The tour wasn't advertised properly due to the potential risks associated with riding in the desert with no warning about taking insurance out
on 3rd October we took the *** ATV tour, which is advertised as needing no previous experience and suitable for ages from 16.
Once we started riding the dust became a real issue as visibility became difficult, you had to keep sight of the rider in front of you or else you could go off track, also in parts the track became very narrow. Both these factors led to me hitting the bank and flipping the bike on top of me. I broke my collarbone.
We were taken to the hospital by one of the tour guides, but immediately after was given a bill of $1525 to pay for the damage to the bike and asked to pay there and then. I was in so much shock we paid it but once we returned to our hotel thought about it and was very unhappy. Although we had to sign a waiver we really believed that any damage to the bike would only be charged if you abused the bike or behaved irresponsibly, not through a genuine accident. We phoned the tour company the next day and they refunded $525 but we are still out of pocket for $1000.
We believe you should be made aware that it is advisable to take out insurance against such costs, as this did not even occur to us before booking the trip. If we had known we would have thought differently as the trip was advertised as being suitable for all ages it did not seem a risky trip to do

We would like the advert to advise people , of the potential dangers and to explain to customers that they should take out extra insurance against any damage to the vehicles

American Adventure Tours is not responsible for the guest's prior research or knowledge of the tour. All information including rules, regulations, and our disclaimer is clearly listed and available for download. Before the tour guests are made aware of dangers that can happen on tour, it is the guest's responsibility to have adequate insurance before assuming all risks. After orientation and reading the disclaimer, if the guest was unsure about continuing with the tour, they had the opportunity to advise our guides that they do not feel comfortable and we could have made other arrangements as we did with his wife. His wife did not feel comfortable riding an ATV and we upgraded her to another vehicle at no cost to her to make sure she felt safe.
At American Adventure Tours safety is our main concern for all guests and our guides. The *** ATV tour is for beginners if they follow the rules given in orientation. After orientation and before the tour, guests are to go over the ATV and take practice laps in our staging area to be more comfortable with the machine. Every guest during orientation is informed about the dangers of the desert terrain, letting the wheels loose as it would cause harm to yourself, another guest, the desert terrain, or roll over of the equipment. Guest are informed in orientation that they are responsible to pay for any damages to any equipment that they abuse, damage, or lose and is stated in our Participant Agreement, release and assumption of risk disclaimer that every guest reads and signs. The guest is advised to maintain the proper following distance and if they are unable to see because of the dust, they should slow down until it is clear. Every turn, split in the road, our guides make sure that the guest follows the correct path and/or our guides will stop at every cross, intersection to ensure all guest are accounted for. Per our guides, the tour was going down a wide trail at 15 mph. When the incident happened, our guides were immediately there to assists the guest. After review of the incident, it had appeared there had been drift marks left by the guest before the incident. Guests signed our orientation check list that clearly states no jumping, fishtailing, or stunts are allowed at any time. It was the guest choice to ride to close to the other guest and to ride in unsafe conditions for himself as he was not following the safety guidelines given in orientation.
Guests are to follow the rules given and signed in orientation, failure to obey these rules results in incidents causing the guest to be fully responsible for the any damages to any equipment that they abuse, damage, or lose. American Adventure Tours never charges the guest for labor or the time the machine is down. Guests are only responsible for the parts needed to repair the equipment. At the time of the incident, the quest was advised of the total amount of $1,525.00 was due for the damages. After talking with the guest, we had our mechanic go through the ATV once more. After further review of the ATV, we provided the guest with a refund of over $500. The guest then proceeded to contact our third-party booking company *** who advised us that the guest is requesting a refund from them of $1,000 due to the incident.

Again, the guests are informed in orientation that they are responsible to pay for any damages to any equipment that they abuse, damage, or lose and that is stated in our Participant Agreement, release and assumption of risk disclaimer that every guest reads and signs before getting on any machine. This refund was denied as the guest failed to follow the rules given and signed in orientation, failure to obey these rules results in incidents causing the guest to be fully responsible for the any damages to any equipment that they abuse, damage, or lose. Our disclaimer also states the guest has certify, meaning to pay or have adequate insurance to cover any or damage that they may cause of suffer while participating, or else agree to bear the costs of such injury or damage to themselves. They further certify that they are willing to assume the risk of any medical or physical conditions they may have.
