired prior to installing the flooring In the signed plans you will see that nowhere on the plans are 2xwalls called for in load bearing instances Furthermore, 2xwalls are not required by code on load bearing walls in one or two story applications.
Deck-
The dirt under the deck was removed last week We have everything minus screwing of the replace deck boards on the deck completed That will be done next week.
Plan Issues-
Not sure what is the problem here that we haven’t already covered in my initial response.
Hot Water Heater-
The attic area where the water heater initially had to have an access door by code Attached is a signed plan showing where the hot water heater was in the attic area with an access door However, Mrs*** did execute a change order that removed that hot water heater and changed the home to an Tankless Hot Water Heater while removing the door But that change order was not done until sheetrock and trim were completed in the house So naturally we had to cover the hole that was there for the door because we built from the attached signed plans.
Leak at Front of the Home-
This issue is now completed and repaired to customer’s wishes.
Smooth Ceilings-
In the “Residential Construction Performance Guidelines” that per the contract is what we adhere to it says about sheetrock joints:
PERFORMANCE GUIDELINE: “Any joints that are visible from a standing positon facing the surface at a distance of feet under lighting conditions are considered excessive.”
CORRECTIVE MEASURE: One time only during the warranty period, the contractor will repair the affected area of the wall to meet performance guidelines.”
We have attempted to repair the areas that concern Mrs*** on occasions After the current sheetrock work is complete we will not be doing anything going further.
Scratched Floors-
When Mrs*** is happy with all other issues we and is ready to settle and take possession of the home we will touch up the floor one time with her supervision to ensure that we complete them to her satisfaction, and that she signs off stating that she is ok with the touch up.
Sheetrock in the Gargage-
The additional sheetrock was installed to meet code There is no code that says it has to be staggered
Stairway Light-
Already addressed about months ago.
Desired Settlement-
Deck-Once complete no issues will be here.
Ceilings-
After this repair no more action will be needed per our contract.
Grading issues-
The lot was done by owner The house was placed on the lot that was given to us See the attached Pricing Worksheet that says that initial grade was not included in our allowance amounts.
Coring of Foundation-
She is free to do so But the repair and coring will be at Mrs***’s cost.
Longevity of Project-
Please see the attached signed contract It says clearly that no build time it promised or guaranteed Nor is AHP liable for any fees due to construction time.
Leaks-All leaks are repaired (including the toilet)
Semi Gloss/Flat Paint issue-AHP installs flat only Nowhere in the attached documents was semi-gloss paint paid for or selected.
I would be happy to send a Performance Guidelines book if it is needed for the file and your reference.
